This application is intended to serve as a guide in assisting you with our public hearing process. Please feel free to contact us, should you have any questions. There is no deadline to submit this application as it is presented semi-annually to the Planning, Zoning and Appeals Board and the City Commission. The application submittal date is the date stamped by Hearing Boards' staff on this page. The responses to this application must be typed and signed in black ink. All pertinent and accurate information/documentation; i.e., the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the information contained in the application and all supporting materials. Should you wish, you could bring the materials to our office for review prior to submittal to ensure completeness. You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city boards, committees and the city commission. A valid power of attorney will be required if neither applicant or legal counsel representing the applicant execute the application or desire to make a presentation before city boards, committees and the city commission. All documents, reports, studies, exhibits (8Y2x11") or other materials submitted during this process will be kept as part of the record. Any documents offered to the Planning, Zoning and Appeals Board and the City Commission, which have not been provided fifteen (15) days before the meeting as part of the agenda materials will be entered into the record at the discretion of the aforementioned Board and Commission. ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. The Property is located on the east side of SW 27 Avenue between SW 1 Street and SW 2 Street abutting Leon Medical Centers' ("LMC") Miami Center to the west. The Property is approximately 112,500 square feet (2.58 acres) in size, with approximately four hundred feet (400') of frontage on SW 1 Street and approximately three hundred fifty feet (350') of frontage on SW 2 Street. The Property consists of Lots 1 and 2 currently serving as parking lots for the existing LMC Miami Center and the remaining lots are currently multi -family and duplex uses. The City's Miami Neighborhood Comprehensive Plan ("MNCP") designates Lots 1, 2, 8 and 9 as "Low Density Restricted Commercial" and Lots 3, 4, 5, 6, 7,10,11,12, 13 and 14 as "Duplex Residential." Further, the Property is not located within an archeological conservation area. Background. Through the proposed land use amendment and rezoning, LMC seeks to satisfy a significant deficiency in the City for high quality neighborhood -based healthcare as well as promote economic development by providing employment opportunities in close proximity to major Transit Corridors. Patient demand at the existing LMC Miami Center, located at 151 SW 27 Avenue abutting the Property, is expected to rise in the coming years and LMC is proactively planning for a future where Medicare recipients will independently live and drive for longer into their golden years than have prior generations. The LMC Miami Center opened its doors in 1996 as the first LMC facility in South Florida. Since then, LMC has provided unparalleled medical care and compassion to hundreds of thousands of South Florida residents. LMC has grown to become one of the most prestigious and in -demand healthcare institutions in South Florida. A model for Medicare providers locally, as well as nationally, LMC is allied with Miami-Dade's most prominent hospitals, and employs and contracts the highest performing physicians, specialists and healthcare professionals. With more than 2,300 dedicated professionals who serve over 42,000 Medicare recipients, LMC is redefining the status quo in the industry. At the heart of these applications is LMC's imminent need to meet the demands of its current and future members. Baby boomers are aging and expected to independently live and drive for longer than have prior generations. Currently, approximately 20.79% (9,909) of the population residing within a 1 mile radius of the LMC Miami Center is 65 years of age or older. Notably, the median age within a 1 mile radius of the LMC facility is 44 years old. As the area's population continues to age, the more in -demand LMC's services will become. LMC, as a neighborhood -based Medicare provider, is called upon to meet the medical needs of an aging population in the area and the City at large. Approval of these applications will implement Policy LU-1.3.12, which states that the City's land use regulations will permit neighborhood -based health care facilities. Project. Approval of these applications is necessary to achieve the development of a state of the art medical campus in the heart of the City's Little Havana. In response to the Miami 21 requirement that zoning changes must occur 'successionally', LMC proposes to redevelop the Property in phases (the "Project"). Phase I of the Project is to develop the Property with onsite circulation and surface parking to temporarily alleviate the existing need for queuing of private LMC buses and on -site patient parking. Phase II of the Project is to redevelop the Property and abutting LMC Miami Center as one cohesive campus. In order to develop the Project, the Applicant will seek the additional necessary entitlements to achieve one land use designation and one zoning transect for the entire LMC Miami Center assemblage, including the Property. Approval of these applications is necessary to redevelop the Property consistent with today's Miami 21 Zoning Code and conform to both parking requirements and operational reality. The existing LMC Miami Center is grandfathered with twenty two (22) parking spaces, where 93 would otherwise be required by Miami 21. In 2011, in order to accommodate the growth and need for onsite transit circulation and member parking, LMC obtained Waiver Final Decision No. 11- 0039 and was permitted to provide sixty (60) parking spaces on separate properties, thirty (30) parking spaces adjacent to SW 2 Street and thirty (30) parking spaces fronting SW 1 Street with both parking areas sharing the same access located at SW 1 Street and SW 2 Street. Today, 60 on -site parking spaces is insufficient to accommodate LMC Miami Center's existing 7,500 members and 200 employees and much less accommodate the foreseeable surge in demand. Currently, approximately 200 employees park offsite at the County Auditorium, where for the past 18 years LMC has held a lease with the County to park approximately 100 to 125 vehicles on a daily basis. These employees are shuttled using one of the 35 LMC buses that serve the LMC Miami Center. The offsite parking lease with the County will remain, as Phase I of the Project is to accommodate onsite circulation and parking for LMC members only. Approvals of these applications are necessary to prevent encroachment of commercial parking into the residential area to the south. Furthermore, providing on -site circulation for LMC buses will reduce traffic impact on the City's roadways by encouraging use of private transit. Transit Corridor. The existing LMC Miami Center serves over 7,500 LMC members with over 200 employees. Notably, the LMC Miami Center is located less than 1/2 a mile from both the SW 27 Avenue and SW 8 Street as well as the SW 22 Avenue between SW 1 Street and SW 7 Street Transit Corridors. Miami 21 defines a Transit Corridor as "a designation established by the City involving an area not exceeding a one - quarter (1/4) mile radius from a non -limited access thoroughfare that included designated transit stop locations and is served by one or more mass transit route(s) with designated transit vehicle(s) operating at an average of ten (10) minute or less headway Monday thru Friday between the hours of 7am thru 7pm." See Centers, Transit Corridors and Wedges Map. Bus Route 27 is located immediately in front of the LMC Miami Center along SW 27 Avenue, with an approximate average twenty (20) minute headway. Additionally, there are over 10 bus stops located within 1/2 a mile of the Property. The proposed redevelopment is ideally situated within walking distance from City - recognized Transit Corridors and transit stops thereby promoting pedestrianism and the use of public transit by LMC members and employees. According to the U.S. Department of Labor, healthcare related occupations will have the fastest employment growth from 2016 to 2026 with employment in healthcare support occupations growing the fastest among occupational groups, at 23.6%.1 Healthcare related professions offer competitive salaries that in turn boost the quality of life for families and the local economy in general. Accordingly, the Project redevelopment plans will have a positive impact in both the neighborhood and the City by addressing the healthcare needs of an aging population and providing quality employment within proximity to existing Transit Corridors. Application Requests. Accordingly, the Applicant seeks to amend the MCNP designation of Lots 3, 4, 5, 6, 7, 10,11,12, 13 and 14 from "Duplex Residential" to "Low Density Restricted Commercial." Additionally, the Applicant seeks to implement the proposed land use by rezoning Lots 1, 2, 8 and 9 from T4-L to T4-O and Lots 3, 4, 5, 6, 7, 10,11,12,13 and 14 from T3-O to T4-O. Upon approval of the land use amendment and rezoning applications the Property will be designated "Low Density Restricted Commercial" and zoned T4-O. Criteria. Due to the growing need for onsite transit circulation and member parking, through Waiver Final Decision No. 11-0039, LMC provided sixty (60) parking spaces, thirty (30) parking spaces adjacent to SW 2 Street and thirty (30) parking spaces fronting SW 1 Street with both parking areas sharing the same access located at SW 1 Street and SW 2 Street. See Waiver Final Decision No. 11-0039. Currently, approximately 200 employees park offsite at the Miami -Dade County Auditorium where for the past 18 years LMC has held a lease with Miami -Dade County to park approximately 100 to 125 vehicles. These employees are shuttled using one of 35 LMC buses that serve this LMC facility. The offsite parking Iease with Miami -Dade County will continue, as the proposed parking facility is to accommodate onsite circulation and parking for LMC members. Because the existing T3 zoning does not permit office or commercial uses, LMC would not be allowed to redevelop the Property as a unified site for medical office uses under the existing zoning. In accordance with Article 7, Section 7,1.2.8 of Miami 21, zoning changes must occur 'successionaIIy' to a lesser transect zone, within the same transect zone to a lesser or greater intensity, or to the next higher transect zone. Currently, the T3-O and T4-R zoning at the Property (abutting the LMC's existing facility) does not allow for the provision of circulation and parking for the adjacent medical office use. Accordingly, LMC's objective of redeveloping the all privately -owned land within the block must be implemented in phases. SW 27 Avenue has various Miami -Dade County bus stops which are ideally situated steps from the LMC facility. • Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. Through the approval of this rezoning and land use amendment application, the City will continue to encourage development patterns that enhance the existing neighborhood by providing professional, high paying jobs and medical facilities on SW 27 Avenue, a section line road. • Objective LU-1.6: Regulate the development or redevelopment of real property within the city to insure consistency with the goals, objectives and policies of the Comprehensive Plan. The proposed rezoning and land use amendment applications encourage the redevelopment of the Property and provide a neighborhood -based health care facility as required by Policy LU-1.3.12 as well as advance other goals, objectives and policies of the Comprehensive Plan. • Policy LU-1.6.10: The City's land development regulations and policies will allow for the provision of safe and convenient on -site traffic flow and vehicle parking and will provide access by a variety of transportation modes, including pedestrianism, bicycles, automobiles, and transit. In addition to providing adequate parking for members, LMC will provide safe and convenient on -site traffic flow for the private LMC buses that transport LMC members to and from their homes to the LMC facility. Approval of the proposed rezoning and land use amendment applications will protect and enhance the quality of life of the neighborhood by providing an exceptional neighborhood -based healthcare facility and promoting the redevelopment and beautification of the area. Approval of the rezoning and land use amendment applications will promote efficient traffic circulation within the City and facilitate access to medical treatment for the aging population in the City. LMC provides private transport to many of its members and must also provide parking facilities to those members who choose to independently drive or be accompanied by family or caretakers to the facility. Accordingly, the proposed interim surface parking and eventual redevelopment of the Property will allow for onsite traffic circulation which will eliminate any spillover of vehicles to encroach onto the residential neighborhoods. Additionally, LMC will provide significant employment opportunities which will directly support the economic development of the area. Additionally, the proposed land use and rezoning application meets the intent of Miami 21 by facilitating the provision of parking spaces for the existing facility and eliminating the nonconforming parking facilities on the site. The proposed rezoning will allow adequate parking to be provided in the immediate future, and allow the eventual redevelopment of the LMC facility. Finally, pursuant to Article 2, Section 2.1.1 of Miami 21, one of the purposes of Miami 21 is to further the goals and objectives of the Comprehensive Plan. Additionally, the proposed rezoning and land use amendment will allow the redevelopment of the Property that will in turn promote economic development in the area by providing high paying, professional jobs in the burgeoning healthcare industry. Moreover, SW 27 Avenue is a section line road and major transportation corridor in Miami -Dade County. Miami -Dade County Bus Route 27 has a dedicated bus stop on SW 27th Avenue and SW 2 Street, ideally located in front of the existing LMC facility to promote transit and pedestrianism for both employees and members. The proposed use of the properties subject to the rezoning is both appropriate and compatible with the neighborhood. The neighborhood is consists of institutional uses to the east, commercial and office to the west and some residential to the south and north. With regards to the existing residential units, several units were vacated at the time of sale. The remaining units will be vacated on or before October 1, 2018. The prevailing party in the action or suit shall be entitled to recover costs and reasonable attorney's fees. This enforcement provision shall be in addition to any other remedies available under the law. The award of attorney's fees to a prevailing party shall not be used or enforced against the City of Miami. Section 7. Severabilitv. Invalidation of any one of these covenants by judgment of Court shall not affect any of the other provisions of the Declaration, which shall remain in full effect. Section 8.
