HomeMy WebLinkAboutR-19-0135City of Miami Resolution R-19-0135 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5558 Final Action Date: 4/11/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE MUTUAL AID AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI, NORTH BAY VILLAGE, AND THE CITY OF PINECREST TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ENSURE PUBLIC SAFETY AND ADEQUATELY RESPOND TO INTENSIVE SITUATIONS, INCLUDING, BUT NOT LIMITED TO, NATURAL AND MANMADE DISASTERS OR EMERGENCIES, AS DEFINED UNDER THE FLORIDA MUTUAL AID ACT OF CHAPTER 23, PART 1, FLORIDA STATUTES. WHEREAS, there are natural and man-made challenges faced by the Miami Police Department ("MPD") and other municipal police departments that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the municipal police departments; and WHEREAS, the City of Miami ("City"), North Bay Village, and the City of Pinecrest (collectively, "Participating Municipalities") wish to enter into Mutual Aid Agreements ("MAAs") to ensure that preparation and resources from their law enforcement agencies will be adequate to address natural and manmade challenges, to protect the public peace and safety, and to preserve the lives and property of the people of the City and the Participating Municipalities; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into mutual aid agreements; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into interlocal agreements for purposes of permitting local governmental units to make the most efficient use of their powers, by enabling them to cooperate with other localities on a basis of mutual advantage, and thereby, to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geography, economic population, and other factors influencing the needs of the local communities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized' to execute MAAs, in substantially the attached form, with the Participating Municipalities, to receive and extend mutual aid in the form of law enforcement services and resources, to ensure public safety and adequately respond to intensive situations, including, but not limited to, natural or manmade disasters or emergencies, as defined under Chapter 23, Part 1, Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City ttor ey 4/1/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
