AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE V OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), TITLED "STREETS AND SIDEWALKS/BASE
BUILDING LINES," MORE SPECIFICALLY BY AMENDING SECTION 54-190,
TITLED "NONSTANDARD STREET WIDTHS," BY MODIFYING THE WIDTH OF
NORTHWEST/NORTHEAST 5TH STREET BETWEEN BISCAYNE
BOULEVARD AND NORTHWEST 3RD AVENUE FROM EIGHTY FEET (80') TO
SEVENTY FEET (70'); MODIFYING THE WIDTH OF
NORTHEAST/NORTHWEST 6TH STREET BETWEEN NORTHEAST 2ND
AVENUE AND NORTHWEST 3RD AVENUE FROM EIGHTY FEET (80') TO
SEVENTY FEET (70'); AND MODIFYING THE WIDTH OF NORTHWEST 1ST
AVENUE ON THE EAST SIDE BETWEEN NORTHWEST 10TH STREET AND
NORTHWEST 11TH STREET FROM ONE HUNDRED FIVE FEET (105') TO
SEVENTY FEET (70'), AND BETWEEN NORTHWEST 8TH STREET TO
NORTHWEST 10TH STREET FROM ONE HUNDRED FIVE FEET (105') TO
FIFTY FEET (50'); CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.

WHEREAS, Chapter 54, Article V of the Code of the City of Miami, Florida, as amended
("City Code"), establishes base building line locations for all public streets within the City of
Miami ("City"); and
WHEREAS, in 1985, the City Commission pursuant to Ordinance No. 10031, increased
the zoned width of certain roadways within the area bounded by Northwest/Northeast 5th Street,
1-395, 1-95, and Biscayne Boulevard thereby reserving for roadway purposes additional private
property in anticipation of future widening in accordance with the Southeast Overtown/Park
West Redevelopment Plan; and
WHEREAS, Ordinance No. 13114, as amended, the Zoning Ordinance of the City of
Miami, Florida establishes streetscape criteria for new development to accommodate the needs
of vehicular traffic, pedestrians, and landscaping in the public right-of-way and adjacent private
property; and
WHEREAS, there is existing and historical development on the east and west borders of
the Southeast Overtown/Park West area that precludes certain roadways from ever reaching
the increased zoned right-of-way width in the future as a continuous typical cross section along
their entire length; and
WHEREAS, the City Administration's review of the local roadways in the Southeast
Overtown/Park West area reveals that the right of way widths as proposed in this Ordinance will
adequately serve the present and future transportation needs of the public; and

WHEREAS, the City's Departments of Police, Fire -Rescue, and Solid Waste have
evaluated the effect of the reduction of the zoned street widths of these roadways on their
operations and have no substantial objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 54/Article V/Section 54-190 of the City Code is amended in the
following particulars.'
"CHAPTER 54
STREETS AND SIDEWALKS
ARTICLE V. BASE BUILDING LINES
Sec. 54-190. Nonstandard street widths.
Base building lines shall be located from the centerline as specified for each of the following
streets:

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
