City of Miami Legislation Resolution Enactment Number: R-18-0135 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3830 Final Action Date:4/12/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION CODESIGNATING SOUTHWEST 10TH STREET FROM SOUTHWEST 12TH AVENUE TO SOUTHWEST 14TH AVENUE, MIAMI, FLORIDA "CALLE DE LAS PRESAS POLITICAS CUBANAS" PURSUANT TO SECTION 54-137, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"); FURTHER AUTHORIZING THE PLACEMENT OF A MARKER DESIGNATION IN THE PUBLIC RIGHT-OF-WAY LOCATED IN THE MEDIAN AT THE INTERSECTION OF SOUTHWEST 10TH STREET AND SOUTHWEST 13TH AVENUE TO HONOR THE FEMALE POLITICAL PRISONERS OF CUBA, OR "LAS PRESAS POLITICAS CUBANAS," PURSUANT TO SECTION 54-136(1) OF THE CITY CODE, SUBJECT TO ALL APPLICABLE PERMITTING REQUIREMENTS; FURTHER DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE HEREIN DESIGNATED OFFICES. WHEREAS, according to Human Rights Watch, World Report, 2017, the Cuban government continues to repress dissent and punish public criticism by use of short-term arbitrary arrests of human rights defenders and independent journalists, in addition to beatings, public shaming, and the termination of employment; and WHEREAS, according to the above cited report, the Cuban Commission for Human Rights and National Reconciliation, an independent human rights group lacking the Cuban government's official authorization and, therefore, considered illegal, received more than 7,900 reports of arbitrary detentions by the Cuban government from January through August 2016; and WHEREAS, arbitrary detention is often used preemptively to impede participation in peaceful marches or meetings for political discussions, during which time detainees are often beaten, threatened, and held incommunicado for hours and even days; and WHEREAS, many of those arbitrarily detained are women falsely accused of such crimes as contempt, property damage, and public disorder; and WHEREAS, these same women have been detained while partaking in peaceful demonstrations in public or arrested while in their homes after participating in said demonstrations or other meetings and activities, which are commonplace in a modern day independent civil society; and WHEREAS, the arbitrary detention of women leads to divided families punished for not accepting to live without freedom; and WHEREAS, to honor these female political prisoners of Cuba, or "Las Presas Politicas Cubanas"; including, but not limited to, the Ladies in White, the Patriotic Union of Cuba (UNPACU), the Forum for Rights and Freedoms (FDyL), the Cuban Reflection Movement and the Eastern Democratic Alliance (ADO), and many others both within the island and in exile in Miami, Florida, the City of Miami ("City") wishes to co -designate Southwest 10th Street from Southwest 12th Avenue to Southwest 14th Avenue, Miami, Florida and provide a marker in the public right-of-way located in the median at the intersection of Southwest 10th Street and SW 13th Avenue; and WHEREAS, District 4 will cover the costs associated with the installation of the sign and the marker; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this section. Section 2. Southwest 10th Street from Southwest 12th Avenue to Southwest 14th Avenue, Miami, Florida is hereby co -designated as "Calle De Las Presas Politicas Cubanas," pursuant to Section 54-137 of the Code of the City of Miami, Florida, as amended ("City Code"), with costs associated with the installation of same to be paid for by District 4. Section 3. The placement of a marker in the public right-of-way located in the median at the intersection of Southwest 10th Street and Southwest 13th Avenue, Miami, Florida, pursuant to Section 54-136(1) of the City Code to honor female political prisoners of Cuba, or "Las Presas Politicas Cubanas" is authorized, subject to all applicable permitting requirements, with the costs associated with the installation of same to be paid for by District 4. Section 4. The City Clerk is directed to transmit a copy of this Resolution to the Departments of Police, Fire -Rescue, and Solid Waste; the Miami -Dade County Department of Transportation and Public Works; the United States Postal Service; and, if a State of Florida road, to the Florida Department of Transportation, District Six, for sign installation within the newly designated roadways. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
