Subject: Evaluate - Adaptation Action Districts
Purpose of Item:
A Resolution of the Miami City Commission directing the City Manager to evaluate
designating Adaptation Action Districts to enable exceptions and special permits within
these designated areas in support of advancing resilience to Sea Level Rise.
Background of Item:
Adaptation Action Areas are those that experience coastal flooding and that are
vulnerable to the related impacts of rising sea levels. The concept of Adaptation Action
Areas can be used as a tool to help begin addressing challenges on a more
manageable scale.
Adaptation Action Districts provide additional policy tools to encourage alignment of
resources and prioritization of funding for infrastructure needs and adaptation planning.
Criteria for designating areas as Adaptation Action Districts may include: areas for
which land elevations are below, at, or near mean high water, areas designated as
evacuation zones for storm surge, or coastal areas.

A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO INITIATE THE PROCESS TO AMEND ORDINANCE NO. 10544, AS
AMENDED, THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN ("MCNP") OF
THE CITY OF MIAMI, FLORIDA AND ORDINANCE NO. 13114, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA ("MIAMI 21 CODE"), AS AMENDED,
TO DEVELOP ADAPTATION ACTION AREAS IN THE COASTAL MANAGEMENT
ELEMENT OF THE MCNP AND IN THE MIAMI 21 CODE TO ALLOW FOR SPECIFIC
DESIGN STANDARDS, SPECIAL PERMITS, AND OTHER INNOVATIVE LAND
DEVELOPMENT REGULATIONS WITHIN DESIGNATED ADAPTATION ACTION
AREAS IN SUPPORT OF ADVANCING ADAPTATION AND RESILIENCE TO SEA
LEVEL RISE.
WHEREAS, Section 163.3164(1), Florida Statutes, defines adaptation action areas as "a
designation in the coastal management element of a local government's comprehensive plan
which identifies one or more areas that experience coastal flooding due to extreme high tides
and storm surge, and that are vulnerable to the related impacts of rising sea levels for the
purpose of prioritizing funding for infrastructure needs and adaptation planning."; and
WHEREAS, Section 163.3177(6)(g)(10), Florida Statutes, allows local governments the
option of developing "adaptation action area designation for those low-lying coastal zones that
are experiencing coastal flooding due to extreme high tides and storm surge and are vulnerable
to the impacts of rising sea level ..." as part of the coastal management element to its
comprehensive plan; and
WHEREAS, adopting adaptation action areas, as part of the coastal management
element of the Miami Comprehensive Neighborhood Plan ("MCNP"), will allow for the
consideration of policies that "improve resilience to coastal flooding resulting from high -tide
events, storm surge, flash floods, stormwater runoff, and related impacts of sea -level rise" for
"areas for which the land elevations are below, at, or near mean high water, which have a
hydrologic connection to coastal waters, or which are designated as evacuation zones for storm
surge"; and
WHEREAS, consistent with any amendments to the MCNP related to adaptation action
areas, Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended
("Miami 21 Code") could be amended to incorporate specific design standards, special permits,
or other innovative land development regulations to improve resilience and mitigate the impact
of sea level rise in adaptation action areas; and
WHEREAS, the City's Sea Level Rise Committee, at its February 20, 2018 meeting,
adopted a resolution recommending that the City Manager evaluate designating adaptation
action areas in support of advancing resilience to sea level rise;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby directs the City Manager to initiate the process
to amend the MCNP to develop adaptation action areas in the coastal management element
thereof, to allow for specific design standards, special permits, and amendments to the Miami
21 Code within these designated areas, in support of advancing adaptation and resilience to
sea level rise.
Section 3. The City Commission hereby directs the City Manager to initiate the process
to amend the Miami 21 Code to allow for specific design standards, special permits, and other
innovative land development regulations, consistent with the MCNP, within designated
adaptation action areas in support of advancing adaptation and resilience to sea level rise.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
