HomeMy WebLinkAboutR-16-0585City of Miami Resolution R-16-0585 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 1304 Final Action Date: 12/8/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO CONVERT A PORTION OF THE LAND LOCATED AT 2820 MCFARLANE ROAD, MIAMI, FLORIDA 33133, COMMONLY REFERRED TO AS THE "GLASS HOUSE" ("PROPERTY"), TO A CONDOMINIUM FORM OF OWNERSHIP FOR PURPOSES OF AD VALOREM TAXATION; FURTHER AUTHORIZING THE CITY MANAGER TO CREATE AND EXECUTE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, A DECLARATION OF CONDOMINIUM, ARTICLES OF INCORPORATION, BY-LAWS, AND ANY OTHER DOCUMENTS NECESSARY FOR THE ESTABLISHMENT OF A CONDOMINIUM ON THE PROPERTY. WHEREAS, the City of Miami ("City") owns land located at 2820 McFarlane Road, Miami, Florida 33133 ("Property"); and WHEREAS, the City issued Request for Proposals No. 12-13-067 for the lease of a Garden Cafe on the portion of the Property commonly referred to as the "Glass House"; and WHEREAS, Glasshouse Coconut Grove, LLC ("Tenant") was the top -ranked proposer and subsequently entered into a lease agreement with the City on December 24, 2014, for a restaurant in the Glass House; and WHEREAS, the lease requires the Tenant to pay all ad valorem taxes levied against the leased area; and WHEREAS, the Tenant's use of the Glass House for a restaurant may subject the Property as a whole to ad valorem taxes; and WHEREAS, converting a portion of the Property to a condominium form of ownership will separate the property into defined units, which will allow the Miami -Dade County Property Appraiser to levy an ad valorem tax on the Tenant's leasable area, while the remaining portion of the Property remains open to the public and tax-exempt; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is hereby authorized1 to create and execute, in a form acceptable to the City Attorney, a Declaration of Condominium, Articles of Incorporation, By- laws, and any other documents necessary to convert the Property to a condominium form of ownership for purposes of ad valorem taxation. Section 3. This Resolution shall become effective immediately upon adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor 11/29/2016 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
