RE: Proposed ordinance amending Sections 2-358 and Sections 53-1 of the Code of
the City of Miami, Florida, as amended ("City Code"), and repealing, in its
entirety, Chapter 53/Article III thereby removing reference to the Coconut Grove
Expo Center from the City Code.
The attached proposed ordinance amends Sections 2-358 and Sections 53-1 of the
Code of the City of Miami, Florida, as amended ("City Code"), and repeals, in its entirety,

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
2/ARTICLE IV/DIVISION 7/SECTION 2-358 OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("CITY CODE"), TITLED
"ADMINISTRATION/DEPARTMENTS/CONFERENCES AND CONVENTIONS AND
PUBLIC FACILITIES DEPARTMENT/ORGANIZATION OF DEPARTMENT," AND
CHAPTER 53/ARTICLE I/SECTION 53-1 OF THE CITY CODE, TITLED "STADIUMS
AND CONVENTIONS CENTERS/IN GENERAL/TICKET SURCHARGE ON PAID
ADMISSIONS TO EVENTS," TO REMOVE REFERENCES TO THE COCONUT
GROVE EXPO CENTER AND UPDATE THE NAME OF THE REAL ESTATE AND
ASSET MANAGEMENT DEPARTMENT; FURTHER REPEALING IN ITS ENTIRETY
CHAPTER 53/ARTICLE III OF THE CITY CODE, TITLED "STADIUMS AND
CONVENTIONS CENTERS/COCONUT GROVE EXPO CENTER"; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in or around 2013, the Coconut Grove Expo Center was demolished and
Regatta Park was built in its place; and
WHEREAS, it is appropriate to repeal any reference to the now extinct Coconut Grove
Expo Center throughout the Code of the City of Miami, Florida, as amended ("City Code");
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 2/Article IV/Division 7 of the City Code is amended in the following
particulars.'

DIVISION 7. CONFERENCE AND CONVENTIONS AND

Sec. 2-358. Organization of department.
The functions and duties of the conferences and conventions and public facilities Real
Estate and Asset Management department are to be carried out by the office of the director of
the department and the following divisions:

Public facilities division: The public facilities division shall have the planning,
development, management, maintenance and supervision of the day-to-day operations
of the city marinas, Orange Bowl Stadium, and the Miami Marine Stadium and the
Coconut Grove Expo Center, including the coordination and management of planning,
development, and construction efforts at all city facilities. The division shall have the
duty of planning and management of promotions, negotiations, and bookings of special
events such as concerts, sports, and other exhibitions and competitions, and other
forms of entertainment as appropriate in those public facilities."
Section 3. Chapter 53/Article III of the City Code is amended in the following
particulars.'
"CHAPTER 53
STADIUMS AND CONVENTION CENTERS
ARTICLE I. IN GENERAL
Sec. 53-1. - Ticket surcharge on paid admissions to events.
(a) Applicability.
(1) To certain facilities. A ticket surcharge shall be imposed against all paid admissions to
city -owned facilities, including, without limitation, the Marine Stadium, the Coconut
Grove Expo Center, the Miami Convention Center, and the Bayfront Park
Amphitheater, and on tour boats operating at Miamarina at Bayside. Said surcharge
shall additionally apply where admission is charged for events conducted in city parks,
facilities therein, and/or community centers. However, no ticket surcharge shall be
imposed upon any event held at the Manuel Artime Community Center, regardless of
paid admissions. Unless specifically exempted below, and for the purposes of this
section, "events" shall include activities, programs, concerts, festivals, parties,
meetings and other gatherings for whatever social, entertainment, cultural, sport or
other purpose and for which attendees are expected to pay or make a donation in
order to attend. The application of the ticket surcharge shall commence upon the
effective date of this section, except for those events for which advance ticket sales
have the prior approval of the city manager, or designee.

Section 4. Chapter 53/Article III of the City Code is repealed in its entirety and said
Article is now reserved for future use.1

{a) Use rates. Use rates include normal janitorial service, showtime air conditioning, normal
security guards, ushering staff, ticket sellers and ticket takers, stagehands, spotlight
installation(s), setup of tables and chairs and portable stages. Use rates are applicable to a
day or fraction thereof.

a. Main Hall, Wcst Exhibit Area, West Court Area and North Exhibit Area:
1. Three-day scheduled show or less:
i. Per square foot used $ 0.50
ii. Minimum guarantee per show 19,000.00
2. Four day through six day scheduled show:
i. Per square foot used 0.50
ii. Minimum guarantee per show 20,000.00
3. Shows exceeding six days in scheduled length: An additional charge of
$/1,000.00 per scheduled day will be added to the above minimum charge per
show.
b. Main Hall, North Exhibit Area and West Court Area:
1. Three day scheduled show or less:
i. Per square foot used 0.50
ii. Minimum guarantee per show 16,000.00
2. Four day through six day scheduled show:
i. Per square foot used 0.50
ii. Minimum guarantee per show 17,000.00
3. Shows exceeding six days in scheduled length: An additional charge of
$3,500.00 will be added to the above minimum charge per day.
c. Main Hall, North Exhibit Area and West Exhibit Area:
1. Three day scheduled show or less:
i. Per square foot used 0.50
ii. Minimum guarantee per show 15,000.00
2. Four day through six day scheduled show:
i. Per square foot used 0.50
ii. Minimum guarantee per show 16,000.00
3. Shows exceeding six days in scheduled length: An additional charge of
$3,250.00 will be added to the above minimum charge per day.
d. Main Hall, West Exhibit Area and West Court Area:
1. Three day scheduled show or less:
i. Per square foot used 0.50
ii. Minimum guarantee per show 13,000.00

3. Shows exceeding six days in scheduled length: An additional charge of
$2,250.00 per scheduled day will be added to the above minimum charge per
day.
h. Main Hall and West Exhibit Area:
1. Three day scheduled show or less:
i. Per square foot used 0.50
ii. Minimum guarantee per show 8,000.00
2. Four day through six day scheduled show:
i. Per square foot used 0.50
ii. Minimum guarantee per show 9,000.00
3. Shows exceeding six days in scheduled length: An additional charge of
$2,000.00 per scheduled day will be added to the above minimum charge per
show.
i. Mezzanine:
1. Three day scheduled show or le-c:

*Minimum applies when the Main Hall is not used with this area. When
used in conjunction with Main Hall, rates are $0.40 per square foot used

{b) Move in or move out charges. For shows, exhibits and conventions of:
{1) One to three days in duration, two days' move in and one day move out at no
additional charge.
{2) Four or more days in duration, two days' move in and two days move out at no
additional charge.
Any additional time required is at the rate of one half daily rental fee.
{c) Setup costs for labor:
{1) Metal chairs, each $ 1.00
{2) Upholstered chairs each 2.00
{3) Tables, each 6.00
(d) Miscellaneous charges: There is a charge of $75.00 per hour for use of the air
conditioning during move in and/or move out time.
{e) Special rates: In addition to those rates set forth herein, special rates or fee waivers may
be approved by the city commission at the Coconut Grove Expo Center upon user request
and rccommcndation by the administration.

{a) Persons or organizations wishing to use Coconut Grove Expo Center facilities shall be
required to pay as follows:

{2) User must pay to city for use of said facilities the remaining 30 percent of a minimum
50 percent of the basic use fee no later than 30 days prior to moving into the premises.
{3) Unless otherwise governed by written agreement, payment of the remaining 50

rnade in cash or by cashier's check from a domestic bank.
(b) The monies paid to the city under subsections (a)(1) and-(2)-of this section will be forfeit if
paragraph.
Sec. 53 15/1. Transfer of ice rights
User shall have no right to transfer or assign any interest whatsoever in the city's-
agreement permitting use of Coconut Grove Expo Center facilities unless such right shall have
been provided for within said agreement of the city.

Section 5. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
