Purpose of Item:
The purpose of this item is to authorize the City Manager to execute an Amendment to
the Agreements with Moffatt & Nichol, Coastal Systems, T.Y. Lin, and APTIM
Environmental, for the provision of Miscellaneous Marine and Coastal Engineering
Services, increasing the authorized Compensation Limit by an amount not -to -exceed
$250,000, respectively, for a total amount not -to -exceed $1,000,000 each. Funds are to
be allocated from the corresponding capital improvement projects and departmental
budgets, for said purposes.
Background of Item:
On June 16, 2016, pursuant to City of Miami ("City") Procurement Code Section 18-87,
Request for Qualification ("RFQ") 15-16-011, the City Manager authorized the execution
of Agreements with Moffatt & Nichol, Coastal Systems, T.Y. Lin, and APTIM
Environmental, for the provision of Miscellaneous Marine and Coastal Engineering
Services, in an amount not to exceed $500,000, for each firm.
Pursuant to Resolution R-18-0030, adopted on January 25, 2018, the City Manager
authorized the execution of an Amendment to the Agreements with each firm,
increasing the Compensation Limit by an amount not to exceed $250,000, respectively,
for a total amount not to exceed $750,000 for each firm.
However, the amended Compensation Limit, for each firm, has diminished by varied
amounts based on the volume of work and complexity of the projects assigned, and is
therefore not sufficient to address the costs associated with the outstanding and
foreseeable future design and construction administration assignments.
Therefore, it is in the best interest of the City to enter into a second Amendment to the
Agreements with said firms, increasing the amended Compensation Limit by an amount
not to exceed $250,000, respectively, for a total amount not to exceed $1,000,000 each.
Funds are to be allocated from the appropriate capital improvement projects and
departmental budgets.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING AN INCREASE TO THE PROFESSIONAL SERVICES AGREEMENTS
WITH MOFFATT & NICHOL, INC., COASTAL SYSTEMS INTERNATIONAL, INC., T.Y.
LIN INTERNATIONAL, AND APTIM ENVIRONMENTAL & INFRASTRUCTURE, INC.,
FORMERLY CB&I ENVIRONMENTAL & INFRASTRUCTURE, FOR THE PROVISION
OF MARINE AND COASTAL ENGINEERING SERVICES, FOR ADDITIONAL WORK
IN AN AMOUNT NOT -TO -EXCEED $250,000.00 FOR EACH FIRM, THEREBY
INCREASING THE TOTAL COMPENSATION LIMIT FROM $750,000 TO AN AMOUNT
NOT -TO -EXCEED $1,000,000 EACH; ALLOCATING FUNDS FROM THE
APPROPRIATE CAPITAL IMPROVEMENT PROJECTS AND DEPARTMENTAL
BUDGETS, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED;
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE
PROFESSIONAL SERVICES AGREEMENT WITH EACH FIRM, IN SUBSTANTIALLY
THE ATTACHED FORM; AND FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALLOCATIONS,
APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY
MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, (CITY CODE), INCLUDING, THE
CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND
FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE
CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN
COMPLIANCE WITH APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR
SAID PURPOSE.
WHEREAS, pursuant to Section 18-87 of the Code of the City of Miami, Florida, as
amended, and Request for Qualifications ("RFQ") No. 15-16-011, the City of Miami ("City")
authorized the execution of Professional Services Agreements ("Agreement") with Moffatt &
Nichol, Inc. ("Moffatt & Nichol"), Coastal Systems International, Inc. ("Coastal Systems"), T.Y.
Lin International ("T.Y. Lin"), and APTIM Environmental & Infrastructure, Inc., formerly CB&I
Environmental & Infrastructure ("APTIM Environmental"), for the provision of Miscellaneous
Marine and Coastal Engineering Services, in an amount not to exceed $500,000.00,
respectively; and
WHEREAS, pursuant to Resolution No. 18-0030, adopted on January 25, 2018, the City
Commission authorized the execution of an Amendment to the Agreement with each firm,
increasing the Compensation Limit by an amount not to exceed $250,000.00, respectively, for a
total amount not to exceed $750,000.00 for each firm; and
WHEREAS, the amended Compensation Limit has diminished by varied amounts based
on the volume of work and complexity of the projects assigned; and
WHEREAS, the amended Compensation Limit, for each firm, is not sufficient to address
the costs associated with the outstanding and foreseeable future design and construction
administration assignments; and
WHEREAS, it is in the best interest of the City to increase the amended Compensation
Limit under the Agreement to accommodate outstanding and foreseeable future assignments;
and
WHEREAS, the proposed amendment ("Amendment"), in substantially the attached
form, proposes to increase the Compensation Limit with each firm by an amount not -to -exceed
$250,000.00, thereby increasing the total Compensation Limit from $750,000.00 to an amount
not -to -exceed $1,000,000.00 each; and
WHEREAS, funds are to be allocated from the appropriate capital improvement projects
and departmental budgets;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. An increase to the Agreements with Moffatt & Nichol, Coastal Systems, T.Y.
Lin, and APTIM Environmental, for the provision of Miscellaneous Marine and Coastal
Engineering Services, in an amount not -to -exceed $250,000.00 for each firm, thereby
increasing the total Compensation Limit from $750,000.00 to a total amount not -to -exceed
$1,000,000.00 each, is authorized.'
Section 3. Funds for said increase to be allocated from the appropriate capital
improvement projects and departmental budgets.
Section 4. The City Manager is authorized' to execute an Amendment to the
Agreements with Moffatt & Nichol, Coastal Systems, T.Y. Lin, and APTIM Environmental, in
substantially the attached form, for said purposes.
Section 4. The City Manager is further authorized' to negotiate and execute all other
documents, including any amendments, renewals, and extensions, subject to allocations,
appropriations, and budgetary approval having been previously made, and in compliance with
applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"),
including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City
Attorney, and in compliance with applicable regulations, as may be necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
