A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO TAKE ANY AND ALL ACTIONS REGARDING ALLEGATIONS THAT
CERTAIN PARKING LOT OWNERS AND OPERATORS ARE IMPROPERLY ISSUING
FAKE PARKING TICKETS TO MOTORISTS WHO PARK ON THEIR LOTS.
WHEREAS, the City of Miami ("City") has received numerous allegations of certain
parking lot owners and operators placing fake parking tickets on the windshields of their
customers in the event that the customer either did not pay or the customer's time for parking
has expired; and
WHEREAS, these fake parking tickets are designed to look like real Miami -Dade County
parking tickets in form and appearance and including the orange stripe that is identical to the
official Miami -Dade County Uniform Parking Citation; and
WHEREAS, there is no basis in the Code of the City of Miami, Florida, as amended
("City Code"), or the Code of Metropolitan Miami -Dade County, Florida, as amended ("County
Code"), for a private parking lot owner or operator to issue such parking violations, thereby
rendering the parking tickets null and void; and
WHEREAS, unsuspecting motorists may not realize that they have received a fake
parking ticket, versus a real Miami -Dade County Uniform Parking Citation; and
WHEREAS, as a result, many unsuspecting motorists are paying the fake violations to
and thereby unjustly enriching the parking lot owner and operator; and
WHEREAS, it is in the best interests of the City that the City Manager take any and all
appropriate action to investigate the practice of the issuance of fake parking tickets, to
coordinate an appropriate action plan to prevent the practice, and to report his findings and
actions back to the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Resolution.
Section 2. The Miami City Commission hereby directs the City Manager to take any and
all actions regarding allegations that certain parking lot owners and operators are improperly
issuing fake parking tickets to motorists who park on their lots, to coordinate an appropriate
action plan to prevent the practice, and to report the findings and any actions taken back to the
City Commission.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
