The developer shall connect as follows: 200 N.E. 62 St. (#01-3218-066-0010: Connect to existing twelve (12) inch water main located in N.E. 2 Avenue at N.E. 62 Street and extend a twelve (12) inch water main easterly in N.E. 62 Street to N.E. 2 Ct., interconnecting to an existing twelve (12) inch water main at that location. 6200 N.E. 62 St. (#01-3218-024-0180/ -0200): Connect to an existing twelve (12) inch water main in N.E. 62 St. at N.E. 4 Ct. and extend a twelve (12) inch water main northerly in N.E. 4 Ct. to the N.E. corner of the property, interconnecting to an existing twenty (20) inch water main at that location. Properties along N.E. 62 St. at N.E. 4 Avenue: Connect to an existing twelve (12) inch water main in N.E. 62 St., east of N.E. 2 Ct., and extend a twelve (12) inch water main easterly in N.E. 62 St. to the "most eastern" N.E. 4 Avenue, interconnecting to an existing eight (8) inch water main at that location., Also, connect to proposed twelve (12) inch water main in N.E. y62 Street at the "western" N.E. 4 Avenue and extend a Twelve (12) inch water main northerly in "western" N.E. 4 Avenue to the N.W. corner of the developer's property, interconnecting to an existing eight (8) inch water main at that location. Also, cut, plug, and abandon the existing six (6) inch and eight (8) inch water mains along proposed twelve (12) inch water mains. Properties along N.E. 61 St.: Connect to an existing twelve (12) inch water main in N.E. 61 St. halfway between N.E. 3 & 4 Avenue, and extend a twelve (12) inch water main easterly in N.E. St. to N.E. 4 Avenue, interconnecting to an existing twelve (12) inch water main at that location. Also, cut, plug, and abandon the exiting four (4) inch water main along the proposed twelve (12) inch water main. Properties along N.E. 60 St.: Connect to an existing twelve (12) inch water main in N.E. 60 St. 1 Water and Sewer LOA (18-357102) Properties along N.E. 2 Avenue: Connect to an existing twelve (12) inch water main that abuts the properties in N.E. 2 Avenue. Any public water main extension within the property shall be twelve (12) inch minimum diameter. If two (2) or more fire hydrants/fire services are to be connected to a public water main extension, then the water system shall be looped with two (2) points of connection. For sewer service, the proposed allocation of 503,952 GPD will add 7.32 hours to the proposed NAPOT of P.S. 30-0044. The new NAPOT of P.S. 30-0044 including this allocation will result in 11.82 hours, which will exceed the established ten hours NAPOT criteria. Therefore, Pump Station 30-0044 requires to be upgraded by the developer prior of accepting this allocation. At the time this project applies for an Agreements an analysis will be performed and the requirements for the pump station upgrade will be provided. The following gravity sewer upgrades are required to handle the substantial increase in flow: N.E. 2 Avenue: Replace existing eight (8) inch gravity sewer with ten (10) inch gravity sewer from manhole 0037 to 0022. Replace existing eight (8) inch gravity sewer with twelve (12) inch gravity sewer from manhole 0022 to 0098. N.E. 67 St.: Replace existing eight (8) inch gravity sewer with twelve (12) inch gravity sewer from manhole 0098 to 0007. Replace existing ten (10) inch gravity sewer with twelve (12) inch gravity sewer from manhole 0007 to well wet P.S. 44. Also, connect to any of the existing eight (8) inch gravity sewers that abut the individual property folios. All developer's property abuts gravity sewer mains and should no required main extensions. Other points of connection may be established subject to approval of the Department. Construction connection charges and connection charges shall be determined once the developer enters into an agreement for water and sewer service, provided the Department is able to offer those services at the time of the developer's request. Information concerning the estimated cost of facilities must be obtained from a consulting engineer. All costs of engineering and construction will be the responsibility of the developer. Easements must be provided covering any on -site facilities that will be owned and operated by the Department. Please be advised that the right to connect the referenced property to the Department's sewer system is subject to the terms, covenants and conditions set forth in court orders, judgments, consent orders, consent decrees and the like entered into between the County and the United States, the State of Florida and/or any other governmental entity, including but not limited to, the Consent Decree entered on April 9, 2014, in the United States of America, State of Florida and State of Florida Department of Environmental Protection v. Miami -Dade County, Case No. 1:12-cv-24400-FAM, as well as all other current, subsequent or future enforcement and regulatory actions and proceedings. The County hereby represents and the developer acknowledges that the gravity sewer basin that will serve the developer's property, at the present time may not meet County criteria for conveying additional flows, including those of the proposed development within the developer's property. The County intends to construct the necessary improvements, and has adopted a special connection 2 Water and Sewer LOA (18-357102) charge to pay for the construction of necessary improvements in accordance with County Ordinance No. 13-57. The developer acknowledges and agrees that it shall pay to the County said special connection charge in the amount of four dollars and twenty-four cents ($4.24) per average daily gallon, for any new or increased sewer service for the developer's property. Said payment shall be a condition precedent to any obligation on the part of the County to provide service to the property. Notwithstanding the preceding, nothing contained herein shall obligate the County to provide service to the property if said service is in contravention of any consent decree or order to which the County is a party, or is in convention of any rule, law, or statute. The Department makes no representations as to the likely date the referenced improvements will be placed into service, and developer shall have no cause of action, at law or equity, against the County arising out of the construction of said improvements. This letter is for informational purposes only and conditions remain in effect for thirty (30) days from the date of this letter. Nothing contained in this letter provides the developer with any vested rights to receive water and/or sewer service. The availability of water and/or sewer service is subject to the approval of all applicable governmental agencies having jurisdiction over these matters. When development plans for the subject property are finalized, and upon the developer's request, we will be pleased to prepare an agreement for service, provided the Department is able to offer those services at the time of the developer's request. GENERAL The proposed Magic City project is located in the City of Miami and is bounded on the north by NE 64th Terrace, on the east by NE 4th Court, on the south by NE 59th Terrace and on the west by NE 2nd Avenue. The project consists of thirty-seven existing parcels on which MCD Miami, LLC and its affiliates propose to construct mixed use buildings. The mixed use buildings may contain retail, office, residential, other commercial and/or parking garage elements. Please see Appendix A for Special Area Plan dated June 20, 2018. POTABLE WATER The proposed Magic City project is within Miami -Dade Water and Sewer Department (MDWASD) water service area. The majority of the existing potable water and sewer infrastructure in the general area of the project site is composed of 12 inch diameter potable water mains that are owned and operated by MDWASD. See attached Appendix A Figure 2 and 3 depicting the proposed water distribution system infrastructure improvements. The existing water distribution system serving the general project area is anchored by an existing 30 inch diameter potable water main that runs along NE 67th Street. However, there are gaps in the existing potable water infrastructure between the 12 inch diameter mains that are currently served by smaller 4, 6 and 8 inch diameter mains. A Letter of Availability (LOA) from MDWASD dated August 22, 2017 (see Appendix C) was obtained based on a previous Special Area Plan concept book. A revised LOA for the Special Area Plan dated June 20, 2018 will be processed through MDWASD. Based on the obtained LOA, below are the MDWASD required improvements to the infrastructure serving the project: Technical Memorandum Utility Analysis Memorandum Magic City Innovation District SAP Miami, FL Langan Project No.: 300217301 21 December 2017 (Revised: 21 June 2018)- Page 2 of 7 All water mains 4, 6, and 8 inch in diameter shall be replaced with 12 inch diameter water main and the 4, 6, and 8 inch diameter mains shall be abandoned in place. All existing water services and fire hydrant branches from the 4, 6, and 8 diameter mains shall be transferred to the proposed 12 inch diameter water mains. NE 4th Court: Tap the existing 12 inch diameter potable water main located at the intersection of NE 62"d Street and NE 4' Court and extend a 12 inch diameter water main north along NE 4' Court to the northeast corner of Parcel 3 and connect to the existing 20 inch diameter potable water main on NE 4th Court. The proposed building on Parcel 3 shall be served potable water and fire water from the proposed 12 inch diameter potable water main. NE 62"d Street: Tap the existing 12 inch diameter potable water main located at the intersection of NE 2"d Avenue and NE 62"d Street and extend a 12 inch diameter water main east along NE 62nd Street and connect to an existing 12 inch diameter potable water main at the intersection of NE 62"d Street and NE 2nd Court. In addition, tap the existing 12 inch diameter potable water main located on NE 62nd Street about 300 feet west of the intersection of NW 2nd Avenue and NW 62"d Street and extend west along NE 62nd Street to the intersection of NE 4th Avenue and connect to an existing 8 inch diameter water main at that location. The proposed buildings on Parcel 14 shall be served potable water and fire water from an existing or proposed 12 inch diameter water main. In addition, the buildings on Parcel 5 and 9 shall be served potable water and fire water from the proposed 12 inch diameter potable water main. NE 4th Avenue: Connect to the previously described proposed 12 inch diameter potable water main at the intersection of NE 62nd Street and NE 4th Avenue and extend a 12 inch diameter water main north along NE 4th Avenue to the northeast corner of Parcel 4 and connect to the existing 8 inch diameter water main at that location. The proposed buildings on Parcel 1 and 4 shall be served potable water and fire water from the proposed 12 inch diameter potable water main. NE 61' Street: Tap the existing 12 inch diameter potable water main at a location about 900 feet east of the intersection of NE 2"d Avenue and NE 61 st Street and extend a 12 inch diameter water main east along NE 61st Street to the intersection of NE 4th Avenue and NE 61st Street and connect to an existing 12 inch diameter water main at that location. Proposed Parcels 16, 12, 10 and 6 shall be served potable water and fire water from a proposed or existing 12 inch diameter water main. NE 60th Street: There is an existing 12 inch diameter potable water main that runs along NE 60th Street between NE 2nd Avenue and NE 4' Avenue from which proposed Parcel 17, 15, 13, 11, 8 and 7 shall be served potable water and fire water. Based on our review of the updated Special Area Plan dated June 20, 2018 we do not anticipate MDWASD will require additional improvements to the water infrastructure beyond those listed above. LANGAN Technical Memorandum Utility Analysis Memorandum Magic City Innovation District SAP Miami, FL Langan Project No.: 300217301 21 December 2017 (Revised: 21 June 2018)- Page 3 of 7 SANITARY SEWER The proposed Magic City project is within Miami -Dade Water and Sewer Department (MDWASD) sanitary sewer service area. The area in which the project is located is served by gravity sanitary sewers that convey the collected sewage to existing MDWASD pumping station (PS-44) located at the southeast quadrant of the intersection of NE 67' Street and NE 4' Avenue. The general flow direction of sewage collected in the PS-44 sanitary sewer basin is from NE 4th Avenue west to NE 2"d Avenue and north along NE 2"d Avenue to NE 67th Street and west along NE 67tht Street to PS- 44. The main sanitary sewage conveyance trunk line runs along NE 2"d Avenue and NE 67th Street. This trunk line is composed of an existing 8 inch diameter gravity sewer running along NE 2"d Avenue from NE 60th Street to the intersection of NE 2"d Avenue and NE 67th Street and along NE 67tht Avenue for a length of about 690 feet with the remaining 430 feet to PS-44 composed of 10 inch diameter gravity sewer. Additionally, the existing 8 inch diameter gravity sewer will be replaced with approximately 670 feet of 10 inch diameter gravity sewer beginning at the intersection of NE 2"d Avenue and NE 60th Street to the intersection of NE 2"d Avenue and NE 62"d Street. NE 67th Street: Replace the existing 8 inch diameter gravity sewer with 12 inch diameter sewer pipe along NE 67th Street for a distance of about 690 feet west and replace the remaining 430 feet of existing 10 inch diameter gravity sewer with 12 inch diameter pipe to PS-44. Based on our review of the updated Special Area Plan dated June 20, 2018 we anticipate MDWASD will request the following additional improvements: NE 60th Street: Replace existing 8 inch diameter gravity sewer with 10 inch diameter sewer pipe along NE 60th Street. The replacement will begin at the terminal manhole south of the intersection of NE 60th Street and NE 4th Avenue to the intersection of NE 60th Street and NE 2"d Avenue. PS-44: Based on the Miami Dade County Pump Station Capacity Estimator the projected NAPOT (Nominal Avg. Pump Operating Time) will be greater than 10 hours a day. Therefore, improvements will need to be made to PS-44 to bring the proposed NAPOT below 10 hours per day. LANGAN Technical Memorandum Utility Analysis Memorandum Magic City Innovation District SAP Miami, FL Langan Project No.: 300217301 21 December 2017 (Revised: 21 June 2018)- Page 4 of 7 SPECIAL SEWER BASIN The project is located in a Special Sanitary Sewer Basin. This is a sewer basin that is undergoing improvements to the regional force mains and sewer pumping stations. MDWASD will collect a sewer improvement fee from the developer. The revenue generated by this fee will be put forth by the Department to improve the general sewage conveyance system of the basin. MDWASD has advised that at this moment in time a completion date to the improvements has not been determined however, the Department anticipates that the improvements will be completed by the time construction begins on the Magic City project components. MICELLANEOUS UTILITIES Florida Power and Light (FPL) has confirmed that sufficient capacity is available to provide electric service to the Magic City project. The service will be provided in accordance with the applicable rates, rules and regulations. Please see attached availability letter provided by FPL in Appendix C. TECO Peoples Gas is the gas provider for the general area where the Magic City project is located. TECO has confirmed that natural gas service is available in the project area. When the project is further along, TECO will require the service load calculations to provide detail plans of the underground service lines for the project. Please see attached availability letter provided by TECO in Appendix C. AT&T is the telephone service utility for the general area where the Magic City project is located. AT&T has confirmed that service is available. When the project is further along, AT&T will require more information to provide detail plans of services to the individual building of the project. Please see attached availability letter provided by AT&T in appendix C Comcast is the internet communication service provider for the general area where Magic City is located. Comcast has confirmed that internet communication is available to the serve the Magic City project. Please see attached availability letter provided by Comcast in Appendix C. STORMWATER MANAGEMENT The various parcels of Magic City shall require a permit from the Miami -Dade County Department of Regulatory and Economic Resources (RER) Water Control Section. The water control section issues standard drainage permits for projects that encompass less than 2 acres and an Environmental Resource Permit (ERP) for projects that encompass more than 2 acres. The drainage system that can be implemented to serve the parcels of Magic City may consist of a combination of a surface water body, exfiltration trenches or drainage wells. Magic City is an infill project and therefore, space for a surface water body is not practical because the minimum horizontal requirements for a surface water body would require utilizing entire parcels leaving no developable area in the parcel. A more practical approach is to utilize drainage wells, exfiltration trenches or a combination to address the stormwater management requirements. o For sites smaller than 2-acres a DERM Water Control Review is required and the following criteria will apply to the project: LANGAN Technical Memorandum Utility Analysis Memorandum Magic City Innovation District SAP Miami, FL Langan Project No.: 300217301 21 December 2017 (Revised: 21 June 2018)- Page 5 of 7 • Site drainage shall be designed for a 5-year 1-hour event. • Stormwater quality to be 1" over the entire site or 2.5" over the impervious area, whichever is greater. o For sites with an area of 2-acres or more an Environmental Resource Permit (ERP) is required and the following criteria will apply to the project: • Site drainage shall be designed for a 5-year 1-hour event. • RER will allow the peak stage calculation for the 100-year 72-hour and the 25-year 72-hour design storm events to consider discharge through the drainage wells provided that a safety factor of two is applied to the number of wells required or exfiltration trench length required to serve the 5-year 1- hour event. • The peak stage of the 100-year 72-hour event shall not peak above the proposed finished floor elevation. • The peak stage of the 25-year 72-hour event shall not peak above the proposed perimeter grading of the site. • RER will consider a pre versus post -development runoff analysis of the project site. Post -development runoff for a 25-year 72-hour event can't exceed the pre -development. • Stormwater quality shall be provided for 1" over the entire site or 2.5 times over the impervious area, whichever is greater. Because of the difference in permitting requirements based on the 2-acre threshold, we recommend permitting each parcel as an individual project. The attached Figure 1 in Appendix D depicts the required number of wells and exfiltration trench for each parcel for this scenario based on preliminary calculations. We have analyzed a second scenario in which parcels 6, 7, 10, 11, 12, 13, 15, 16 and 17 are permitted as one project as shown in Appendix D Figure 2. For this scenario an ERP will be required for the project, the preliminary calculations were developed for the following requirements: • Site drainage (no standing water above drainage structure grates) shall be designed for a 5-year 1-hour event. • RER will allow the peak stage calculation for the 100-year 72-hour and the 25-year 72-hour design storm events to consider discharge through the drainage wells provided that a safety factor of two is applied to the number of wells required for the 5-year 1-hour event. • Stormwater quality to be 1" over the entire site or 2.5" over the impervious area, whichever is greater. LANGAN Technical Memorandum Utility Analysis Memorandum Magic City Innovation District SAP Miami, FL Langan Project No.: 300217301 21 December 2017 (Revised: 21 June 2018)- Page 6 of 7 We did not perform the following calculations for this preliminary analysis, due to the early stage of the project and the lack of information in regards to existing topography and the proposed development: • 100-year 72-hour event peak stage shall not peak above the proposed finished floor elevation. • 25-year 72-hour event peak stage elevation shall not peak be above the perimeter grading of the site. • RER will consider a pre versus post -development runoff analysis of the project site. Post -development runoff for a 25-year 72-hour event can't exceed the pre -development. The following assumptions were made in order to complete the preliminary stormwater management analysis: • Well discharge rate is assumed to be 500 gallons per minute per foot of head per well. • The available well head is assumed to be six feet per well. • The percolation rate for the exfiltration trenches is assumed to be 5x10-4 cfs/sf-ft of head. This rate will have to be confirmed with percolation tests before beginning the detail design of the drainage and stormwater management system. FINISHED FLOOR ELEVATION The site is located within FEMA Flood Zone X, which is defined as areas outside of the 500- year floodplain. In accordance with Section 20-3 of the City of Miami Code of Ordinances, the finished floor elevation (FFEL) shall be a minimum of 4-inches above the base elevation. In this case, the base elevation is "established by the Miami -Dade County flood criteria map, or the elevation of the crown of road or street abutting such building site, whichever is higher." The adjacent road crown elevations shown on the table below are ranges based on limited available information shown on the surveys received from Leiter, Perez & Associates, Inc. on October 12th, 2017 and supplemental information from Google Earth software. Additional detailed topographic information for the existing roadways is necessary in order to confirm the FFELs. However, for preliminary planning purposes the table below provides a general indication of the expected finished floor elevations for the Magic City project buildings.
