HomeMy WebLinkAboutR-18-0436City of Miami Resolution R-18-0436 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 4717 Final Action Date: 10/11/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5) AFFIRMATIVE VOTE, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S EMERGENCY FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT IT IS MOST ADVANTAGEOUS FOR THE CITY TO WAIVE THE COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; FURTHER APPROVING THE RETROACTIVE SELECTION OF TERMA OF NORTH AMERICA INC., A FOREIGN PROFIT CORPORATION, FOR THE PURCHASE OF A MARITIME RADAR ANTENNA, IN THE AMOUNT OF $105,433.08. WHEREAS, the City of Miami's Department of Fire -Rescue ("Fire") required the replacement of the maritime radar antenna that was damaged by hurricane Irma in order to continue being part of the region -wide counter terrorism/interdiction project ("Project"); and WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"), approved an emergency purchase to acquire the antenna; WHEREAS, the emergency purchase of this maritime radar antenna was necessary to service and enhance the health, safety, and welfare of City of Miami ("City") residents; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-90 of the City Code, the City Manager's emergency finding, attached and incorporated as Exhibit "A," is ratified and retroactively approved; the requirements for competitive sealed bidding procedures are waived; and the emergency purchase of the antenna from Terma North America, Inc. for Fire, in the amount of $105,433.08, is approved. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. 1 This resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
