AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
35/ARTICLE IV OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TITLED "MOTOR VEHICLES AND TRAFFIC/PARKING RATES,"
MORE PARTICULARLY BY AMENDING SECTIONS 35-191 THROUGH 35-196
TO UPDATE RATES AND FACILITIES, CONTAINING A SEVERABILITY
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City o

WHEREAS, the ordinance establishing parking fees has not been updated or revised to
reflect average market rates or an updated listing of parking facilities throughout the City since
October 2009; and
WHEREAS, the City Commission authorizes the amendment to the Sections pertaining
to metered space rentals, meter removals, and residential parking program, as well as the
inclusion or deletion of additional facilities, as set forth in the Code of the City of Miami, Florida,
as amended ("City Code"), and more particularly described below;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance e
adopted and incorporated as if fully set forth in this Section,
Section 2, Chapter 35/Article IV of the City Code is amended in the following particulars:

from time to time. Average occupancy for each zone will be evaluated quarterly to adjust
pricing to demand, Pricing will be adjusted by demand using the following criteria:
(1) Zones that show occupancy greater than eighty five percent (85°/0) increase
by one dollar ($1.00) from the then existing rate until maximum rate is in effect,
(2) Zones that show occupancy between fifty percent (50%) and eighty five
percent (85%) remain the same.
0) Zones that show occupancy less than fifty percent (50%) decrease by he
dollar ($1,00) from the then existing rate until the minimum rate is in effect,
Areas that have wide variations throughout the day will be split into peak and off-peak
pricinq tiers. Rate changes will be applied to peak and off-peak times independently.
The minimum rate will be set at one dollar ($1.00) and the maximum rate at six dollars
($6.00) This pricing will not apply during special events.
Lc) The following fees will be assessed during special events, film production, and construction
uses for on -street parking space rentaL
1 Fifty dollars ($50.00) administrative fee per event assessed for any parking space
rental.
(2) The rental rate of thirty dollars ($30,00) per on -street parking space per day will be
assessed during special events and construction uses,
) The rental rate of thirty dollars ($30,00) per on -street parking space per day will be
assessed during film production, in addition to a two thousand dollar ($2,000.00) flat fee,
plus all other applicable fees.
(-b-) (d) Monthly on -street perrnIt program: The monthly on -street permit program is available, in
certain areas of the city, pursuant to this chapter, on a first -come, first -serve space available
basis. Permits are to be issued by DOSP. The chief executive
officer ("director") is expressly authorized to implement this program and shall oversee and
develop these special on -street parking permit areas as they are deemed necessary by the
director where the director determines that sufficient off-street parking facilities are not available
in an area to accommodate monthly parking demand. Such areas will be subject to all
applicable laws, resolutions, rules and guidelines governing their operation established by the
city commission and/or board/ -of-eff-street-park-ing-DOSP. Monthly parking patrons
may not pre -purchase on -street permits for more than one month at a time. On -street permits
can only be purchased on a month to month basis and payment is due on the 1s1 of the month.
DOSP will strictly enforce correct usage of permits, not allowing for any grace period,
(-e) (e) City employees who reside within the city will be able to receive a 20 percent (20%)
discount towards the purchase of one a) monthly permit f(one (1) permit)], as long as they
remain eligible Each additional permit will be sold at regular price. City residents are eligible to

individual fiscal year, or at an accrued annual rate of three percent (3%). The increase shall not

The rates and -fees charged for metered parking space rentals,

all applicable sales tax):
(1) Administrative processing fees: The administrative fees for the processing of all
metered parking space rental permits are set forth herein and may be amended from
time to time, by the city commission. The administrative fee is in addition to any fee paid
for parking stalls, meter bags, or linear curb space.

Parking space rental for production and film use.
DOSP may provide bagged parking space rental meters on an as -needed basis
within the sole discretion of t -ing-DOSP, taking into account the
parking needs of the city, and parking space rental bagged meters to accommodate production,
staff, and film needs. A copy of a valid, city issued production/film permit must accompany each
application for parking space baggeel-meter rental. Only essential vehicles shall be allowed to
park at parking spaces. ei.ege4meters. Crew parking can be arranged with f
off- DOSP. Parking Space Rental for production and film use shall be
red in color and shall state, "No Parking/Tow Away", and shall be strictly enforced. The fee per
parking space meter, or for every twenty (201 linear feet, is $1-0,00 thirty dollars ($30.00) per
day, payable twenty-four (24) hours in advance. The fees are set forth herein and may be
amended from time to time by the city commission.

(b) Permanent parking space FR-e-teF rernoval. Permanent parking space meter removal or
loading zone removal requests are strongly discouraged and are granted at the sole discretion
of DOSP's Chief Executive Officer, consistent with the parking needs of the City. The
monetization period for removal of a regulated parking space meter or loading zone parking
space (20' of Curb -line) will be ten (10) years assuming a three percent (3%) annual growth for
years two (2) through ten (10). The fee for the removal of a parking space is to be paid in
advance in a single lump sum fee. The monetized fee shall be the average annual system wide
revenue generated by a single parking space " or highest annual revenue
generated by a single metered parking space in the area where removal is requested,
whichever is greater. Monetization value of the ten years of income at the above described
highest annual revenue amount is calculated by street or parking meter zone, based upon the
most accurate revenue data available and maintained by DOSP.
If the applicant anticipates the creation of additional, new or replacement parking spaces
or loading zones, it shall provide DOSP with any and all information regarding the number and
location of these spaces or loading zones. Once the applicant has completed the project, it may
request from DOSP a refund for the specific number of spaces or curbline not permanently
removed from the public parking inventory. Any refund will be calculated based upon the total
number of replacement parking spaces returned to the public right of way, and the prorated
balance of time remaining, after subtracting the total time the parking metered space was
removed from the public inventory, from the ten (10)-year period of the pre -paid parking space
metef-monefization fee.
(c) Parking Infrastructure Reserve Fund (PIRF)- When a request for the removal of a parking
space is made, as defined above, all fees collected in accordance with the process shall be held
in a Parking Infrastructure Reserve Fund. DOSP shall use the monies in the PIRF for the
acquisition and installation of automated parking meters, automation of existing facilities,

expansion of the centralized operation capabilities, future development projects, land acquisition
and other improvements to the public parking system.
Sec. 35-196. Restricted residential parking program.
(a) The city commission hereby establishes the following Restricted Residential Parking (RRP)
zones. These zones are created to protect the quality of life of the city's residents in areas
where residential parking is severely impacted by competing uses. DOSP's Chief Executive
Officer or designee shall have the authority to create rules, regulations, and guidelines in
conformity with this section for the parking of vehicles and the issuance of resident, visitor, or
temporary permits within the RRP zones. The RRP zones are hereby established in conjunction
with, and following the location of, the City of Miami Commission districts.
(b) Resident parking permits. A restricted, residential zone resident must purchase restricted
residential permits from the - ck-ifig-DOSP. Residents can purchase up
to three (3) parking permits per household. Parking spaces within the RRP zones are not
guaranteed and are restricted to a specific RRP zone. The fee for these zones will be as
follows:
(1) $25.00 per year for one (1) vehicle.
(2) $50.00 per year for two (2) vehicles,
(3) $75.00 per year for three (3) vehicles,

(d) Creation of Additional RRP Zones. Requests for the creation of new RRP zones shall be
submitted te-t,he-lesal-NET office to the DOSP by the residents (property owner or current tenant
of the property). DOSP -shall review reel -us -Mc for new-RRP-zones
October. Upon approval by DOSP's Chief Executive Officer, or designee DOSP shall create a
new RRP zone. RRP zones only apply to single-family homes, duplexes, condominiums and
apartment complexes with ten or fewer units, which contain habitable rooms for non -transient
occupancy. Hotels, suite hotels, motels, apartment complexes with eleven or more units,
boardinghouses and day care centers shall not be considered for an RRP zone, In order to
receive an RRP zone permit, residents must provide copies of the following documents: current
driver's license, current motor vehicle registration, current utility bill and fully executed current
lease of property located within the program area. The RRP zone will be implemented if the
petition is signed by at least sixty percent (60%) of the residents,

(b) Demand Base Pricing:
The Department of Off -St et Parking ("DOSP") may implement demand based pricing
from time to time. Aver- e occupancy for each zone will be evaluated quarterly to adjust
pricing to demand. Pr inq will be adjusted by demand using the following criteria:
(1) Zone hat show occupancy greater than eighty five percent (85%) increase
by one 'dollar ($1.00) from the then existing rate until maximum rate is in effect.
(2) ones that show occupancy between fifty percent (50%) and eighty five
cent (85%) remain the same.
(3) Zones that show occupancy less than fifty percent (50%) decrease by one
dollar ($1.00) from the then existing rate until the minimum rate is in effect.
Areas that have wide variations throughout the day will be split into peak and off-peak
pricing tiers. Rate changes will be applied to peak and off-peak times independently.
The minimum rate will be set at one dollar ($1.00) and the maximum rate at six dollars
($6.00). This pricing will not apply during special events.
(c) The following fees will be assessed during special events, film production, and construction

basis. Permits are to be issued by DOSP. The chief executive officer ("erector") is expressly
authorized to implement this program and shall oversee and develo• ese special on -street
parking permit areas as they are deemed necessary by the directwhere the director
determines that sufficient off-street parking facilities are not ay.' . ble in an area to
accommodate monthly parking demand. Such areas will be . eject to all applicable laws,
resolutions, rules and guidelines governing their operatio -stablished by the city commission
and/or board/DOSP. Monthly parking patrons may not . purchase on -street permits for more
than one month at a time. On -street permits can on l •e purchased on a month to month basis
and payment is due on the 1st of the month. DOS ill strictly enforce correct usage of permits,
not allowing for any grace period.

discount towards the purchase of one monthly permit [one (1) permit], as long as they
remain eligible. Each additional per will be sold at regular price. City residents are eligible to

On -street parking space rental.
The rates and fees charged for metered parking space rentals, bagg-: meters and on
t sream, met non -metered space rental are as follows (all rates exclude parking s , rcharge and all
applicable sales tax):
(1) Administrative processing fees: The administrative fees for the . ocessing of all
metered parking space rental permits are set forth herein , d may be amended from
time to time, by the city commission. The administrative ee is in addition to any fee paid
for parking stalls, meter bags, or linear curb space.
The administrative fee structure is as follows:
a. $20.00 Fifty dollar ($50.00) administrativ- ee assessed for any meter parking space
rental of five meters or less.
b. $25.00 administrative fee assesses for any meter rental of six to ten meters.
c. $30.00 administrative fee as. sed for any meter rental of eleven meters or more.
(2) Metered pParking space rental '-e. The rate is $10.00 thirty dollars ($30.00) per parking

There is a non-refundable, onetime application fee of $1-50.00 two hundred fifty dollars
($250.00) per valet location before DOSP may approve the initial permit. After DOSP approves

Sec. 35-195. Meter removal Parking space closures.
(a) Temporary parking space meter removal closures. DOSP may provide for the tempora
removal closure of parking spaces meters to accommodate construction and other limit
needs. A fifty dollar ($50.00) administrative fee will be assessed for any temporary par ing
space closure. The rate of thirty dollar ($30.00) for the temporary removal closure o he
parking space meter and post shall be assessed on a per space, per day basis, p. able in

monetization period for removal of a regulated parking •ace meter or loading zone parking
space (20' of Curb -line) will be ten (10) years assumi . a three percent (3%) annual growth for
years two (2) through ten (10). The fee for the rem• al of a parking space is to be paid in
advance in a single lump sum fee. The monetize. fee shall be the average annual system wide
revenue generated by a single parking space cred parking space or highest annual revenue
generated by a single metered parking space ' the area where removal is requested,
whichever is greater. Monetization value of e ten years of income at the above described
highest annual revenue amount is calcul. -d by street or parking meter zone, based upon the

or loading zones, it shall provide riOSP with any and all information regarding the number and

request from DOSP a refund .r the specific number of spaces or curbline not permanently
removed from the public p. ing inventory. Any refund will be calculated based upon the total
number of replacement parking spaces returned to the public right of way, and the prorated
balance of time remain g, after subtracting the total time the parking metered space was
removed from the pu' is inventory, from the ten (101.-year period of the pre -paid parking space
meter monetizatio ee.
(c) Parking In f structure Reserve Fund (PIRF): When a request for the removal of a parking
space is ma. -, as defined above, all fees collected in accordance with the process shall be held
in a Parki s Infrastructure Reserve Fund. DOSP shall use the monies in the PIRF for the
acquisiti• and installation of automated parking meters, automation of existing facilities,
expan- on of the centralized operation capabilities, future development projects, land acquisition
and her improvements to the public parking system.
ec. 35-196. Restricted residential parking program.

(a) The city commission hereby establishes the following Restricted Residential Parking (RRP)
zones. These zones are created to protect the quality of life of the city's residents in areas
where residential parking is severely impacted by competing uses. DOSP's Chief Executive
Officer or designee shall have the authority to create rules, regulations, and guidelines in
conformity with this section for the parking of vehicles and the issuance of resident, visitor, or
temporary permits within the RRP zones. The RRP zones are hereby established in conjunc '. n
with, and following the location of, the City of Miami Commission districts.
(b) Resident parking permits. A restricted, residential zone resident must purchase re icted
residential permits from the department of off-street parking. Residents can purch.:e up to
three (3) parking permits per household. Parking spaces within the RRP zones arnot
guaranteed and are restricted to a specific RRP zone. The fee for these zones -ill be as
follows:
(1) $25.00 per year for one (1) vehicle.
(2) $50.00 per year for two (2) vehicles.
(3) $75.00 per year for three (3) vehicles-
(c) Temporary residential guest parkingplacard/hang tag pe' its. Temporary residential guest
parkingplacard/hang tag permits are available to each par cipating residence at a price of one
dollar ($1.00,) per permit, per day for a maximum of fifte• (15) hang tags per calendar year.;
authorizing guest parking in the restricted residential .nes are available from the department of
off street parking. Such permits are to be issued for * bona fide guest of a resident of the
restricted residential parking zones at a fee of $1 • per day, for a maximum two week period
during any calendar year. A restricted residenti zone resident must purchase residential guest
parking placard/hang tag permits. Temporary .uest parkingplacard/hang tag permits are only
valid within the restricted residential zone o he resident purchasing the guest permit, and are
not valid at any parking meter, municipal ' .rking lot, garage, or other restricted residential
parking ("RRP") zone.
(d) Creation of Additional RRP Zo s. Requests for the creation of new RRP zones shall be
submitted to the local NET office . the DOSP by the residents (property owner or current tenant
of the property). DOSP shall r• iew requests for new RRP zones twice a year, in April and
October. Upon approval by ► • SP's Chief Executive Officer, or designee, DOSP shall create a
new RRP zone. RRP zon-. only apply to single-family homes, duplexes, condominiums and
apartment complexes wi ten or fewer units, which contain habitable rooms for non -transient
occupancy. Hotels, sit' hotels, motels, apartment complexes with eleven or more units,
boardinghouses and ay care centers shall not be considered for an RRP zone. In order to
receive an RRP zo' e permit, residents must provide copies of the following documents: current
driver's license, rrent motor vehicle registration, current utility bill, and fully executed current
lease of proper located within the program area. The RRP zone will be implemented if the
petition is si. ed by at least sixty percent (60%) of the residents. Residents must provide woof
of residen ,, a valid driver's license corresponding to the RRP zone and a utility bill in order to
qualify t* eceive an RRP zone permit.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of the Ordinance shall not be affected.
