(the "Applicants") in connection with the development of the properties at 3710 NW 13 Avenue, 1329 NW 37 Street, and 1300 NW 38 Street and legally described in the enclosed Exhibit A (collectively, the "Property"). The Property is in a residential area in immediate proximity to Metrorail, major road corridors (Le., State Road 112, Interstate 95, and NW 36 Street), and multiple Metrobus routes, and high -intensity commercial and semi -industrial uses. Connected as it is to the transportation network and NW 36 Street's emerging commercial corridor, the Property is ideally suited for sorely needed multifamily Workforce Housing. The purpose of the enclosed application (the "Applications") is to amend the Property's Future Land Use and zoning designations to ensure that the Property can realize this potential. Specifically, the Applications propose amending the Property's land use designation from Duplex Residential to Low Density Multi -Family Residential, and its zoning from T3-0 to T4-R. To ensure that future development is in line with existing duplex homes in the area, the Applicant voluntarily proffers a restrictive covenant that would limit the height future buildings on the site. The proffered covenant will also restrict any future residential development on the Property to Workforce Housing. I. The Property The Property is part of a small enclave of duplex homes surrounded by intense uses and development. As depicted in the diagram below, the duplex area is bordered to the north by 2525 Ponce de Leon Blvd., Suite 700, Coral Gables, FL 33134 1305-854-0800 I www.wsh-law.com Ms. Olga Zamora January 11, 2018 Page 2 of 4 State Road 112, to the east by Metrorail tracks and the Allapattah Metro station, to the south by the high intensity commercial corridor along NW 36 Street, and to the west by additional high intensity commercial and T5-residential. In addition, the Property is in close proximity to a number of important civic support uses including: Miami Jackson Senior High School (5 blocks west;) Lenoray Braynon Elementary (9 blocks north); Georgia Jones -Ayres Middle School (9 blocks north); The Pace Center for Girls (3 blocks west); The Allapattah Branch Library (6 blocks west); Moore Park (5 blocks east); and Charles Hadley Park (9 blocks north). The diagram below succinctly describes the Property's immediate neighborhood. Civic Institutional NW 36 Street IL, Comprehensive Plan Analysis Subject Property COMMERCIAL By promoting a greater variety of housing types in close proximity to multiple modes of transportation, civic uses, and Allapattah' s commercial corridor, the Applications will advance a number of the Miami Comprehensive Neighborhood Plan's goals, objectives and policies including, but not limited to: WEISS SEROTA HELFMAN COLE & BIERMAN AT THE CROSSROADS OE BUSINESS, GOVERNMENT & THE LAW Ms. Olga Zamora January 11, 2018 Page 3 of 4 Policy LU-1.1.11 and TR-1.1.1: The City hereby adopts designation of the City,...as an Urban Infill Area. Within this area, the concentration and intensification of development around centers of activity shall be emphasized with the goals of enhancing the livability of residential neighborhoods and the viability of commercial areas. Priority will be given to infill developments on vacant parcels, adaptive reuse of underutilized land and structures, the redevelopment of substandard site, downtown revitalization and the development of projects that promote public transportation. Maintenance of transportation levels of service within this designated Urban Infill Transportation Concurrency Exception Area shall be in accordance with the adopted Transportation Corridors level of service standards and the City of Miami Person Trip Methodology as set forth in Policies TR-1.1.2 and 1.1.3 of the Transportation Element of the MCNP. Policy LU-1.1.7: Land Development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range residential, office, live/work spaces,. neighborhood retail and community facilities in walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. 111. Zoning Analysis Pursuant to Miami 21 Section 7.1.2.8.c.2(g) In accordance with Miami 21 Section 7.1.2.8.c.2(g), the enclosed Applications include an aerial map of the Property's vicinity, a copy of the zoning atlas showing the zoning within a one-half mile radius of the Property, and photos of buildings within 300 feet of the Property. The proposed rezoning will better comply with Miami 21's transect principles than the existing zoning designation. As the diagram below demonstrates, the zoning map for the Property has a T3 transect zone directly abutting a T5 transect. The T5 transect zone allows development of up to five stories with 80% lot coverage, and uses that are virtually identical to those in the T6-0 transect zone,' Miami 21's most liberal transect zone. In dramatic contrast, the T3 transect zone allows two stories, 50% lot coverage, and permits only residential.2 In furtherance of Miami 21's transect principles,3 the proposed rezoning would create better transition between the T3 and T5 transect zones by inserting a T4 transect zone. 1 There are only three minor differences between T6-0 and TS-L permitted uses. 2 Limited civic uses are also permitted but only through the Exception process. 3 Miami 21, Section 2.1.2(a)(2) identifies on of Miami 21's primarily goals as "Improving the relationship between low Density Residential neighborhoods and adjacent Commercial Corridors with appropriate transitions of Density and Height following the theory of the Transect" (emphasis added). Existing buildings within 300 feet of the Property track their zoning designations. A seven -story office building is located on the T51T6 zoned parcel immediately south of the Property. One- and two-story commercial buildings with large surface parking lots are also prevalent to the south. To the north, most buildings are single story residential structures. The proposed zoning —together with the voluntarily proffered covenant to restrict height —will match relate to this pattern by providing a better transition from the five to twelve stories permitted to the south of the Property to the two stories permitted to the Property's north.
