Pursuant to Section 23-5(b) of the City Code of Ordinances, as amended, the HEPB shall obtain a written recommendation from the City Commission as to whether a property should be nominated to the National Register. Background of Item: Pursuant to Section 23-5 of the City Code of Ordinances, as amended, the HEPB shall forward to the SHPO its action on the nomination and the recommendations of the local officials. If either the HEPB or local officials, or both, support the nomination, the SHPO will schedule the nomination for consideration by the Florida National Register Review Board at its meeting scheduled for May 10, 2018. If both the HEPB and the local officials recommend a property not be nominated to the National Register, the SHPO will take no further action unless an appeal is filed with the SHPO. Support for or against a nomination must be based upon the National Register criteria. WHEREAS, the Bacardi Building Complex located at 2100 Biscayne Boulevard, Miami, Florida ("Bacardi Complex") has been a locally protected historic resource since October 6, 2009, when it was designated by unanimous decision by the Historic and Environmental Preservation Board ("HEPB"), HEPB Resolution No. 2009-64; and WHEREAS, on May 26, 2011, the City Commission denied the appeal of HEPB Resolution No. 2009-64 filed, pursuant to Section 23-4(5)(e) of the Code of the City of Miami, Florida, as amended ("City Code"), by Bacardi Imports, Inc. and modified HEPB Resolution No. 2009-64 to remove the conditions imposed by HEPB and instead modify the designation to include the conditions as modified by Bacardi Imports, Inc. and set forth in its Declaration of Restrictive Covenants; and WHEREAS, in January 2018, the State Historic Preservation Office ("State") prepared a nomination proposal, attached and incorporated as Exhibit "A," to add the Bacardi Building Complex ("Bacardi Complex") located at 2100 Biscayne Boulevard, Miami, Florida to the National Register of Historic Places ("National Register"); and WHEREAS, the State has determined that the Bacardi Complex is eligible for the National Register of Historic Places as it meets National Register Criteria C: the property embodies the distinctive characteristics of a type, period, or method of construction in the areas of architecture and art as the buildings are locally significant examples of the International style of architecture, with unique artistic flairs which disregard some of the fundamental tenets of the style, and also meets National Register Criteria Consideration G: the property is less than fifty (50) years of age and, while the Bacardi Building Complex was created in 1963, the administration building was constructed in 1973, but contributes to the significance of the complex because it follows many of the same design principles and influences as the original parts of the complex and does not detract from the resource; and WHEREAS, pursuant to Section 23-5(b) of the Code of the City of Miami, as amended ("City Code"), the Historic and Environmental Preservation Board ("HEPB") shall obtain a written recommendation from the City Commission and the Miami -Dade Board of County Commissioners as to whether a property should be nominated to the National Register; and WHEREAS, HEPB has received a favorable written recommendation from the Miami - Dade County that the Bacardi Complex should be nominated to the National Register; and WHEREAS, pursuant to Section 23-5(b) of the City Code, the HEPB shall give notice to the Property Owners and the State of Florida at least thirty (30) days but not more than seventy- five (75) days prior to the HEPB meeting at which the nomination will be considered; and WHEREAS, pursuant to Section 23-5(c) of the City Code, the HEPB shall obtain comments from the public that shall be included in the report making a recommendation; objections to being listed in the national register by the Property Owners must be notarized and filed with the Historic Preservation Office; and within thirty (30) days after its meeting, the HEPB shall forward to the State its action on the nomination and the recommendations of the local officials; HEPB shall also notify the appropriate local officials, the Property Owner, and the Applicant, of its actions which shall also be notified of the HEPB's actions; and WHEREAS, pursuant to Section 23-5(d) of the City Code, if the HEPB, local officials, or both support the nomination, the State will schedule the nomination for consideration by the State review board for the national register at its next regular meeting; and WHEREAS, pursuant to Section 23-5(d) of the City Code, if both the HEPB and the local officials recommend that a property not be nominated to the national register, the State will take no further action on the nomination unless an appeal is filed with the State; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission recommends to the HEPB its approval of the State nomination to add the Bacardi Complex to the National Register. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
