A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK
SCOTT AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO SUPPORT
SENATE BILL 182, WHICH PROPOSES THE IMPLEMENTATION OF A SMALL
BUSINESS ROADWAY CONSTRUCTION MITIGATION GRANT PROGRAM,
REQUIRING SAID PROGRAM TO DISBURSE GRANTS USING FUNDS ALLOCATED
TO THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) BY THE
LEGISLATURE TO CERTAIN QUALIFIED BUSINESSES DURING A FDOT
CONSTRUCTION PROJECT, CREATING A RETROACTIVITY COMPONENT FOR
BUSINESSES IN CURRENT CONSTRUCTION MITIGATION ZONES, INCLUDING
BUT NOT LIMITED TO, THOSE BUSINESSES LOCATED ALONG FLAGLER
STREET, SW 1ST STREET AND SW/NW 27TH AVENUE IN MIAMI, FLORIDA, AND
URGING GOVERNOR RICK SCOTT AND THE MEMBERS OF THE FLORIDA

URGING GOVERNOR RICK SCOTT AND THE MEMBERS OF THE FLORIDA
LEGISLATURE TO PROVIDE IMMEDIATE TEMPORARY FUNDING TO THOSE
IDENTIFIED BUSINESSES ALONG FLAGLER STREET, SW 1ST STREET AND
SW/NW 27TH AVENUE IN MIAMI, FLORIDA; DIRECTING THE CITY CLERK TO
TRANSMIT A COPY OF THIS RESOLUTION TO GOVERNOR RICK SCOTT AND THE
MEMBERS OF THE FLORIDA LEGISLATURE.
WHEREAS, the Florida Department of Transportation ("FDOT") is an executive
agency responsible for coordinating and planning the development of safe, viable and
balanced state transportation systems; and
WHEREAS, in March of 2016 FDOT began the first of four (4) roadway projects
located on Flagler and 1st Street: 1) Flagler Street from 27th Avenue to 14th Avenue and
SW/NW 27th Avenue from SW 10th Street to NW 9th Street, 2) Flagler Street from 14th
Avenue to 2nd Avenue, 3) SW 1st Street from SW 24th Avenue to SW 17th Avenue, and
4) SW 1st Street from SW 17th Avenue to SW 6th Avenue; and
WHEREAS, the reduction of travel lanes and temporary road closures coupled
with the excavation of roadways and sidewalks have caused a severe decrease in the
mobility of vehicular travel and foot traffic to local businesses along Flagler street; and
WHEREAS, due to the decrease in storefront access, local businesses experienced
major economic hardships, leaving many in jeopardy of permanent closure; and
WHEREAS, in January 2017, this Commission addressed Florida Senator Jose
Javier Rodriguez about the dire conditions that businesses along the above mentioned
corridors suffered and requested that the state intervene to provide assistance; and
WHEREAS, in March of 2017, this Commission unanimously passed Resolution
R-17-0132 urging Governor Rick Scott and the Florida Legislature to create a
compensation package program for businesses adversely effected by FDOT
construction projects; and
WHEREAS, the Miami Herald/EI Nuevo Herald reported that small businesses —
from clothing shops to cafeterias, jewelry and auto repair shops and beauty salons —
complained their sales have dropped by up to 60 percent and that they have been
forced to dismiss employees; and
WHEREAS, currently no such compensation package exists to assist small
businesses with the revenue loss from construction projects; and
WHEREAS, in its ever-present efforts to improve the quality of life of its
residents, this commission unequivocally supports Senate Bill 182, which proposes to
implement a small business roadway construction mitigation grant program while urging
the Legislature to create a retroactivity component for businesses in current
construction mitigation zones, specifically those identified businesses along Flagler, SW
1st Street and SW/NW 27th Avenue in Miami, Florida; and
WHEREAS, certain businesses are currently experiencing the adverse economic
effects of the roadway construction project, and in order to continue to support our local
businesses, we urge that the Florida legislature make available immediate funding for
those identified businesses along Flagler Street, SW 1st Street and SW/NW 27th Avenue
in Miami, Florida;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission urges Governor Rick Scott and the members of
the Florida Legislature to pass Senate Bill 182, which proposes to implement a small
business roadway construction mitigation grant program while urging the Legislature to
create a retroactivity component for businesses in current construction mitigation zones,
including but not limited to those businesses along Flagler Street, SW 1st Street and
SW/NW 27th Avenue in Miami, Florida.
Section 3. The City Commission also urges that Governor Rick Scott and the
members of the Florida Legislature to provide immediate funding for those identified
businesses along Flagler Street, SW 1st Street and SW/NW 27th Avenue in Miami,
Florida.
Section 4. The City Clerk is directed to transmit a copy of this resolution to
Governor Rick Scott and all members of the Florida Legislature.
Section 5. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor.
1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
