A RESOLUTION OF THE MIAMI CITY COMMISSION SCHEDULING A SPECIAL CITY
COMMISSION MEETING ON MAY 8, 2019 AT 9:00 A.M. AT MIAMI CITY HALL, 3500
PAN AMERICAN DRIVE, MIAMI, FLORIDA FOR THE PURPOSES OF DISCUSSING
AND TAKING ANY AND ALL ACTION ASSOCIATED WITH (1) A RESOLUTION OF
THE MIAMI CITY COMMISSION GRANTING/DENYING THE APPEAL FILED BY
MICHAEL SPRING, SENIOR ADVISOR, OFFICE OF THE MAYOR, DIRECTOR,
DEPARTMENT OF CULTURAL AFFAIRS, MIAMI-DADE COUNTY AND
REVERSING/AFFIRMING/MODIFYING THE DECISION OF THE MIAMI HISTORIC
AND ENVIRONMENTAL PRESERVATION BOARD'S DENIAL PURSUANT TO
SECTION 23-6.2(B)(4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, OF THE APPLICATION FOR A SPECIAL CERTIFICATE OF
APPROPRIATENESS FOR THE RESTORATION OF AN EXISTING STRUCTURE
AND NEW CONSTRUCTION OF A THREE HUNDRED (300) SEAT THEATER, A
PARKING STRUCTURE, AND EXTERIOR SPACES WITH LANDSCAPING TO A
PROPERTY LOCATED AT APPROXIMATELY 3500 MAIN HIGHWAY, MIAMI,
FLORIDA, A LOCALLY DESIGNATED HISTORIC SITE AND KNOWN AS THE
COCONUT GROVE PLAYHOUSE WITH FOLIO NUMBER 0141210450140 AND (2) A
PRIVATE ATTORNEY -CLIENT SESSION FOR PURPOSES OF DISCUSSING THE
PENDING LITIGATION IN THE MATTER OF FLAGSTONE ISLAND GARDENS, LLC,
ET AL. V. CITY OF MIAMI, CASE NO. 17-13829 CA 44, PENDING IN THE CIRCUIT
COURT OF THE ELEVENTH JUDICIAL CIRCUIT IN AND FOR MIAMI-DADE COUNTY
TO WHICH THE CITY IS PRESENTLY A PARTY, WITH THE SUBJECT OF THE
MEETING CONFINED TO SETTLEMENT NEGOTIATIONS OR STRATEGY
SESSIONS RELATED TO LITIGATION EXPENDITURES.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. A Special City Commission Meeting is hereby scheduled for May 8, 2019 at
9:00 a.m. at Miami City Hall, 3500 Pan American Drive, Miami, Florida for the purposes of
discussing and taking any and all action associated with a Resolution of the Miami City
Commission granting/denying the appeal filed by Michael Spring, Senior Advisor, Office of the
Mayor, Director, Department of Cultural Affairs, Miami -Dade County and
reversing/affirming/modifying the decision of the Miami Historic and Environmental Preservation
Board's denial pursuant to Section 23-6.2(b)(4) of the Code of the City of Miami, Florida, as
amended, of the application for a special certificate of appropriateness for the restoration of an
existing structure and new construction of a three hundred (300) seat theater, a parking
structure, and exterior spaces with landscaping to a property located at approximately 3500
Main Highway, Miami, Florida, a locally designated historic site and known as the Coconut
Grove Playhouse with Folio Number 0141210450140 and (2) a private attorney -client session
for purposes of discussing the pending litigation in the matter of Flagstone Island Gardens, LLC,
et al. v. City of Miami, Case No. 17-13829 CA 44, pending in the Circuit Court of the Eleventh
Judicial Circuit in and for Miami -Dade County to which the City is presenting a party, with the
subject of the meeting confined to settlement negotiations or strategy sessions related to
litigation expenditures.
Section 2. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
