Gonzalez, Ph.D. City Manager DATE: March 4, 2019 SUBJECT: Four Fifth Waiver, Ultimate Catering, LLC FROM: Daniel Rotenberg / ) REFERENCES: Director, Department of Real Estate and Asset Management ENCLOSURES: Background Revocable License Agreement, between the City of Miami ("City") a municipal corporation of the State of Florida, and Ultimate Catering LLC's (the "Concessionaire") for concession services located at Police Headquarters Cafeteria, 400 N.W. 2nd Avenue, Miami, Florida 33128 (the "Premises"). The City of Miami desires to have quality food and beverage service to be provided through concession operations in the City of Miami Police Headquarters Building, located at 400 N.W. 2nd Avenue, Miami, Florida 33128 (the "Premises") without interruption. The current concessionaire, Lopetegui Corporation INC., vacated the Premises on March 1, 2019. Concession operations are vital to the men and woman of the Miami Police Headquarters Building since many have limited times allocated for breaks and lunches. Employees stationed within Miami Police Headquarters Building would have to order to food from outside vendors at higher prices or drive to various locations within Downtown Miami with limited time for lunch breaks, especially 911 operations, if no Concessionaire was present. Maintaining a quality food service Concessionaire within the building will provide an invaluable service to the men and women of the Miami Police Department by providing quality and nutritious food as well as increase moral. Recommendation In Tight of the above stated, approval of a waiver of the formal requirements of competitive sealed bidding methods as not being practicable or advantageous to the City as set forth in the City Code of Ordinances, as amended, specifically Section 18-85 (A), and the affirmation of these written findings and the forwarding of the same to the City Commission for ratification by a four -fifths vote is respectfully requested. sapproved .
