Background of Item: Because of the existing and continuing possibility of the occurrence of law enforcement problems and other natural and man-made conditions which are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the City of Miami ("City") Department of Police and City of Miami Gardens, City of South Miami, Village of El Portal, City of North Miami and the City of Miami Beach ("Participating Municipalities"). In order to ensure that preparation of these law enforcement agencies will be adequate to address any and all of these conditions, to protect the public peace and safety and to preserve the lives and property of the people of the City and the Participating Municipalities. The City and the Participating Municipalities have the authority under The Mutual Aid Act, Chapter 23, Part 1, of the Florida Statutes, to enter into this mutual aid agreement. The City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, §163.01 Florida Statutes, to enter into interlocal agreements to jointly exercise any power, privilege or authority which they share in common and which each might exercise separately. WHEREAS, there are natural and man-made challenges faced by the Miami Police Department ("MPD") and other municipal police departments that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the municipal police departments; and WHEREAS, the City of Miami ("City") and the City of Miami Gardens, the City of South Miami, the Village of El Portal, the City of North Miami and the City of Miami Beach (collectively, the "Participating Municipalities") wish to enter into a Mutual Aid Agreement ("MAA") to ensure that preparation and resources from their law enforcement agencies will be adequate to address natural and manmade challenges, to protect the public peace and safety and to preserve the lives and property of the people of the City and the Participating Municipalities; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into mutual aid agreements; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into interlocal agreements for purposes of permitting local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population, and other factors influencing the needs of the local communities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute Mutual Aid Agreements with the City of Miami Gardens, the City of South Miami, the Village of El Portal, the City of North Miami and the City of Miami Beach, to receive and extend mutual aid in the form of law enforcement services and resources to ensure public safety and adequately respond to intensive situations, including, but not limited to, natural or manmade disasters or emergencies as defined under the Florida Mutual Aid Act of Chapter 23, Part I of the Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey ) 11/23/2016 1 The herein authorization is further subjected to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
