Background of Item: Pursuant to Resolution No. R-18-0433, adopted October 11, 2018 the Miami City Commission approved the allocation of $3,018,379.00 in CDBG funds in the Economic Development category for Program Year 2018-2019, which included and amount of $1,954,690.00 allocated to Department of Community and Economic Development for Street and Park improvement. Effective October 1, 2018, the City of Miami commission changed the name of the Department of Community and Economic Development to the Department of Housing and Community Development. There is a need to allocate these funds in order for the City to meet its CDBG timeliness by August 1st, 2019. The City Administration recommends the transfer of CDBG funds in the amount of $1,954,690.00 from the Department of Housing and Community Development to the agencies/departments, specified in attachment "A", for economic development activities. WHEREAS, pursuant to Resolution No. R-18-0433 adopted October 11, 2018, the City Commission approved the allocation of $3,018,379.00 in Community Development Block Grant ("CDBG") funds in the Economic Development category for Program Year 2018-2019, which included an amount of $1,954,690.00 allocated to the Department of Community and Economic Development for Street and Park improvements ("Funds"); and WHEREAS, effective October 1, 2018, the City Commission changed the name of the Department of Community and Economic Development to the Department of Housing and Community Development; and WHEREAS, there is a need to allocate the Funds in order for the City to meet its CDBG timeliness requirements by August 1, 2019; and WHEREAS, the City Administration recommends the transfer of the Funds from the Department of Housing and Community Development to the agencies/departments specified in Attachment "A," attached and incorporated, for Economic Development activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of the Funds from the Department of Housing and Community Development to the agencies/departments specified in Attachment "A," attached and incorporated, for Economic Development activities is approved. Section 3. The City Manager is authorized to negotiate and execute any and all necessary documents, including but not limited to amendments, extensions, and modifications, in a form acceptable to the City Attorney, to implement the transfer of said Funds, subject to all Federal, State, and Local laws that regulate the use of such Funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: Barnaby I_. Min, Deputy City Attorney 12/31/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
