Subject: Peacock Park to Condo. Ownership
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to convert the land located at 2820 McFarlane Road, Miami, FL 33133,
commonly referred to as "Peacock Park" (the "Property"), to a condominium form of
ownership; further authorizing the City Manager to execute articles of incorporation,
bylaws, declaration of condominium, in substantially the attached form, and any other
documents necessary for the establishment of a condominium on the Property.
Background of Item:
The City of Miami ("City") owns the land located at 2820 McFarlane Road, Miami, FL
33133, commonly referred to as "Peacock Park" (the "Property"). The City issued RFP
12-13-067 for the lease of a Garden Cafe known as the Glass House ("Glass House
Cafe") and located on the Property.
Glass House Coconut Grove, LLC ("Tenant") was the top -ranked proposer and
subsequently entered into a lease agreement with the City of Miami for a restaurant on
a portion of the Property. A portion of the Property is subject to taxation to be paid for by
the Tenant per the Lease. The remaining portion of the Property is open to the public
and tax-exempt for municipal purposes.
Converting the Property to a condominium form of ownership shall separate the
property into defined units, which will allow the Miami Dade Property Appraiser to tax
the Tenant separately.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO CONVERT A PORTION OF THE LAND LOCATED AT 2820
MCFARLANE ROAD, MIAMI, FLORIDA 33133, COMMONLY REFERRED TO AS THE
"GLASS HOUSE" ("PROPERTY"), TO A CONDOMINIUM FORM OF OWNERSHIP
FOR PURPOSES OF AD VALOREM TAXATION; FURTHER AUTHORIZING THE
CITY MANAGER TO CREATE AND EXECUTE, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, A DECLARATION OF CONDOMINIUM, ARTICLES OF
INCORPORATION, BY-LAWS, AND ANY OTHER DOCUMENTS NECESSARY FOR
THE ESTABLISHMENT OF A CONDOMINIUM ON THE PROPERTY.
WHEREAS, the City of Miami ("City") owns land located at 2820 McFarlane Road,
Miami, Florida 33133 ("Property"); and
WHEREAS, the City issued Request for Proposals No. 12-13-067 for the lease of a
Garden Cafe on the portion of the Property commonly referred to as the "Glass House"; and
WHEREAS, Glasshouse Coconut Grove, LLC ("Tenant") was the top -ranked proposer
and subsequently entered into a lease agreement with the City on December 24, 2014, for a
restaurant in the Glass House; and
WHEREAS, the lease requires the Tenant to pay all ad valorem taxes levied against the
leased area; and
WHEREAS, the Tenant's use of the Glass House for a restaurant may subject the
Property as a whole to ad valorem taxes; and
WHEREAS, converting a portion of the Property to a condominium form of ownership
will separate the property into defined units, which will allow the Miami -Dade County Property
Appraiser to levy an ad valorem tax on the Tenant's leasable area, while the remaining portion
of the Property remains open to the public and tax-exempt;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to create and execute, in a form
acceptable to the City Attorney, a Declaration of Condominium, Articles of Incorporation, By-

laws, and any other documents necessary to convert the Property to a condominium form of
ownership for purposes of ad valorem taxation.
Section 3. This Resolution shall become effective immediately upon adoption and
signature of the Mayor.2
