A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO RESEARCH PROPERTIES DESCRIBED AT THE FEBRUARY
14, 2019 CITY COMMISSION MEETING DURING DISCUSSION ITEM "D3.1 —
CODE ENFORCEMENT" REGARDING VIOLATIONS RELATED TO NO
CERTIFICATE OF USE, CERTIFICATE OF USE OBTAINED UNDER FALSE
PRETENSES, AND/OR PROPERTIES WITH VIOLATIONS THAT POSE LIFE -
SAFETY ISSUES, AND INITIATE INJUNCTIVE PROCEEDINGS AGAINST
SAID PROPERTIES UNTIL THE PROPERTIES ARE BROUGHT INTO
COMPLIANCE.
WHEREAS, the City of Miami ("City") is committed to protecting the health, safety and
well-being of its residents; and
WHEREAS, researching potential violations related to no certificate of use for a
business, obtaining a certificate of use under false pretenses, and/or violations related to life -
safety issues will ensure the Code of the City of Miami, Florida, as amended, are adhered to by
businesses operating in the City; and
WHEREAS, the City Commission has determined that it is in the best interest of the City
to have the City Attorney adequately research code compliance matters specifically related to
certificates of use and life -safety matters;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Attorney is hereby directed to research properties described at the
February 14, 2019 City Commission meeting during discussion item "D3.1 — Code Enforcement"
regarding violations related to no certificate of use, certificate of use obtained under false
pretenses, and/or properties with violations that pose life -safety issues and initiate injunctive
proceedings against said properties until the properties are brought into compliance.
Section 2. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'
1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
