Subject: Sole Source - Integrated Ballistics Identification System
Purpose of Item:
A Resolution of the Miami City Commission, by a four -fifths (4/5ths) affirmative vote,
pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended, after
an advertised public hearing, ratifying, approving, and confirming the City Manager's
finding of a sole source; waiving the requirements for competitive sealed bidding
procedures and authorizing the City Manager to execute the IBIS Trax-HD3D
Agreement from FTI, including, but not limited to any addendum, software licenses,
training services, maintenance, and support for a period of four (4) years; allocating
funds from from the Capital Project No. 40-B183211 of the Police Department, subject
to the availability of funds and budgetary approval at time of need. Further authorizing
the City Manager to negotiate and execute all other documents, including any
amendments, renewals, and extensions, subject to allocations, appropriations and
budgetary approval having been previously made, and in compliance with applicable
provisions of the Code of the City of Miami, Florida, as amended, ("City Code"),
including, the City of Miami's Procurement Ordinance, Anti -deficiency Act, and Financial
Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable
to the City Attorney, and in compliance with applicable regulations, as may be
necessary for said purpose.
Background of Item:
The City of Miami's Police Department is in need of a system that will allow the
comparison of both types of ballistic evidence found at gun related crime scenes and
the collection of 2D and 3D images of cartridge casing evidence. These images can
then be researched in the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF)
National Integrated Ballistic Information Network (NIMIN). FTI is the only company
whose system is approved and certified to be used in the U.S. on ATF NIMIN. It also
allows users the option of performing triage of the ballistic evidence and other evidence
using the included Stereo Zoom Microscope which provides high magnification. The
System is currently in use at the Florida Department of Law Enforcement (FDLE) and
the Jacksonville Sheriff's Office (JSO) both procurements were Sole Source. The IBIS
System from FTI is the only system that can access ATF and Miami -Dade County and
fulfill all of the Miami Police Department needs.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A
FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"),
AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND
CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE, ATTACHED
AND INCORPORATED AS EXHIBIT "A"; WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE CITY
MANAGER TO EXECUTE THE IBIS TRAX-HD3D AGREEMENT FROM FORENSIC
TECHNOLOGY INC. ("FTI"), INCLUDING BUT NOT LIMITED TO THE ADDENDUM, IN
SUBSTANTIALLY THE FORM ATTACHED AS EXHIBIT "B," FOR SOFTWARE
LICENSES, TRAINING SERVICES, MAINTENANCE, AND SUPPORT FOR A PERIOD
OF FOUR (4) YEARS; ALLOCATING FUNDS FROM OFFICE OF CAPITAL
IMPROVEMENTS ("OCI") PROJECT NO. 40-B183211, NATIONAL INTEGRATED
BALLISTIC INFORMATION NETWORK, IN AN AMOUNT NOT TO EXCEED ONE
HUNDRED EIGHTY SEVEN THOUSAND THREE HUNDRED SEVENTY-SEVEN
DOLLARS ($187,377.00), SUBJECT TO THE AVAILABILITY OF FUNDS AND
BUDGETARY APPROVAL AT TIME OF NEED; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING
ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO
ALLOCATIONS, APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN
PREVIOUSLY MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF
THE CITY CODE, INCLUDING THE CITY OF MIAMI'S PROCUREMENT ORDINANCE,
ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET
FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, AND IN COMPLIANCE WITH APPLICABLE REGULATIONS, AS
MAY BE NECESSARY FOR SAID PURPOSE.
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer has made a finding that Forensic
Technology Inc. ("FTI") is the sole source manufacturer of IBIS Trax-HD3D System; and
WHEREAS, Miami Police Department ("MPD") has a need to purchase one (1) IBIS
Trax-HD-3D System; and
WHEREAS, the Purchase of the Ballistics Testing and Forensic Imaging Project will
assist the MPD with solving more gun related cases; and
WHEREAS, the findings of the Chief Procurement Officer have been approved and
adopted as the finding of the City Manager, attached and incorporated as Exhibit "A"; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive sealed bidding procedures be waived and that the procurement of
the above system, as specified, be approved; and
WHEREAS, following a published noticed made at least fifteen (15) days prior to the
award, the City Commission is ratifying and approving, by a four -fifths (4/5th) affirmative vote, the
waiver of competitive sealed bidding procedures as a sole source;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA"
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the
Code of the City of Miami, Florida, as amended ("City Code"), after an advertised public hearing,
the City Manager's finding of a sole source, attached and incorporated as Exhibit "A," is ratified,
approved, and confirmed, the requirements for competitive sealed bidding procedures are
waived, and the request to purchase an IBIS Trax-HD3D System for the MPD, from FTI, the
sole source manufacturer of IBIS Trax-HD3D, is approved.
Section 3. Funds, in an amount not to exceed One Hundred Eighty Seven Thousand
Three Hundred Seventy Seven Dollars ($187,377.00), to be allocated from the Office of Capital
Improvements ("OCI") Project No. 40-B183211, National Integrated Ballistic Information
Network.
Section 4. The City Manager is authorized' to execute the IBIS Trax-HD3D Agreement
from FTI, including but not limited to the Addendum, in substantially the form attached as Exhibit
"B," for software licenses, training services, maintenance, and support for a period of four (4)
years.
Section 5. The City Manager is further authorized1 to negotiate and execute all other
documents, including any amendments, renewals, and extensions, subject to allocations,
appropriations, and budgetary approval having been previously made, and in compliance with
applicable provisions of the City Code, including, the City of Miami's Procurement Ordinance,
Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City
Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations,
as may be necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
2 This Resolution shall become effective as specified herein unless vetoed by Mayor with ten (10) days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
