HomeMy WebLinkAboutR-18-0500City of Miami Resolution R-18-0500 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 4912 Final Action Date: 11/15/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE MIAMI-DADE WATER AND SEWER DEPARTMENT FOR THE PROVISION OF WATER AND SANITARY SEWER SERVICES FOR CURTIS PARK'S NEW POOL FACILITY, CAPITAL PROJECT 40-B35806. WHEREAS, the City of Miami ("City") intends to construct a new public swimming pool facility with a capacity for eighty-eight (88) people to replace the existing fifty (50) person capacity public swimming pool facility at Curtis Park in connection with Curtis Park New Pool Facility, Capital Project 40-B35806, located at 1901 Northwest 24 Avenue, Miami, Florida ("Property"); and WHEREAS, the Miami -Dade Water and Sewer Department ("WASD") provides water and sewer services at the Property; and WHEREAS, since there is estimated to be no average daily gallonage increase, the City does not have to pay additional connection charges to WASD; and WHEREAS, the City Manager requests authorization to execute an agreement, in substantially the attached form, with WASD for water and sanitary sewer services at the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute an agreement, in substantially the attached form, with WASD for the provision of water and sanitary sewer services for the Curtis Park New Pool Facility, Capital Project 40-B35806, at the Property. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. Z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
