GENERAL INFORMATION REQUEST: Pursuant to Section 55-15(c), of the City Code of Ordinances, Resorts World Miami, LLC and Miami -Dade County (the "Applicant") request to close, vacate, abandon and discontinue for public use a Street located at NE 14 Terrace, between Biscayne Boulevard and North Bayshore Drive. PROPERTY: The subject Property is in an Urban Core -Open Transect Zone, "T6-O," and in the Omni CRA Performance Arts & MED District / Downtown Brickell NET area. The segment of this one-way Street proposed be closed and vacated is comprised of approximately 12,600 square feet. It is approximately 30 feet in width by 420 feet in length and stretches in eastward direction from Biscayne Boulevard to North Bayshore Drive. The subject Street abuts Miami -Dade County Transit Bus Terminal to the north, and a surface parking lot to the south, which is shown in Figure 1. A copy of which is provided as Attachment "A". Figure 1: Aerial View of NE 14 Terrace B. BACKGROUND The request for a Street closure is in support of Awana Forest tentative plat application "T-Plat # 1904". The Street was dedicated on January 8, 1916 by the platting of the "Garden of Eden Subdivision," as shown in P.B. 4, Page 12. The dedication was made for the sole use of the properties abutting the Street, included in the Original Plat, and consists of Lots 6 to 10 on Block 1, and Lots 3 to 10 of Block 2. The Original Plat also assigns the reversionary rights for the entire width of the Street to the owners of the afore -mentioned parcels. In time, the subject Street was enlarged in width by approximately five feet and improved along its corridor in order to accommodate traffic flow and vehicle parking along its route. Today, the Applicant owns all the properties bisected by the Street to the north and to the south. On April 18, 2017, the Applicant was awarded a lease from the Miami Dade County Board of Commissioners for the Omni Bus Terminal, located on Block 1 (known as proposed Tract 1) and abutted by NE 15 Street to the north, NE 14 Terrace to the south, North Bayshore Drive to the east and Biscayne Boulevard to the west. The south portion of the Plat, (noted on the plans as proposed Tract 2) will be added to the County's property pursuant to the approved Tentative Plat, and will be deeded to the County. The Applicant has stated that the entirety of the vacated right-of-way will be owned, developed and operated for public use for the purpose of a bus terminal under the ownership of Miami -Dade County Transit. The reason for the vacation and closure of NE 14 Terrace is to incorporate the closed section of this Street into Tract 1 and Tract 2 of the "Awana Forest Tentative Plat", approved with conditions by the Plat and Street Committee Meeting on September 25, 2017. Excerpt of Awana Forest T-Plat The purpose of this Plat is for the expansion of the existing bus terminal footprint located north of the Street and for the widening of the street circulation within the Property to accommodate site improvements and to facilitate the circulation of single and bi-articulated buses in and around the site. In addition, the Applicant proposes to construct a 5,000 square foot retail building on site, fronting Biscayne Boulevard. PZAB File ID No 3997. Page 2 of 7 With the proposed closure of NE 14 Terrace, the result of the proposed improvements will be the addition of a higher quality air conditioned bus terminal system for the ridership, accommodation of different types of buses that circulates in and around the area, and the addition of a new commercial building fronting Biscayne Boulevard. C. ANALYSIS On September 25, 2017, the Plat and Street Committee approved the tentative plat with conditions for technical requirements. In accordance with Section 55-15 (c) of the City Code of Ordinances, the Applicant's request was evaluated by the Plat and Street Committee, and the Planning Staff using four (4) criteria listed in Chapter 55. The complete list of Findings is provided as Attachment "B," and summarized below: Criteria 9: Plat and Street Committee Finding: Criteria 2: Plat and Street Committee Finding: Criteria 3: Is the request in the public interest, or would the general public benefit from the vacation of the rights -of -ways or Easements? The Street is approximately 30 feet in width where today's standards call for a 50 foot width, rendering it a substandard right-of-way. Although public, the Street is mostly utilized for circulation of the Buses serving the Terminal abutting to the north, Public will benefit from business and development on the site. Is the general public no longer using the right-of-way or Easement, including public service vehicles such as trash and garbage truck, police, fire or other emergency vehicles? The subject Street is rarely trafficked. NE 14 Terrace is a one way eastbound Street that begins at Biscayne Boulevard and ends at North Bayshore Drive. Emergency service vehicles currently have access from the adjacent main streets. Fire Rescue vehicles have great difficulty turning onto and navigating NE 14 Terrace due to its narrow width. The vacation and closure of this Street may eliminate an inactive Street and may allow for the redevelopment of the Property by activating its uses and enhancing policy services. Would there be no adverse effect on the ability to provide police, fire or emergency services? Plat and Street There is no adverse effect because there is no current use for emergency Committee Finding: services. There will be no adverse effect upon police, fire or emergency services, because none of the foregoing services currently use the Alley. At this time, all properties abutting the Alley have frontage on a public street, and are able to receive public services from that frontage. Criteria 4: Would the vacation and closure of the rights -of -way or Easements have a beneficial effect on pedestrian and vehicular circulation in the area? PZAB File ID No 3997. Page 3of7 Plat and Street The Street is substandard in width. It does not facilitate nor continue the Committee Finding: established grid of streets in the area. The Street is detrimental to vehicular circulation as it is a one-way from Biscayne Boulevard to North Bayshore Drive. The Committee determined that there would be no effect on pedestrian and vehicular circulation in the area because the Street does not presently serve as an active vehicular connection between streets. On September 25, 2017, the Plat and Street Committee members voted 6 (six) to 0 (zero) in favor of this Street closure request. D. CONCLUSION The Street closure will promote the development of this Neighborhood and is thereby consistent with the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"). Per findings by the Plat and Street Committee as well as Planning Department the request for a vacation of the Street satisfies the minimum requirements of Section 55-15 of the City Code. E. RECOMMENDATION Pursuant to Chapter 55, Section 55-15, of the City of Miami Code of Ordinances, and the aforementioned findings, the Planning Department recommends approval of the request to close, vacate, abandon and discontinue from public use a Street included in the Awana Forest T-Plat, subject to the following conditions: 1. A building permit, including phased permits, will not be issued on the property being platted until the final plat is recorded or as authorized by the City of Miami Code Section 55-10(i). 2. A Certificate of Occupancy or Certificate of Use shall only be issued after all the required subdivision improvements have been completed. 3. The Applicant, owner, or their successor must comply with all the conditions of approval stated for the Awana Forest Tentative Plat #1904, in a letter dated October 10, 2017 issued by the Department of Public Works. 4. The Applicant, owner, or their successor must comply with all applicable development standards identified in the Miami 21 Code and all applicable local, County, State, and Federal regulations. A letter from the Miami -Dade Water and Sewer Department is required to determine if any adjustments to their facilities or easements are required (only for road and/or alley vacation). 35. Existing utilities located within the street, alley, and easement to be closed and vacated must be relocated or easements provided. 36. Provide a legal opinion as to if any claim has been filed for reversionary rights to the Right of Way to be closed and vacated, pursuant to Florida Statutes Chapter 177, Section 177.085. 37. Public Hearing/Planning, Zoning and Appeals Board (PZAB). a. An Opinion of Title as to reversionary rights for the right-of-way to be closed and vacated will be required by the PZAB (does not apply for easement within private property). The Opinion of Title must also address whether or not there are individuals, in addition to the abutting property owners, having an interest in the right-of-way to be closed and vacated. A copy of the Opinion of Title must be provided to the Public Works Department. b. The PZAB will require a sketch and legal description with a square footage, on an 8'/2" X 11" paper, for the proposed closure. Contact the Office of the Hearing Boards, at 305-416- 2030. Provide a copy to the Public Works Department. 38. The Plat and Street Committee has reviewed the tentative plat of Awana and determined that all technical requirements contained in the Miami City Code Subdivision Regulations have been met and has approved the tentative plat. The members of the Plat and Street Committee have further considered the request for vacation and closure of the street with respect to Miami City Code requirements and have voted 6 in favor and 0 in denial of this vacation and closure request. Standard Comments 39. A letter from Comcast is required to determine if any adjustments to their facilities or easements are required. 40. Verify with Miami -Dade County that the proposed plat name is acceptable. 41. All encroachments across proposed tract and/or lot lines must be removed prior to final plat submittal. 42. An Opinion of Title, in the City of Miami Opinion of Title form, must be provided at the time of final plat submittal. 43. Current backup documentation will be required for all who execute the final plat. A resolution for authority to execute documents and a Certificate of Good Standing from the Secretary of State are required, if applicable. 44. Tentative plat application must be made with Miami -Dade County after receiving approval from the City of Miami Plat and Street Committee. Provide a copy of the notice of action to Public Works. 45. Be advised that an incomplete final plat package will not be accepted by the City of Miami. It is the owner's responsibility to work with his/her surveyor and attorney to assure that everything is in order before submitting the final plat package. 46. Be advised that if all requirements for scheduling the final plat for City Commission action are not in order, the final plat will not be scheduled for a City Commission meeting. 47. A letter of concurrency from Miami -Dade County School Board is required prior to the final plat approval (see contact sheet). The tentative plat name and tentative plat number must be included on the application form. 48. A letter from Miami -Dade Water and Sewer Department is required to release the final plat in connection with water and sewer service agreements. 49. For informational purposes, provide two 8 '/2" x 11" sketches of the division of the land; one sketch of the existing divisions before the plat is recorded and one sketch of the divisions after the plat is recorded. State and local laws require the installation of various physical improvements in the public rights - of -way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. REQUIRED: The submission of an electronic file of the tentative plat, in an AutoCAD, to the City of Miami Public Works Department, Roadway Plans Section will EXPEDITE the preparation and enhance the ACCURACY of the subdivision improvement letter required for the final plat approval. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat is recorded or as authorized by the City of Miami Code Section 55-10(i). Also, the Temporary Certificate Occupancy and/or Certificate of Occupancy for any building construction will be issued only after all the required subdivision improvements have been completed. 4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the issuance of a building permit. 5. In order to mitigate problems associated with access and construction activities throughout the neighborhood, the contractor/developer is encouraged to notify the affected neighborhood residents, in writing, of the project starting and completion dates at the time of issuance of permits. The contractor/developer may coordinate the notification of residents with the local City of Miami NET Service Center. 6. Additional items must be provided to the City of Miami Department of Public Works before the final plat is submitted to the City Commission for approval. You will be notified in writing as to what these items are after the amount of the bond has been determined for the necessary subdivision improvements. It is required that the applicant contacts the City of Miami Public Works Survey Section to verify that all final plat submittal documents are complete prior to final plat submittal. 7.
