HomeMy WebLinkAboutR-19-0039City of Miami Resolution R-19-0039 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5269 Final Action Date: 1/24/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN CAMILLUS HOUSE, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("CAMILLUS HOUSE"), AND THE CITY OF MIAMI ("CITY") TO PROVIDE FUNDING FOR THE CITY'S HOMELESS SHELTER PROGRAM, TO INCLUDE THE PROVISION OF SEVENTY-FIVE (75) BEDS IN THE CAMILLUS HOUSE NORWEGIAN CRUISE LINE CAMPUS EMERGENCY SHELTER, FOR NIGHTLY USAGE BY HOMELESS INDIVIDUALS AND PROVIDING OTHER ASSOCIATED AND ACCOMPANYING HOMELESS SERVICES AND CASE MANAGEMENT, SUBJECT TO SAID BEDS BEING EXCLUSIVELY DESIGNATED FOR THE CITY'S HOMELESS WHO ARE PLACED BY A MIAMI POLICE OFFICER IN ACCORDANCE WITH THE POTTINGER SETTLEMENT ("AGREEMENT") AT THE TOTAL COST OF FOUR HUNDRED SIXTY THOUSAND DOLLARS ($460,000.00), WITH CONDITIONS AS STATED IN THE AGREEMENT, PAYABLE BY THE CITY TO CAMILLUS HOUSE IN TWELVE (12) MONTHLY INSTALLMENTS ("GRANT") COMMENCING DURING THE CITY'S 2018-2019 FISCAL YEAR FOR AN INITIAL PERIOD OF ONE (1) YEAR WITH THE OPTION TO RENEW FOR FIVE (5) ADDITIONAL ONE (1) YEAR PERIODS OF CITY SPONSORSHIP GRANT FUNDING UNDER THE SAME TERMS AND CONDITIONS, SUBJECT TO THE AVAILABILITY OF FUNDING AND BUDGETARY APPROVAL; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, MODIFICATIONS, AND AMENDMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO COMPLETE AND FURTHER THE GRANT ALLOCATION AND APPROPRIATION. WHEREAS, the City of Miami ("City") is a party to a Settlement Agreement, as amended, in the matter of Michael Pottinger, et al. v. City of Miami, filed in the United States District Court, Southern District of Florida, Case No.: 88-2406-Civ-Moreno ("Pottinger Settlement Agreement"); and WHEREAS, the City, in furtherance of its continuing commitment to assist the homeless within its jurisdictional boundaries, wishes to execute an Agreement with Camillus House, Inc., a Florida not for profit corporation ("Camillus House"), in order to ensure the availability of shelter beds for the City's homeless population in accordance with the Pottinger Settlement Agreement; and WHEREAS, Camillus House has the capacity to accommodate seventy-five (75) beds in the Camillus House Norwegian Cruise Line Campus Emergency Shelter, to provide the City of Miami Page 1 of 2 File ID: 5269 (Revision:) Printed On: 4/15/2025 File ID: 5269 Enactment Number: R-19-0039 associated and accompanying homeless services and case management, and the ability to implement the City's Shelter Program ("Shelter Program"); and WHEREAS, the City's grant funding for the Shelter Program will be in an amount not to exceed Four Hundred Sixty Thousand Dollars ($460,000.00), will be available as the obligation becomes due by the City, and will be payable by the City to Camillus House in twelve (12) monthly installments ("Grant"); and WHEREAS, the Grant payments will commence during the City's 2018-2019 Fiscal Year for an initial period of one (1) year with the option to renew for five (5) additional one (1) year periods of City sponsorship grant funding under the same terms and conditions of the Agreement and subject to the availability of funds and budgetary approval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedi to negotiate and execute an Agreement, in a form acceptable to the City Attorney, between Camillus House and the City for the Grant funding of the Shelter Program to ensure the availability of shelter beds for the City's homeless population in accordance with the Pottinger Settlement Agreement, with payments commencing during the City's 2018-2019 Fiscal Year for an initial period of one (1) year with the option to renew for five (5) additional one (1) year periods of City sponsorship grant funding under the same terms and conditions and subject to the availability of funds and budgetary approval. Section 3. The City Manager is further authorizedi to negotiate and execute any and all other necessary documents, modifications, and amendments, in a form acceptable to the City Attorney, to complete the Grant allocation and appropriation. Section 4.
