Projects Purpose of Item: The purpose of this item is to authorize the City Manager to execute Amendment No. 1 to the Agreements with Alleguez, Carty, Chisholm, Diaz Carreno Scotti, Ferguson Glasgow Schuster Soto, Gurri Matute, Leo A. Daly, MC Harry, Rodriguez Quiroga, and Wolfberg Alvarez, for the provision of Architectural Services for Miscellaneous Projects, increasing the authorized Compensation Limit by an amount not -to -exceed $500,000, respectively, for a total amount not -to -exceed $1,000,000 each. Funds are to be allocated from the corresponding capital improvement projects and departmental budgets, for said purposes. Background of Item: On April 12, 2018, pursuant to City of Miami ("City") Procurement Code Section 18-87, Request for Qualification ("RFQ") 16-17-057, the City Manager authorized the execution of Agreements with Alleguez, Carty, Chisholm, Diaz Carreno Scotti, Ferguson Glasgow Schsuter Soto, Gurri Matute, Leo A. Daly, MC Harry, Rodriguez Quiroga, and Wolfberg Alvarez, for the provision of Architectural Services for Miscellaneous Projects, in an amount not to exceed $500,000, for each firm. Said firms are actively rendering professional consulting services on several City projects, which require the continuation of design and construction administration services. However, the existing Compensation Limit, for each firm, is not sufficient to address the costs associated with the outstanding and foreseeable future design and construction administration assignments. Therefore, it is in the best interest of the City to enter into Amendment No. 1 to the Agreements with said firms, increasing the Compensation Limit by an amount not to exceed $500,000, respectively, for a total amount not to exceed $1,000,000 each. Funds are to be allocated from the appropriate capital improvement projects and departmental budgets. CHISHOLM ARCHITECTS, INC., DIAZ, CARREIVO, SCOTTI & PARTNERS, INC., FERGUSON GLASGOW SCHUSTER SOTO, INC., GURRI MATUTE, P.A., LEO A. DALY COMPANY, M.C. HARRY & ASSOCIATES, INC., RODRIGUEZ AND QUIROGA ARCHITECTS CHARTERED, AND WOLFBERG/ALVAREZ AND PARTNERS, INC. FOR THE PROVISION OF ARCHITECTURAL SERVICES FOR MISCELLANEOUS PROJECTS, FOR ADDITIONAL WORK IN AN AMOUNT NOT -TO -EXCEED $500,000.00 FOR EACH FIRM, THEREBY INCREASING THE TOTAL COMPENSATION LIMIT FROM $500,000.00 TO AN AMOUNT NOT -TO -EXCEED $1,000,000.00 EACH; ALLOCATING FUNDS FROM THE APPROPRIATE CAPITAL IMPROVEMENT PROJECTS AND DEPARTMENTAL BUDGETS, SUBJECT TO BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT WITH EACH FIRM, IN SUBSTANTIALLY THE ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALLOCATIONS, APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY OF MIAMI'S ("CITY") PROCUREMENT ORDINANCE, ANTI - DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, pursuant to Section 18-87 of the Code of the City of Miami, Florida, as amended ("City Code") and Request for Qualifications ("RFQ") No. 16-17-057, the City of Miami ("City") authorized the execution of Professional Services Agreements ("Agreement") with Alleguez Architecture, Inc. ("Alleguez"), Carty Architecture, LLC ("Carty"), R.E. Chisholm Architects, Inc. ("Chisholm"), Diaz, Carreno, Scotti & Partners, Inc. ("Diaz Carreno Scotti"), Ferguson Glasgow Schuster Soto, Inc. ("Ferguson Glasgow Schuster Soto"), Gurri Matute, P.A. ("Gurri Matute"), Leo A. Daly Company ("Leo A. Daly"), M.C. Harry & Associates, Inc. ("MC Harry"), Rodriguez and Quiroga Architects Chartered ("Rodriguez Quiroga"), and Wolfberg/Alvarez and Partners, Inc. ("Wolfberg Alvarez") for the provision of Architectural Services for Miscellaneous Projects, in an amount not to exceed $500,000.00, respectively; and WHEREAS, said firms are actively rendering professional consulting services on several City projects, which require the continuation of design and construction administration services; and WHEREAS, the existing Compensation Limit, for each firm, is not sufficient to address the costs associated with the outstanding and foreseeable future design and construction administration assignments; and WHEREAS, it is in the best interest of the City to increase the Compensation Limit under the Agreement to accommodate outstanding and foreseeable future assignments; and WHEREAS, Amendment No. 1, attached and incorporated, increases the Compensation Limit with each firm by an amount not -to -exceed $500,000.00, thereby increasing the total Compensation Limit from $500,000.00 to an amount not -to -exceed $1,000,000.00 each; and WHEREAS, funds are to be allocated from the appropriate capital improvement projects and departmental budgets; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An increase to the Agreements with Alleguez, Carty, Chisholm, Diaz Carreno Scotti, Ferguson Glasgow Schsuter Soto, Gurri Matute, Leo A. Daly, MC Harry, Rodriguez Quiroga, and Wolfberg Alvarez, for the provision of Architectural Services for Miscellaneous Projects, in an amount not -to -exceed $500,000.00, for each firm, thereby increasing the total Compensation Limit from $500,000.00 to a total amount not -to -exceed $1,000,000.00 each, is authorized.' Section 3. Funds for said increase to be allocated from the appropriate capital improvement projects and departmental budgets, subject to budgetary approval at the time of need. Section 4. The City Manager is authorized1 to execute Amendment No. 1 to the Agreements with Alleguez, Carty, Chisholm, Diaz Carreno Scotti, Ferguson Glasgow Schsuter Soto, Gurri Matute, Leo A. Daly, MC Harry, Rodriguez Quiroga, and Wolfberg Alvarez, in substantially the attached form, for said purpose. Section 5. The City Manager is further authorized1 to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations, and budgetary approval having been previously made, and in compliance with applicable provisions of the City Code, including, the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. APPROVED AS TO FORM AND CORRECTNESS:
