(the "Applicant") with respect to land use and zoning matters in connection with its property located at 1130 Venetian Way, Miami, Florida and legally described as Lots 4, 5, and 6 of BISCAYNE ISLAND PLAT, as recorded in Plat Book 34 Page 93 of the Public Records of Miami Dade County, Florida. (the "Property"). The Plat and Street Committee voted 5-0 in favor of approving the Street Closure and Median/Park Closure at its March 16, 2016 meeting. I. History The Property was originally developed in accordance with the Biscayne Island Plat (the "Original Plat") as recorded on February 10, 1937 in Plat Book 34 at Page 93 according to the Public Records of Miami -Dade County (the "County"). The development consisted of five (5) separate residential structures with surface parking abutting the buildings on the North end of the Property. The Original Plat established reversionary interests to the original developers' successors should the described uses be discontinued. Below in Image 2 and Image 3 is a portion of the Original Plat showing the Property and the dedication and reversionary interest language highlighted. Image 4 In 1981, the neighbors West of the Property closed and vacated a portion of South Venetian Drive fronting their building through the Venetian Harbor Subdivision plat as recorded in Plat Book 117 at Page 10 on February 17, 1981, (the "Venetian Harbor Plat"). As a result of the Venetian Harbor Plat, a remnant tract including the subject Street Closure, remained fronting the Sandpiper Property. Image 6 The Original Plat also included additional property North of Venetian Causeway with the same park use restriction as shown on Image 7 below (the "North Park"). In 1939, the northern portion of the Original Plat was replatted under the Resubdivision of a portion of Biscayne Island as recorded in Plat Book 40 at Page 34 in the Public Records of Miami -Dade County (the "Resubdivision"). One of the reasons for the Resubdivision was specifically to close the North Park and North Venetian Drive. Below is an image of the Resubdivision and the dedication language referencing the closure of the North Park and North Venetian Drive as Image 5 and Image 6, respectively. Since the development at the Property the "road" and "park" have existed as a parking lot for over 30 plus years, see image 4. Therefore, the reversionary language as included on the Original Plat and previously described above should be invoked. The Plat and Street Committee determined that the application for Street Closure meets the criteria established in Section 55-15(c) of the City Code. For the reasons stated above, and in connection with the City Plat and Street Committee's recommendation of approval of the Street Closure and the Median/Park Closure, we submit the attached City of Miami Application for Vacation and Closure for consideration at a public hearing. Opinion of Title SANDPIPER VILLAS —A PLAT 2 MIA 186120354v2 Therefore, it is our opinion that the following parties must join' in the platting of the above described real property in order to grant CITY OF MIAMI and the public, a good and proper title to any dedicated areas shown on the final plat of the Property, the subdivision thereof to be known as "SANDPIPER VILLAS": NAME INTEREST SPECIAL EXCEPTION NUMBER Sandpiper Villas Co -Op Apts., Inc., a Delaware corporation not -for -profit Fee Simple N/A Banco Popular North America Collateral Assignee 4(f) Based solely upon my review of a copy of that certain Corporate Resolution for Sandpiper Villas Co -Op Apts., Inc. ("Consent") attached hereto as Exhibit "B" and assuming such Consent was duly and properly authorized and executed and has not been amended, rescinded or revoked, Sharon Denaro, as President, acting alone, has the power and authority to sign the final plat on behalf such corporation. With respect to the reversionary rights for the right-of-way portion of the property included within the limits of the plat to be closed and vacated and legally described in Exhibit "C" attached hereto (the "Street"), we have examined the Florida Statutes and have determined that Section 177.085(1) of the Florida Statutes ("Statute") reads as follows: "When any owner of land subdivides the land and dedicates streets, other roadways, alleys or similar strips on the map or plat, and the dedication contains a provision that the reversionary interest in the street, roadway, alley or other similar strip is reserved unto the dedicator or his or her heirs, successors, assigns, or legal representative, or similar language, and thereafter conveys abutting lots or tracts, the conveyance shall carry the reversionary interest in the abutting street to the centerline or other appropriate boundary, unless the owner clearly provides otherwise in the conveyance."
