PURPOSE: This will close, vacate, abandon and discontinue the public use of a Street.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING THE CLOSURE, VACATION, ABANDONMENT, AND
DISCONTINUANCE FOR PUBLIC USE A STREET LOCATED AT NORTHEAST 14
TERRACE BETWEEN BISCAYNE BOULEVARD AND NORTH BAYSHORE DRIVE,
MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A,"
ATTACHED AN INCORPORATED, PURSUANT TO SECTION 55-15(C) OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; MAKING FINDINGS;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Resorts World Miami, LLC and Miami -Dade County (collectively,
"Applicant") submitted an application to the City of Miami ("City") for the vacation and closure of
a street located at Northeast 14 Terrace between Biscayne Boulevard and North Bayshore
Drive, Miami, Florida ("Street"), as more particularly described in Exhibit "A"; and
WHEREAS, the Street lies within the limits of the approved Awana Forest Tentative Plat
#1904; and
WHEREAS, the City's Department of Resilience and Public Works and the Plat and
Street Committee ("PSC") have reviewed the subject vacation and closure and determined that
it will not affect pedestrian or vehicular traffic circulation or access for public service; and
WHEREAS, at its meeting held on September 25, 2017, the PSC reviewed the Street
closure application and determined it complied with the required findings for a closure and that
all technical requirements had been met; and
WHEREAS, the PSC, pursuant to the requirements of Section 55-15 of the Code of the
City of Miami, Florida, as amended ("City Code"), considered the request for vacation and
closure of the Street and recommended approval with conditions by a vote of six to zero (6 - 0);
and
WHEREAS, the City's Planning, Zoning and Appeals Board ("PZAB") at its meeting on
June 6, 2018, following an advertised public hearing, adopted Resolution No. PZAB-R-18-031
by a vote of four to three (4 - 3), recommending approval with conditions of the vacation and
closure of the Street as presented; and
WHEREAS, the City Commission finds that it is in the best interest of the general welfare
of the City and its inhabitants to grant the vacation and closure of the Street and deems it
advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Street, as more particularly described in Exhibit "A", is closed,
vacated, abandoned, and discontinued for public use.
Section 3. The closure, vacation, abandonment, and discontinuance for public use of
a portion of the Street must comply with the following conditions:
a) The Applicant, owner, or their successor must meet all applicable
development standards identified in the Ordinance No. 13114, as amended,
the Zoning Ordinance of the City of Miami, Florida and all other applicable
local, County, State, and Federal regulations.
b) A building permit, including phased permits, will not be issued on the
property being platted until the final plat is recorded or as authorized
pursuant to Section 55-10 of the City Code.
c) A Certificate of Occupancy, Certificate of Use, Temporary Certificate of
Occupancy, or Temporary Certificate of Use shall only be issued after all the
required subdivision improvements have been completed.
d) The Applicant, owner, or their successor shall comply with the conditions of
approval stated for the Awana Forest Tentative Plat #1904 in a letter dated
October 10, 2017 issued by the Department of Resilience and Public Works.
Section 4. The approval of the requested vacation and closure shall be valid for a
period of four (4) years and shall remain independent of the referenced tentative plat during this
period.
Section 5. The approved final plat must be recorded within the four (4) year approval
period of the requested vacation and closure.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
