This Waiver is required before I can to apply for the "after -the -fact" building permits needed, in order for me to comply with Code Compliance violation notice. The circumstances which support this request are communicated in my original Letters of Intent dated November 14, 2018 and December 30, 2018 which accompanied my application for Certificate of Appropriateness. All of the pre-existing issues and points made in my previous Letters of Intent still remain. The hedges and fences provide security, privacy and screening from the surrounding properties: 2-story building, alley and private residence on west side, 3-4 story units on north side, two 5-story multi -family buildings on east side (which also rents to short- term tourists and groups of young people); as well as a 9-foot concrete wall adjacent to my private walkway on east side of my property. I believe I am entitled to feel "safe" in my home. Miami 21 does not take into consideration extremely unique properties like mine (designated historic in 1989) and/or the circumstances which currently exist; some which came about after Miami 21 was implemented. I believe Miami 21 was brought about to provide for development creating a consistent look and feel to the Upper East Side. I don't believe my property fits into any pre- existing category covered by the scope of Miami 21. I believe that the current landscaping enhances and ads character to the property and creates a unique feel of a "private compound" and "country cottage" (as described in the Historic Designation Report) in the middle of the city; protecting and blocking out the development that has been built up around us. 5543-N\y+N\o\- &(\tyn4f1._ \AtA\ covn &(\0aCk.Act,A Barbara Pittman 452 NE 39th Street Miami, FL 33137 barbpitOcomcast.net 305-799-9977 January 10, 2019 Page 2 Submitted into the public record for r(s) P Z , _ � on /� �� City Clerk The recently completed Miami Bay complex has had its own variances granted, allowing for the 9-foot wall opposite my property (next to a private walkway) - one of the arguments for my hedge height. I am submitting this Letter of Intent in an attempt to request that the Board grant me the Waivers needed (to allow the issues that the HEPB already approved) as to not subject my property to Miami 21 limitations and provisions in this unique circumstance.
