FOR THE SPECIAL ELECTION
HELD ON NOVEMBER 8, 2016

CITY OF MIAMI
I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all
necessary legal steps were taken in connection with the conduct of the City of Miami
Special Election held on November 8, 2016, including, though not limited to, the
following:
I. On Wednesday, October 19, 2016:
A. Commencing at approximately 10:00 a.m., the Miami -Dade County
Supervisor of Elections (hereinafter referred to as "Supervisor of Elections")
conducted a logic and accuracy test of the touch screen and optical scan voting
systems to be used for vote -by -mail, early voting and precinct ballots for the
November 8, 2016 City of Miami Special Election.
B. The Supervisor of Elections compared the test results with the predetermined
totals for the tabulating devices selected for the logic and accuracy test and
pursuant to the requirements established in Section 101.5612, Florida Statutes,
observed the performance and results of all required tests and verified the
correctness of the programs and equipment.
II. On Monday, October 24, 2016 through Tuesday, November 8, 2016:
A. Commencing at approximately 10:00 a.m. on Monday, October 24, 2016, the
Supervisor of Elections conducted the pre -count logic and accuracy test of the
optical scan system used for vote -by -mail and provisional ballots and verified
the correctness of the programs and equipment. Additionally, the Miami -
Dade Elections Department began the process of opening vote -by -mail ballots
in addition to the duplication of damaged vote -by -mail ballots. This task was
carried out on an as needed basis until Tuesday, November 8, 2016.
III. On Tuesday, October 25, 2016 through Monday, November 7, 2016:
A. Commencing at approximately 10:00 a.m. on Tuesday, October 25, 2016,
Miami -Dade County's Canvassing Board (hereinafter referred to as
"Canvassing Board") met to canvass presumed invalid vote -by -mail ballots.
This task was carried out on an as needed basis until Monday, November 7,
2016.

IV. On Tuesday, November 8, 2016 through Friday, November 11, 2016:
A. Commencing at approximately 12:00 p.m. on Tuesday, November 8, 2016, the
Canvassing Board met to canvass presumed invalid vote -by -mail ballots. Per
Section 101.048(1), Florida Statutes, persons casting provisional ballots have
the right to present written evidence supporting their eligibility to vote to the
Supervisor of Elections no later than 5:00 p.m. on the second day following
the election. The deadline to provide said evidence was Thursday, November
10, 2016. On Thursday, November 10, 2016, provisional ballots were
canvassed by the Canvassing Board. After the completion of this task, the
tabulation of preliminary election results was finalized and the Supervisor of
Elections presented me with the UNOFFICIAL election results for the
November 8, 2016 City of Miami Special Election.
V. On Friday, November 18, 2016:
A. Per Florida Administrative Code Section IS-2.013(7) Vote -by -mail Ballots to
Overseas Electors, with respect to the General Election, any vote -by -mail
ballot cast for a federal office by an overseas elector which is postmarked or
signed and dated no later than the date of the federal election shall be counted
if received no later than ten (10) days from the date of the federal election as
long as such vote -by -mail ballot is otherwise proper. Due to the fact that the
City of Miami's Special Election shared the same ballot as a General Election,
the Canvassing Board was not able to provide certified official election results
until ten (10) days after the date of the federal election. On Friday, November
18, 2016, the Canvassing Board met at 3:00 p.m. to canvass overseas vote -by -
mail ballots. After the completion of this task, the tabulation of the final
election results was completed and the Supervisor of Elections presented me
with the certified OFFICIAL election results for the November 8, 2016 City of
Miami Special Election.
VI. I further certify and declare that the results of the City of Miami Special Election
held on November 8, 2016, are as follows:

Charter Amendment Allowing Leasing of City -owned Dr. Jackson's Office to Dade Heritage Trust, Inc.
Shall the Miami Charter be amended to authorize the City Commission, by four -fifths (4/5ths) affirmative vote, to
waive competitive bidding and execute a lease with Dade Heritage Trust, Inc. for the City -owned building located at
190 Southeast 12th Terrace, for a term of 30 years, with two 30-year renewals, for minimum annual rent of
$600.00, with Consumer Price Index adjustments, with restrictions, reversions, and retention by the City of all other
rights?

Charter Amendment Changing the Date for a Runoff Election for Mayor and City Commissioner
Shall Section 7 of the Charter of the City of Miami, Florida be amended to require that a runoff election for Mayor
and City Commissioner be held on the third Tuesday after the first Monday in November in odd -numbered years,
rather than the second Tuesday after the first Monday in November?

Charter Amendment Providing Further Independence of the Civilian Investigative Panel
Shall Miami Charter Section 51 be amended to provide further independence of the Civilian Investigative Panel by
clarifying its membership composition; affirming its right to hire and fire an executive director and independent
counsel, subject to City Commission approval; establishing an annual budget by ordinance; confirming its authority
to investigate conduct and review policies and practices of the Police Department; and clarifying its authority to
issue subpoenas in consultation with the State Attorney's Office?

Charter Amendment Guaranteeing City Will Follow Charter and Allowing Residents to Enforce Charter
Shall Section 52 of the Charter of the City of Miami, Florida, known as the "Citizens' Bill of Rights," be placed at the
beginning of the Charter, be amended to expressly require the City to abide by the Charter's provisions, provide the
residents the right to sue and be heard in court to enforce compliance with Charter provisions, and if successful, to
recover court costs but not attorney's fees?
