HomeMy WebLinkAboutR-17-0058City of Miami Resolution R-17-0058 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1523 Final Action Date: 1/26/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY ("COUNTY COMMISSIONERS") TO AMEND THE CHARTER COUNTY TRANSIT SURTAX ORDINANCE INCLUDING BUT NOT LIMITED TO SECTION 29-124(H)(II) OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA TO ALLOW THE CITY OF MIAMI ("CITY") TO UTILIZE SURTAX PROCEEDS TO PROVIDE ON -DEMAND TRANSPORTATION SERVICES AS DEFINED BELOW FOR INDIVIDUALS RECEIVING MIAMI-DADE COUNTY -SPONSORED TRANSPORTATION SERVICES; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE MAYOR OF MIAMI-DADE COUNTY AND TO THE COUNTY COMMISSIONERS; FURTHER DIRECTING THE CITY MANAGER TO BRING A SEPARATE FUTURE AMENDMENT TO THE CITY'S FISCAL YEAR 2016-2017 OPERATING BUDGET AS NECESSARY TO ACCOMPLISH THE CONTINUATION OF THE CITY'S ON -DEMAND TRANSPORTATION SERVICES FOR INDIVIDUALS AS SET FORTH HEREIN. SPONSOR(S): Commissioner Wifredo (Willy) Gort WHEREAS, Section 212.055(1), Florida Statutes, sets for the Charter County and Regional Transportation Surtax Systems provisions regarding the types of uses to which a county commission may apply the proceeds of such surtax and whereby the governing body of a county may distribute proceeds from the surtax to municipalities within such county; and WHEREAS, Section 212.055(1)(e), Florida Statutes, defines "on demand transportation services" as transportation provided between flexible points of origin and a destination selected by individual users with such services being provided at a time that is agreed upon by the user and the provider of the service and that is not fixed -schedule or fixed -route in nature; and WHEREAS, the City of Miami ("City") has an on -demand transportation services program to serve the City's low-income elderly population, aged sixty-five (65) years and over and/or disabled persons for specific trip purposes within the City at no costs to the individual; and WHEREAS, the Charter County Transit Surtax Ordinance and Section 29-124(h)(ii) of the Code of Miami -Dade County, Florida (collectively, "Miami -Dade County Transit Surtax Provisions") prohibit any city within Miami -Dade County ("County") from utilizing surtax proceeds to provide on -demand transportation services for individuals receiving County sponsored Special Transportation Services for low income persons aged sixty-five (65) years or older, or persons with a disability; and WHEREAS, the County's Special Transportation Services require an additional payment amount from the individual at time of services; and City of Miami Page 1 of 2 File ID: 1523 (Revision:) Printed On: 3/20/2025 File ID: 1523 Enactment Number: R-17-0058 WHEREAS, in fairness and in the spirit of the public purposes of assisting the City's low- income elderly population and persons with disabilities, the City Commission believes that it is in the best interests of the City and the County for the Miami -Dade County Transit Surtax Provisions to be amended to allow the City to continue to fund its on -demand transportation services program with surtax proceeds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission urges the County Commissioners to amend the County Transit Surtax Provisions to allow the City to utilize surtax proceeds to provide on -demand transportation services for individuals receiving County -sponsored transportation services. Section 3. The City Clerk is directed to transmit a copy of this Resolution to the Mayor of Miami -Dade County and to the County Commissioners. Section 4. The City Manager is directed to bring a separate future amendment to the City's Fiscal Year 2016-2017 Operating Budget as necessary to accomplish the continuation of the City's on -demand transportation services for individuals as set forth herein. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
