HomeMy WebLinkAboutAgenda Item Summary FormAGENDA ITEM SUMMARY FORM File ID: #5539 Date: 02/22/2019 Commission Meeting Date: 03/14/2019 Requesting Department: Office of Resilience and Sustainability Sponsored By: District Impacted: All Type: Resolution Subject: Bid Waiver - Urban Land Institute Advisory Panel Purpose of Item: A Resolution of the Miami City Commission, with attachment(s), by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, ratifying, confirming, and approving the City Manager's recommendation and written findings, pursuant to section 18-85(a) of the code of the City of Miami, Florida, as amended; waiving the requirements for competitive sealed bidding/proposal methods as not being practicable or advantageous to the City of Miami for the professional services of the Urban Land Institute ("ULI") Advisory Panel, and all work of ULI in relation thereto; further authorizing the City Manager to execute the attached Advisory Services Agreement between the City of Miami and Downtown Development Authority (DDA) as sponsors and the Urban Land Institute (ULI) as the service provider to obtain written advice and recommendations from the ULI on resilience, economic development and planning strategies for the Miami Waterfront at a total cost of $135,000.00, the Downtown Development Authority and City of Miami agree to split the cost equally with each entity paying a total of $67,500.00 for the panel; further authorizing the City Manager to negotiate and execute the attached advisory services agreement, for said purpose. Background of Item: The City of Miami has been on the forefront of resilient planning and recently started evaluating innovative ways to address the impacts of sea level rise and climate change through new and more adaptive strategies. Of special interest is Miami's first line of defense, its Waterfront. The Urban Land Institute will arrange for panel members to visit the location upon which its recommendations are sought for a period of not less than five days, starting on June 2, 2019. During that time, the panel, directly through its staff, will study designated area; consult with public and private officials, representatives of other relevant organizations, and other individuals familiar with the problems involved; and prepare its conclusions and recommendations which will be presented to the City, DDA and its invited guests in oral form at the close of the onsite. WHEREAS, the City of Miami ("Miami") has been on the forefront of resilient planning and recently started evaluating innovative ways to address the impacts of sea level rise and climate change through new and more adaptive strategies, especially along Miami's first line of defense, its Waterfront; and WHEREAS, pursuant to Section 18-85(a) of the City Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has waived competitive sealed bidding/proposal methods making a written finding with reasons supporting his conclusion therein; and WHEREAS, the Urban Land Institute ("ULI") maintains an Advisory Services Program for the purpose of benefitting organizations, governments and the general public through improved planning and utilization of land; and WHEREAS, the ULI will provide a suitable panel composed of members of the ULI and others who collectively have a varied and broad experience and knowledge applicable to the particular problems to be considered; and WHEREAS, the scope of the panel will include Miami's urban waterfront from Southeast 26th Street (Southern Boundary) to Northeast 36th Street (Northern Boundary) to Northwest 27th Avenue (Western Boundary) along the course of the Miami River; and WHEREAS, the ULI will arrange for panel members to visit the locations upon which its recommendations are sought for a period of not less than five (5) days, starting on June 2, 2019, during which, the panel, directly through its staff, will study designated areas; consult with public and private officials, representatives of other relevant organizations, and other individuals familiar with the problems involved; and prepare its conclusions and recommendations which will be presented to Miami, DDA and its invited guests in oral form at the close of the onsite visit, and later in written form; and WHEREAS, the ULI agrees to provide the Miami and DDA with a full -color written summary of its conclusions and recommendations illustrated with photographs and drawings, as appropriate, absorb all travel, reimbursable, contract related, and living expenses of its panel and staff while on site and provide customary workers' compensation and liability insurance for the panel members and the ULI employees; and WHEREAS, The City Manager's recommendation and written finding, attached and incorporated as Exhibit "A," that competitive sealed bidding/proposal methods are not practicable or advantageous for Miami in this instance must be ratified, confirmed, and approved by the City Commission by a four -fifths (4/5ths) affirmative vote during an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written finding, attached and incorporated as Exhibit "A," pursuant to Section 18-85(a) of the City Code are ratified, confirmed, and approved, the requirements for competitive sealed bidding/proposal methods are waived, and the selection of the Urban Land Institute to obtain written advice and recommendations from ULI on resilience, economic development, and planning strategies for the Miami waterfront, with Miami/Downtown Development Authority as co-sponsors, are approved. Section 3. The City Manager is further authorized' to execute the attached Advisory Services Agreement, in substantially the attached form, with the ULI and with the DDA as an equal co-sponsor, at a total cost of $135,000.00, which shall be divided equally between the DDA and Miami, with each sponsoring public agency paying a total of $67,500.00 for the panel, subject to allocations, appropriations, and budgetary approval having been previously made, and in compliance with applicable provisions of the City Code, including Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. APPROVED AS TO FORM AND CORRECTNESS:
