A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE USE FEE
FOR THE MANUEL ARTIME COMMUNITY CENTER PURSUANT TO SECTION
38-8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY
CODE"), TITLED "USE OF MANUEL ARTIME COMMUNITY CENTER;"
FURTHER WAIVING THE CITY OF MIAMI'S POLICE DEPARTMENT AND
FIRE -RESCUE DEPARTMENT COSTS REQUIRED PURSUANT TO SECTION
19-9 OF THE CITY CODE, TITLED "SPECIAL OFF -DUTY FIRE -RESCUE
SERVICES," AND SECTION 54-6.3(C)(18) OF THE CITY CODE, TITLED
"CRITERIA FOR ISSUANCE OF SPECIAL EVENTS PERMIT," IN A TOTAL
AMOUNT NOT TO EXCEED $2,500.00 FOR THE MIAMI INTERNATIONAL
JAZZ FESTIVAL TO BE HELD ON FEBRUARY 15 AND 16, 2019 AT THE
MANUEL ARTIME COMMUNITY CENTER.

WHEREAS, the Miami International Jazz Fest ("MIJF") is a 501(c)(3) corporation that
organizes events showcasing various jazz performers in a yearly jazz festival; and
WHEREAS, the 2019 Miami International Jazz Festival ("Event") will be held on
February 15 and 16, 2019 at the City of Miami's ("City") Manuel Artime Community Center
("Venue"), which will present diverse jazz expressions and artists; and
WHEREAS, the Event provides the local academic community, both students and
professors, with volunteer opportunities that place participants in direct contact with professional
musicians that may lead to long-term mentorships that cultivate local musical talent and will
further expose young musicians to the music industry; and
WHEREAS, the Event will be, in part, a benefit event for the Venue since MIJF will share
all ticket sales' receipts on a fifty percent (50%) basis with the City; and
WHEREAS, Section 38-8 of the Code of the City of Miami, Florida, as amended ("City
Code"), provides rates for the use of the various areas at the Venue, which include normal
janitorial service, air conditioning, normal use of houselights, and such other items that are
available for use at the Venue; and
WHEREAS, the rates established in Section 38-8 of the City Code do not include event
personnel or support services such as police officers, firefighters, ushering staff, ticket sellers,
ticket takers, stagehands, spotlight operators, sound and lighting technicians, musicians,
projectionists, booth equipment, installation and dismantling of electrical installations, and
insurance; and

WHEREAS, Section 38-8(c) of the City Code states that special rates or fee waivers the
Venue may be authorized upon user request and recommendation by the City's Administration
and ultimate approval by the City Commission; and
WHEREAS, the estimated Event costs for the required support of the City's Police
Department ("MPD") and Fire -Rescue Department ("Fire -Rescue") is a financial burden for the
MIJF and Event; and
WHEREAS, the waiving of the estimated costs imposed by Section 19-9 and Section 54-
6.3(c)(18) the City Code will result in a negligible financial impact to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The use fees for the MIJF required pursuant to Section 38-8 of the City Code
for use by the MIJF of the Venue are waived.
Section 3. The MPD and Fire -Rescue costs required pursuant to Section 19-9 and
Section 54-6.3 of the City Code for the Event to be held on February 15 and 16, 2018 at the
Venue are waived.
Section 4. The total amount of fees and costs waived pursuant to this Resolution shall
not exceed $2,500.00.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
