HomeMy WebLinkAboutOrdinanceCity of Miami Ordinance Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3517 Final Action Date: 5/23/2019 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "T6-8-L," URBAN CORE - LIMITED, TO "T6-12-L," URBAN CORE - LIMITED, OF APPROXIMATELY 0.55 ACRES (23,939 square feet) OF REAL PROPERTIES LOCATED AT APPROXIMATELY 1136 NORTHWEST 8 AVENUE, 1146 NORTHWEST 8 AVENUE, 1145 NORTHWEST 11 STREET ROAD, AND 1157 NORTHWEST 11 STREET ROAD, MIAMI, FLORIDA; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Omega Development Corp. ("Applicant") has submitted an application to change the zoning classification from "T6-8-L," Urban Core — Limited, to "T6-12-L," Urban Core - Limited, for the properties located at approximately 1136 Northwest 8 Avenue, 1146 Northwest 8 Avenue, 1145 Northwest 11 Street Road, and 1157 Northwest 11 Street Road, Miami, Florida; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on October 18, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-17-077 by a vote of seven to two (7-2), Item No. PZAB. 6, recommending approval with conditions of the zoning change; and WHEREAS, the Applicant intends to develop an Attainable Workforce Housing rental building on the subject properties; and WHEREAS, the proposed zoning change is in harmony with the established land use pattern and the adjacent and nearby districts; and WHEREAS, the proposed zoning change and development is in keeping with the goals, objectives, and policies of the City of Miami's ("City") Comprehensive Neighborhood Plan; and WHEREAS, the proposed zoning change is consistent with the goals and objectives of Ordinance No. 13114, as amended, the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and WHEREAS, the proposed zoning change will increase the height of the buildings allowed on the subject properties; and WHEREAS, the proposed zoning change is not out of scale with the needs of the neighborhood and the City; and WHEREAS, the proposed zoning change will contribute to the improvement of development of the properties in the adjacent area in accordance with existing regulations; and City of Miami Page 1 of 3 File ID: 3517 (Revision:) Printed On: 3/7/2025 File ID: 3517 Enactment Number: WHEREAS, the Applicant has voluntarily submitted a restrictive covenant to run with the land to develop Attainable Workforce Housing rentals on the site; and WHEREAS, the Miami 21 Code allows developments that provide Attainable Workface Housing in T5 Transect Zones or higher and located within a quarter (') mile of a Transit Corridor or a half (%2) mile of a Transit Oriented Development ("TOD") that do not abut a T3 Transect Zone certain relaxations regarding Height, Parking, maximum Lot Size, Setback, Frontage Line, Liner, Floorplate, and Density requirements; and WHEREAS, in exchange for the benefit of utilizing the aforementioned relaxations to the standards set forth in the Miami 21 Code, the Applicant agrees to rent twenty percent (20%) of the Dwelling Units in the Attainable Mixed -Income Housing Development to Households earning up to fifty percent (50%) of the Area Median Income ("AMI") and the balance of the Dwelling Units to Households earning up to 140% of the AMI as required pursuant to Section 3.15.2.a of the Miami 21 Code; and WHEREAS, the proposed zoning change will maintain the same or similar population density pattern and thereby does not increase and overtax the load on public facilities such as schools, utilities, and streets; and WHEREAS, the subject properties are within easy walking distance to Culmer Station on the Metrorail rapid transit system which will provide solo driver trip alternatives to residents of the site; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants to approve this proposed zoning change as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Zoning Atlas of Ordinance No. 13114, as amended, is further amended by changing the zoning classification from "T6-8-L", Urban Core — Limited, to "T6-12- L", Urban Core - Limited, for approximately 0.55 acre (23,939 square feet) of real properties located at 1136 Northwest 8 Avenue, 1146 Northwest 8 Avenue, 1145 Northwest 11 Street Road, and 1157 Northwest 11 Street Road, Miami, Florida, as more particularly described in Exhibit "A", attached and incorporated. Section 3. The covenant voluntarily proffered by the Applicant, attached herein as Exhibit "B", is accepted by the City Commission. The covenant shall be recorded in the Miami - Dade County records within thirty (30) days of the City Commission's adoption of this Ordinance and the Applicant shall provide a recorded copy to the City Attorney's Office and the Planning Department.
