Background of Item: Pursuant to Resolution No. 00-867, adopted September 28, 2000, the City Commission approved the establishment of a Housing and Commercial Loan Committee ("HCLC") with authority to approve certain housing and commercial loans or grants to be provided by the City through various State and Federal funding sources. The authority and composition of the Housing and Commercial Loan Committee was amended by the City Commission by Resolution 02-14 adopted January 10, 2002, Resolution No. 03-993, adopted September 11, 2002, and Resolution 04-0156, adopted March 11, 2004; and Ordinance No. 13030 adopted on October 16, 2008, to include, among other duties, the approval of local affordable housing incentive strategies. The HCLC serves as the City of Miami's Affordable Housing Advisory Committee ("AHAC") as required by F.S. Chapter 420.9072. The HCLC's role as an advisory committee, pursuant to Florida Statute 420.9076, is to review the established policies and procedures, ordinances, land development regulations and the adopted local government comprehensive plan and to recommend specific actions. Effective February 21, 2008 the AHAC, in compliance with Rule 67-371.010, must approve the affordable housing incentive strategy recommendations every three (3) years. On November 28, 2018, the HCLC recommended continuing the following affordable housing incentive strategies which are currently offered by the City: 1. Expedited permitting, 2. Reduction of parking and Setback Requirements; 3. Impact -Fee Deferral/Waiver; 4. Allowance of Flexibility in Densities and Intensities; i.e. Floor Area ratio; 5. Review of Legislation, Policies and Plans that impact Affordable Housing. The City Administration recommends the approval of the affordable housing incentives strategies as recommended by the HCLC. WHEREAS, pursuant to Resolution No. 00-867 adopted September 28, 2000, the City Commission approved the establishment of the Housing and Commercial Loan Committee ("HCLC") with the authority to approve certain housing and commercial loans and grants that are provided by the City of Miami ("City") through various State and Federal funding sources; and WHEREAS, the authority and composition of the HCLC was amended by the City Commission pursuant to Resolution No. 02-14 adopted January 10, 2002, Resolution No. 03- 993 adopted September 11, 2002, Resolution No. 04-0156 adopted March 11, 2004, and Ordinance No. 13030 adopted on October 16, 2008, to include, among other duties, the approval of local affordable housing incentive strategies ("Strategies"); and WHEREAS, the HCLC serves as the City's Affordable Housing Advisory Committee ("AHAC") as required by Section 420.9072, Florida Statutes; and WHEREAS, the HCLC's role as an advisory committee pursuant to Section 420.9076, Florida Statutes, is to review policies, procedures, ordinances, land development regulations, and the local government comprehensive plan and to recommend specific actions; and WHEREAS, in compliance with Section 420.9076, Florida Statutes, the AHAC must approve the recommended changes to the Strategies every three (3) years; and WHEREAS, on November 28, 2018, the HCLC recommended continuing the following Strategies, which are currently offered by the City: Expedited Permitting; Reduction of Parking and Setback Requirements; Impact -Fee Deferral/Waiver; Allowance of Flexibility in Densities and Intensities (i.e. Floor Area Ratio); Review of Legislation, Policies, and Plans that Impact Affordable Housing; and WHEREAS, the City Administration recommends the approval of the Strategies as recommended by the HCLC; NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Department of Housing and Community Development's Strategies as recommended by the HCLC pursuant to Section 420.9076, Florida Statutes, are approved. Section 3. The City Manager is authorized to negotiate and execute any and all necessary documents, in a form acceptable to the City Attorney, to implement said Strategies. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 11/27/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
