As discussed in a Sunshine Meeting with City of Miami officials and various stakeholder representatives
on April 11, 2019, assistance from the City is needed to maximize the project site for the new civil and
probate courthouse through the approval of an aerial easement by the City Commission before May 23,
2019.
The project site selected by the Board is a County -owned lot bounded by the Metrorail on the west, NW
1 Avenue on the east, NW 1 Street on the north, and Flagler Street on the south. Attached to this letter is
an aerial depiction of the project site.
County staff has determined that in order to accomplish the most efficient courtroom to floor ratio on the
project site, aerial rights must be obtained above the public right-of-way alongside NW 1 Avenue to allow
upper floors to overhang a few feet above the right-of-way. NW 1 Avenue and the corresponding right-
of-way are controlled by the City of Miami. County staff met with the Department of Resilience & Public
Works and was advised that these rights can only be obtained through approval of an aerial easement by
the City Commission.
The County respectfully requests that the City prepare and expedite the approval of an aerial easement
in coordination with the County Attorney's Office so that the courthouse project can proceed as
scheduled. A final RFP is scheduled to be issued on May 23, 2019 and approval of the easement must be
accomplished beforehand so that it can be incorporated into each developer team's final design concepts.

We are in receipt of your letter request to encroach into portions of NW 1s Avenue between West
Flagler Street and NW 15t Street. The letter dated April 12th, 2019 states that the upper floors of the
subject project will "overhang a few feet" into the street. Upon review, we were concerned that there is
need for detailed information depicting the proposed aerial encroachment, prepared by a Florida
licensed professional surveyor and mapper in accordance with Florida Standards of Practice in Chapter
5J-17, Florida Administrative Code, to move this forward.
Further to this review, and in communication with staff, it is my understanding that the County Internal
Services Department (ISD) through Dawn M. Soper has today emailed our staff a legal description of the
requested encroachment portions of NW 151 Avenue, accompanied with sketches, showing details of the
proposed aerial easement for our consideration and review. The said legal description shows that the
encroachment will not "overhang a few feet" but will impact 9-feet of the public street.
With the completion of our preliminary review, we will be coordinating further with ISD in preparing an
agenda package that will be scheduled for consideration and action of the Miami City Commission. We
anticipate this process to be accomplished at the earliest possible opportunity. Further, please be aware
that pursuant to Miami City Code Section 55-14, "encroachments onto, into, below, and/or above rights
of -way, public easements, private easements, or emergency access easements" are subject to certain
restrictions. Given your stated project schedule deadline, please feel free to contact Mr. Alan Dodd, PE,
Director of Resilience and Public Works to facilitate this request.
