Purpose of Item: A Resolution of the Miami City Commission, with attachment(s), authorizing the City Manager to execute a Lease Agreement in substantially the attached form, between the City of Miami, Miami Dade County and Better Way of Miami, Inc. for a term of fifteen (15) years with two (2) additional five (5) year options for the continued use of the property located at 800, 810 and 820 NW 28th Street, Miami, Florida. Background of Item: The City and Lessee, a not -for -profit corporation of the State of Florida entered into a lease agreement for a term of twenty (20) years for the period December 12, 1996 through December 11, 2016 for the purpose of providing transitional rental housing for very -low income individuals or families which are homeless. The City and Lessee wish to enter into a Lease with a term of fifteen (15) years with two (2) additional five (5) year options to enable the Lessee to continue to provide these services to the community at a cost of one ($1.00) per year. The County deeded over to the property to the City with a restriction that states that the Property must be used for a "Baseball or Sports Complex, or associated uses". The County, by executing this Lease, agrees to waive the deed restriction and allow the use of the Property by the Lessee. WHEREAS, the City of Miami ("City") and Better Way of Miami, Inc. ("Lessee"), a Florida not for profit corporation, entered into a Lease Agreement ("Lease"), pursuant to an exemption granted under Section 29-B(a) of the Charter of the City of Miami, Florida, as amended, for a term of twenty (20) years, for the period of December 12, 1996 through December 11, 2016, for the use of the property located at 800, 810 and 820 Northwest 28th Street, Miami, Florida ("Property"), for the provision of transitional rental housing for very low income individuals and homeless families ("Housing Services"); and WHEREAS, the City and the Lessee wish to enter into a new Lease with an initial term of fifteen (15) years with two (2) additional five (5) year options for the continued use of the Property for provision of these Housing Services to the community; and WHEREAS, Miami -Dade County ("County") deeded the Property to the City with a restriction that states that the Property must be used for a "Baseball or Sports Complex, or associated uses" ("Deed Restriction"); and WHEREAS, the County, by executing this Lease, agrees to waive the Deed Restriction and allow the continued use of the Property by the Lessee for these Housing Services; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Section 3.
