City of Miami Legislation Resolution Enactment Number: R-19-0122 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5499 Final Action Date:3/28/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO INITIATE THE PERMANENT RESTRICTION OF VEHICULAR ACCESS TO THE PORTION OF NORTHWEST 7TH PLACE BETWEEN NORTHWEST 32ND STREET AND NORTHWEST 34 STREET, MIAMI, FLORIDA ("NORTHWEST 7TH PLACE") ABUTTING MATER ACADEMY OF INTERNATIONAL STUDIES AND THE CORPUS CHRISTI CATHOLIC CHURCH SPORTS FIELD PURSUANT TO SECTION 54-16 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, SUBJECT TO FINAL APPROVAL OF THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS TRAFFIC DIVISION AND CERTAIN CONDITIONS AS MORE PARTICULARLY SET FORTH HEREIN. WHEREAS, Northwest 7t" Place, Miami, Florida, between Northwest 32nd Street and Northwest 34th Street ("Northwest 7th Place) runs between Mater Academy of International Studies ("Mater Academy") and the Corpus Christi Catholic Church ("Corpus Christi"); and WHEREAS, Corpus Christi requested that vehicular access to the portion of Northwest 7th Place abutting Mater Academy and the Corpus Christi sports field be prohibited to ensure the safety of the children during the following days and times: 1. Monday through Friday from 7:00 a.m. to 6:00 p.m.; and 2. Saturday from 7:00 a.m. to 2:00 p.m.; and WHEREAS, the Miami Police Department ("MPD") has reviewed the proposed prohibition of vehicular access and has no objections to the temporary closures during the specified hours; and WHEREAS, the Fire -Rescue Department ("Fire -Rescue") has recommended a siren activated gate sensor as a viable solution that would afford emergency apparatus the ability to access the school and nearby residences with minimal delays in the event of an emergency; and WHEREAS, the Solid Waste Department ("Solid Waste") has reviewed the proposed prohibition of vehicular access and has some objections to the proposed restrictions; however, the area of concern will not be affected by the proposed restriction; and WHEREAS, the City Commission believes that it is in the best interest of the public to prohibit vehicular access to the portion of Northwest 7th Place abutting Mater Academy and Corpus Christi's sports field during the days and times specified herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. It is hereby directed that vehicular access be restricted during the days and times as stated herein subject to approval of the Miami -Dade County Department of Transportation and Public Works Traffic Division ("County"). Section 3. The prohibition of vehicular access shall be subject to any requirements or conditions that may be imposed by the City's Resilience and Public Works Department, MPD, Fire -Rescue, and Solid Waste. Section 4. The City Clerk is directed to transmit a copy of this Resolution to the County. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. If the mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
