As I commented with you I'm a 100% for the recovery of the "zoning T48" for Costa Bella Association Inc. and for the rest of the block affected by the "red lining" that downgraded us from T48 to T8. As you know the building where I have been living for 29 years, has "lost" 13 floors, with the downgrading zoning, in total 171 apartments. So I reiterate the need to recover the T48 zoning for our building and for the rest of the block, on Brickell Bay Drive, between SE 14 St and 15th Road, Miami F1 33131. Suarez City of Miami 3500 Pan American Drive Miami, Florida 33133 RE: Zoning of Property Located on 1402 Brickell Bay Drive, Miami, Florida Dear Mayor Suarez: The Commodore Bay Condominium Association, Inc., located at 1402 Brickell Bay Drive, Miami, Florida (the "Property") within the City of Miami (the "City"), will be seeking to bring the Property's zoning designation into conformity with the surrounding Brickell area and its Ordinance 11000 zoning designation. Brief Zoning History. The Property was platted in 1914 as part of the Amended Plat of Point View, recorded in the Official Records of Miami -Dade County at Plat Book 2, Page 93. While it is true that the Point View area, now Brickell Bay Drive, was initially developed with large single- family homes, over time the area was developed into a high -density residential area. In 1990, Ordinance 11000 rezoned the Property to permit multi -family high -density residential (R-4). The R-4 Zoning District allowed for a maximum density of one hundred and fifty (150) units per acre. Building height was based on the width of the abutting road right-of-way. The allowable floor area ratio (FAR) in R-4 was a maximum of 1.72 times the gross lot area. Under the Ordinance 11000 Zoning Code, the Commodore Bay Condominium was constructed as a multi -family high -density residential development in 1994. In 2010, Miami 21 downzoned the Commodore Bay Condominium to T6-8R Transect Zone. This Transect limits height to eight (8) stories (up to twelve (12) stories with Public Benefits). As a result of the downzoning, all of the properties located along Brickell Bay Drive were excluded from the high - density residential designation of the neighboring properties. The area north and west of the Property is designated T6-48A-O and the area south, which was also previously zoned R-4, is designated T6-24A-R. See Figure 1 and Figure 2 below. Accordingly, the properties located along Brickell Bay Drive, such as the Commodore Bay Condominium, have been unfairly excluded from the shift in zoning and permissible uses of the greater Brickell area.
