The Property currently has split land use and zoning designations as illustrated below. As you can see, a portion of the Property is land use designated Medium Density Restricted Commercial and zoned T4-L. The remaining portion of the Property is land use designated General Commercial and zoned T5-O. This Application proposes to correct the split designations by applying the same land use and zoning designations to the whole of the Property. The Propertv The Property contains more than 0.81 acres and more than 200 feet of street frontage along NW 21 Street. The Property consists of five platted lots owned by a single owner. The two westernmost lots are designated "Medium Density Residential" and T4-L. The three western lots are designated "General Commercial" and T5-O. The Property is located in Southeast Overtown Park West ("SEOPW") and is immediately south of Wynwood. The Property is improved with a warehouse constructed in 1941. The warehouse occupies four of the five lots. The remaining lot is improved with a surface parking lot that serves the warehouse. II. Comprehensive Plan Analysis The Application will advance a number of the Miami Comprehensive Neighborhood Plan's goals, objectives and policies including, but not limited to: Goal LU-1: Maintain a land use pattern that ... promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods .. Objective LU-1.2: Promote, facilitate, and catalyze the redevelopment and revitalization of blighted, declining or threatened residential, commercial and industrial areas through a variety of public, private, and public -private redevelopment initiatives and revitalization programs including, where appropriate, historic designations. Policy LU-1.2.4: The City will continue to adhere to its established policies regarding Community Redevelopment Districts and will continue to implement plans for the Omni and Southeast Overtown/Park West as Community Redevelopment Districts Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. As stated in Policy LU-1.2.4, the City desires to adhere to policies regarding Community Redevelopment Districts like SEOPW. The Application will simultaneously advance several SEOPW redevelopment goals including Goals 4 (Creating jobs within the community) and 6 (improving the quality of life for residents of the Redevelopment Area) by, among other things, adding to the area's tax increment and adding new potential for jobs, housing, and commercial activity. 2 of 4 WEISS SEROTA HELFMAN COLE & BIERMAN AT THE CROSSROADS OF BUSINESS, GOVERNMENT & THE LAW Ms. Olga Zamora June 22, 2018 III. Zoning Analysis Pursuant to Miami 21 Section 7.1.2.8.c.2(g) In accordance with Miami 21 Section 7.1.2.8.c.2(g), the enclosed Application includes an aerial map of the Property's vicinity, a copy of the zoning atlas showing the zoning within a one-half mile radius of the Property, and photos of buildings within 300 feet of the Property. The Property has operated as a single development site for over 75 years. Given this, the City's decision to split its land use and zoning designations appears to have been more the result of expedient line drawing than a careful consideration for the Property's actual operation. Before Miami 21 was enacted, this split designation had little practical effect for the Property because its prior zoning designations (R3 and C2) each allowed the same level of development-65 dwelling units per acre and five stories of development. The only material distinction between the designations was that R3 zoning permitted only residential uses (and a few others) while C2 allowed residential but also commercial, office, and warehouse uses. Under Miami 21, the T5 zoning on the Property's eastern parcels allows 65 units per acre and five stories —just like the R3 and C2 designations permitted under Miami 21. The T4 zoning on the Property's two western lots allows only 36 units per acre and three stories. Thus, Miami 21 downzoned the Property. In downzoning the Property, Miami 21 not only complicated the Property's future redevelopment, it also failed to recognize the continuing need for opportunities in SEOPW and the trajectory of redevelopment in Wynwood. In the near decade since Miami 21 was enacted, Wynwood (immediately north of the Property) has grown into one of Miami's hottest neighborhoods. That neighborhood has up -zoned to allow 8 and 12 stories where only warehouses formerly existed. With the approval of the Mana Wynwood SAP (also just north of the Property), more than 9 million square feet of commercial and residential have been authorized. Despite the growth and development in Wynwood, relatively little new growth has come to the neighboring areas of SEOPW. Rather, portions of the area have been effectively downzoned. Furthermore, nothing has been done to create a transition between the two neighborhoods. Current zoning regulations would allow eight to twelve stories in Wynwood to abut three story buildings in SEOPW. Such a condition is contrary to basic Miami 21 principles that call for gradual transitions between neighborhoods. The Application proposes only a minor correction to the above problem but an important one. The proposed rezoning would improve the north -to -south transition as well as the east -to -west transition between the commercial character of NW 2 Street and the residential area of SEOPW. Just as importantly (if not more importantly), the Application would add potential job opportunities, commercial space, multifamily residential, and a boost to the SEOPW CRA's tax -increment. Miami 21's guiding principles encourage the creation of such opportunities by promoting mixed uses, especially along transit corridors such as NW 2 Avenue.' i See e.g., Miami 21 Section 2.1.3.1(b) (encouraging infill); Section 2.1.3.1(g) (land uses to enable economic activity); and Section 2.1.3.2(b) (Neighborhoods should be mixed -use). 3 of 4 WEISS SEROTA HELFMAN COLE & BIERMAN AT THE CROSSROADS OF BUSINESS.
