Box 330708 Miami, FL 33233-0708 RE: Appeal of HEPB Resolution R-18-050 Local Designation as an Historic Resource Address: 3587 HIBISCUS STREET (Folio Number 01-4121-007-7050) As part of the "Wood Frame Vernacular Residences of Coconut Grove Village West Multiple Property Designation" Owner: Antoinette Simmons Dear Hearing Boards Department: I am filing this Appeal on behalf of Antoinette Simmons. The Appeal is from the Historic and Environmental Preservation Board (HEP Board) Resolution R-18-050, the designation of her property at 3587 Hibiscus Street as an Historic Resource of the City of Miami, Florida. Antoinette Simmons asks that the decision of the HEP Board be reversed pursuant to Sec. 23- 4(7) of the Code. 1 am filing this appeal for Antoinette Simmons on the grounds that: 1. Inconsistent Substantive and Procedural Application The actions of the Historic Preservation Division of the City of Miami Planning and Zoning Department and the City of Miami in creating the "Thematically -Related" concept, the "Multiple Property Designation" process, and the ultimate selection of properties and their designation in accordance with the "Wood Frame Vernacular Residences of Coconut Grove Village West Multiple Property Designation" violates the commitment that the City of Miami has made to act in accordance with the best practices concepts as promulgated by the Secretary of the United States Department of the Interior. Additionally, in the Historic Preservation Division's "Analysis for Evaluation for Designation," dated July 3, 2018 and appearing at page 37 of the Agenda Package for the July 3, 2018 HEP Board meeting, it states: "The Applicant is requesting the Final Evaluation for the wood frame vernacular residences of Coconut Grove Village West as a locally designated multiple property designation. The request is found to be in accordance with the Comprehensive Plan and the Secretary of the Interior Standards." (Emphasis in Italics added.) 1 Since the City of Miami's first Programmatic Agreement with the Florida State Historic Preservation Office and the Federal Advisory Council on Historic Preservation (R-12-0217, May 24, 2012), and the recent amendment (R-17-0358, July 27, 2017), the City has followed Federal Guidelines in the implementation of its historic preservation program. In fact, the September 2011 City of Miami Historic Preservation Guidelines state that they "reflect the best practices in historic preservation." These general design guidelines strictly follow the "Secretary of Interior's Standards for Rehabilitation (U.S. Department of the Interior Regulations, 36 CFR Part 67, Historic Preservation Certifications). And, the City affirmed to the Florida State Historic Preservation Office and the Federal Advisory Council on Historic Preservation in 2012 that "..the City has conducted City-wide historic structure and building surveys; and has defined the boundaries of the City's historic districts, as well as individual historic resources..." This allegation was twice affirmed by the HEP Board (May 1, 2012, following an advertised public hearing, adopting Resolution No. HEPB-2012-30 by a vote of 7-0; and July 10, 2017, following an advertised public hearing, adopting Resolution No. HEPB-R-17-042 by a vote of 8-0) and twice affirmed by the City Commission (May 24, 2012, following an advertised public hearing, adopting Resolution No. 12-0217 by a vote of 4-0; and on July 27, 2017, following an advertised public hearing, adopting Resolution No. R-17- 0358 by a vote of 4-0). Given the City's most recent affirmation in 2017 that all individual historic resources in the City had been identified, then how could there be 51 other properties identified for historic designation in 2018? What exactly is, therefore, this experiment in "thematically -related" "multiple property designation"? If all individual historic resources in the City of Miami have been identified through a "City-wide historic structures and buildings survey," then what is this experimental "Wood Frame Vernacular Residences of Coconut Grove Village West Multiple Property Designation"? How does the HEP Board and the City Commission explain these new-found historic resources when they have for so long affirmed that all historic buildings had been identified? The City of Miami's experiment with Multiple Property Thematic Designation is not only flawed in its conception and fails to meet Due Process and Equal Protection standards, but this experiment is also not even rational in terms of economic impact on property owners of designated structures --many of whom live in old wooden homes in need of repair in an area that the City of Miami in January 2018 declared "slum and blighted" when it approved the Finding of Necessity for the expansion of the Omni CRA to the West Grove (Resolution R-18-0010, January 11, 2018). These slum and blighted wooden properties that have been designated as historic now have "affirmative maintenance required." Sec. 23-6.2(i)(1) of the Code, in part, states: "All such structures shall be preserved against such decay and deterioration and shall be free from structural defects through prompt corrections of any of the following defects:..." And, there are no additional incentives or grants to assist pay for the mandated maintenance and repairs that will be required. Yet, the City's Division of Historic Preservation's meeting handout, "Historic Designation Frequently Asked Questions," clearly states in answer to the question: "What is the City of Miami's Historic Preservation ordinance?" that "Its purpose is to encourage the preservation of historic properties by providing assistance and incentives to owners..." 2 Therefore --"Multiple Property Designation" of "Thematically -Related" historic resources —what are they? A brand-new concept in Miami historic preservation resources above and beyond a previous comprehensive city-wide inventory identifying all historic districts and individual historic properties, affirmed as complete by the HEP Board and the City Commission as late as July 2017. An experiment to save 20+ plus "shotgun" homes that lacked best practices standards for research and identification, and without protections for due process and equal protection that ended up identifying 51 candidate old wooden structures, and violating even the basic Code requirement of Sec. 23-4(c) that: "In those instances when a historic district or Multiple'Property Designation is being considered, the preservation office shall conduct outreach involving all relevant home owner associations and neighborhood associations, ultimately ascertaining their level of support by way of resolution or vote. Said level of support shall be taken into consideration by staff and members of the HEPB when evaluating any proposed historic district of Multiple Property designation." (Emphasis in Italics added.) Finally, the Applicant, (i.e., the City Commission), for this "Wood Frame Vernacular Residences of Coconut Grove Village West Multiple Property Designation" gave clear instructions about additional criteria for removal of properties from the List of Properties during their scheduled "Discussion" Agenda Item of this Application at the City Commission Meeting of Thursday, July 12, 2018. These instructions directed that no building that had received an unsafe structure notice or would face economic hardship should be designated. This Commission meeting was well in advance of the HEP Board Special Meeting for Designation on Monday, July 16, 2018. The failure of the HEP Board to follow these explicit instructions of the Applicant City Commission provides an additional ground for appeal. 2. Insufficient Documentation of Historical Significance In addition, the City has accepted Federal grants to operate its historic preservation program, and has based its Historic Design Guidelines on the "Secretary of the Interior's Standards for the Treatment of Historic Properties." Chapter 23 of the City Code, Section 23-4(a) is woefully short on documentation standards for the selection of historic properties. Similar to the adoption of the Federal Design Guideline Standards, and in accord with the actual language of the 2012 Agreement (amended 2017 to extend the length of the Agreement to 2022), the City has already committed for Section 106 of the National Historic Preservation Act to document candidates for historic preservation with the language that: "The City shall ensure that any determination by Certified Staff as to whether a property is historic, for purposes of this agreement, is supported by sufficient documentation to enable any reviewing parties to understand its basis, including, but not limited to a survey, site plan, photos, elevations, evidence of construction date, context." The City of Miami's HEP Board "...has adopted the Secretary of the Interior's Standards for Rehabilitation as a foundation for the decisions regarding modification of historic buildings..." 3 (City of Miami Planning & ,Zoning web page, Historic Design Guidelines section, accessed August 1, 2018.) However, the Code is silent about the specifics of the designation process. It would be only logical for the City and the HEP Board to follow admitted best practices and therefore follow the Secretary of the Interior's "Standards and Guidelines for Architectural and Engineering Documentation" when seeking to designate an individual historic property. These "Standards & Guidelines for Architectural and Engineering Documentation" are expressly for "Local governments wishing to establish a comprehensive approach to the identification, evaluation, registration and treatment of historic properties within their jurisdictions." (48 Federal Register 44716, 1983), and therefore should be considered part of the "Secretary of Interior Standards" that Historic Preservation staff declared they used in their "Analysis for Evaluation for Designation." However, the failure to follow any detailed Standards and Guidelines for designation, has resulted in a flawed process that created a defective designation of 3587 Hibiscus Street because of inadequate individual property analysis and other factors, with the result that based upon the vague and incomplete information presented on this property, the Criteria for Designation under Section 23-4(a) of Chapter 23 of the City of Miami Code cannot be accurately applied. Therefore, we believe that: 3587 Hibiscus Street does not "3. ExempIify the historical, cultural, political, economic, or social trends of the community;" 3587 Hibiscus Street does not "4. Portray the environment in an era of history characterized by one or more distinctive architectural styles;" and 3587 Hibiscus Street does not "5. Embody those distinguishing characteristics of an architectural style, period, or method of construction.;" 3. Comment on Economic Impact Antoinette Simmons is very much in favor of preserving history and culture. However, she feels that the fifty-one homes that have been selected were singled out for the benefit of the entire area, thereby placing the burden of preservation on just a few. Because of her knowledge of the area, she is very surprised by what she feels is a random selection process used to identify which of the many wooden homes in Village West were included on the List. Antoinette Simmons also wanted to share that she felt that when attempting to preserve cultural heritage, public buildings such as churches, museums, theaters or libraries are places that define a community, not just a random collection of old wooden houses. She, like so many others, question why the initial City Commission goal of creation of an historic district to protect historic shotgun homes was transformed by staff into an experiment in "thematic" "multiple property" designation for the preservation of old wooden homes, some built in the late 1930s and early 1940s. 3587 Hibiscus Street is not a shotgun home, and over the years has had significant modifications, and no longer resembles the original structure. 4 Like so many of the designated property owners, she realizes that there is an economic hardship accompanying designation. The affirmative maintenance requirements as well as the additional bureaucratic review by the Historic Preservation staff and the Historic and Environmental Preservation Board are recognized, but unlike the MiMo historic district, she, like many owners question why there is no plan for Village West that was put into place before this experiment began, and why there was no effort to create incentives to offset the costs to be incurred by designation. Lastly, there is the recognized issue that the National Historic Registry requires the consent of a property owner prior to being listed, and it seems that before this "thematic" "multiple property designation" experiment in designation, Miami had never designated an individual property without the owner's prior consent. Note, also, that there have been repeated allegations by the Historic Preservation staff and speakers during Public Comment periods at both City Commission and HEP Board meetings that historic designation would bring increased value to the property. These allegations are actually counter to a recent report done for the independent Federal Agency, the Advisory Council on Historic Preservation. This Report, Measuring Economic Impacts of Historic Preservation (2013), in its first two Findings, states: 1. Various aspects of historic preservation have substantial economic benefits as well as economic costs. While many argue that the benefits to society, both financial and otherwise, outweigh the costs, the relationship between preservation and the economy as well as the overall societal benefits remains imperfectly understood and only partially documented. 2. Research into the relationship between economics and historic preservation is critically needed. Conclusion In conclusion, on behalf of Antoinette Simmons, I reserve the right to raise additional reasons or grounds for the Appeal at the City Commission Hearing, based upon any newly discovered short -comings in the process and procedure that led up to the amendments to the Code creating the "Multiple Property Designation," and the "Thematic -Related" process, and to any and all other irregularities or short -comings in the research and community engagement procedures. As stated in Sec. 24-4(c)(7): "The appeal shall be a de novo hearing and the city commission may consider new evidence or materials..." Thank you for your guidance as eye prepared this Appeal.
