Background of Item: Miami -Dade County performs collection, processing, adjudication of parking violations for all jurisdictions in the County, and is charged with approving all fine schedules for said violations. Florida Statutes regulate the maximum fine amounts that may be imposed by all counties in the State. In order to alleviate abuse of parking regulations such as parking after violation shows on meter, parking prohibited on certain streets, and willful obstruction of streets, as well as other parking violations that create hazardous conditions or otherwise impede the orderly flow of traffic and the availability of adequate parking areas, it is urged that Miami -Dade County implement comprehensive amendments to its parking fines and that the State of Florida amend applicable statutes in order to increase state penalties for various parking violations. Min Deputy Attorney Review Completed 12/21/2017 1:53 PM Office of the City Attorney Victoria Mendez Approved Form and Correctness with Modification(s) Completed City of Miami Legislation Resolution Enactment Number: R-17-0239 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 2002 Final Action Date:5/11/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RICK SCOTT AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO AMEND THE FLORIDA STATUTES TO INCREASE STATE PENALTIES FOR VARIOUS PARKING VIOLATIONS; URGING THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS TO IMPLEMENT COMPREHENSIVE AMENDMENTS TO ITS PARKING FINE STRUCTURE; SPECIFICALLY REQUESTING AN INCREASE IN ROAD OBSTRUCTION FINES FROM THE CURRENT AMOUNT OF FORTY SEVEN DOLLARS ($47.00) TO THE RECOMMENDED AMOUNT OF ONE HUNDRED TWENTY DOLLARS ($120.00); FURTHER SPECIFICALLY REQUESTING THAT SAID INCREASES IN PENALTIES AND FINES NOT BE INCLUSIVE OF EXPIRED OVERTIME PARKING; DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN. WHEREAS, the penalties for illegal parking offenses set forth in Section 318.18, Florida Statutes, do not reflect penalties that are adequate given the seriousness of these violations; and WHEREAS, similarly, Section 30-388.32 of the Code of Miami -Dade County, Florida, as amended ("County Code") sets forth the schedule for various parking offenses, including but not limited to, parking after a violation shows on a meter, parking on certain prohibited streets, willfully obstructing streets, and other parking violations that create hazardous conditions or otherwise impede the orderly flow of traffic and the availability of adequate parking areas; and WHEREAS, the County Code currently provides parking penalties ranging from eighteen dollars ($18.00) to thirty-three dollars ($33.00), which do not adequately reflect the gravity of these illegal parking offenses and are not in keeping with the current parking rates or the increasing costs of enforcement; and WHEREAS, the City of Miami ("City") specifically requests that road obstruction fines be increased from the current amount of forty seven dollars ($47.00) to the recommended amount of one hundred twenty dollars ($120.00); and WHEREAS, the City further specifically requests that the desired increases in penalties and fines not be inclusive of expired overtime parking; and WHEREAS, the amounts provided in the parking violation fine schedule were last amended by the Miami -Dade County Board of County Commissioners ("County Commission") in 1996; and WHEREAS, inadequate parking fines are a concern to all citizens in the City and Miami - Dade County ("County") and the City urges other municipalities to support an increase in County and State fines for parking violations to serve as a measured deterrent to these parking offenses; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission urges Governor Rick Scott and the members of the Florida Legislature to amend the Florida Statutes to increase penalties for various parking violations as stated herein. Section 3. The City Commission further urges the County Commission comprehensively amend the parking fine structure provided in the County Code to increase penalties for various parking violations as stated herein. Section 4. The City Commission specifically requests that road obstruction fines be increased from the current amount of forty seven dollars ($47.00) to the recommended amount of one hundred twenty dollars ($120.00). Section 5. The City Commission further specifically requests that the desired increases in penalties and fines not be inclusive of expired overtime parking. Section 6. The City Commission hereby directs the City Clerk to send a certified copy of this Resolution to Governor Rick Scott, the members of the Florida Legislature, Miami -Dade County Mayor Carlos A. Gimenez, Chairman of the County Commission Esteban L. Bovo, Jr., and the members of the County Commission. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' APPROVED AS TO FORM AND CORRECTNESS: 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
