City of Miami Legislation Resolution Enactment Number: R-18-0417 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 4557 Final Action Date:9/27/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY ATTORNEY TO TAKE NO FURTHER ACTION AND TO STAY THE SETTLEMENT AGREEMENT ENTERED INTO BETWEEN ALTERNATIVE PROGRAMS, INC., AND THE CITY OF MIAMI IN CIRCUIT COURT CASE NUMBER 2017-012398-CA-01 (32) FORA PERIOD OF EIGHTEEN (18) MONTHS. WHEREAS, the City of Miami ("City") filed a foreclosure action against the property located at 151 Northwest 60th Street, Miami, Florida to foreclose on an unsafe structure lien in the amount of $176,498.77 and code enforcement liens in the amount of $145,750.00; and WHEREAS, the parties agreed to settle the foreclosure matter for a payment to the City in the total amount of $182,500.00; and WHEREAS, Alternative Programs, Inc. was to make monthly payments in the amount of $8,750.00 starting on February 28, 2018, to satisfy the City's liens and the settlement in the foreclosure matter; and WHEREAS, Alternative Programs, Inc. has failed to comply with the settlement agreement by failing to make the requisite payments; and WHEREAS, Alternative Programs, Inc. is requesting an eighteen (18) month extension from the enforcement of said settlement in order to fully comply; and WHEREAS, Alternative Programs, Inc. has agreed to enter into an amended stipulation agreement, which will incorporate the granting of the eighteen (18) month stay with the previously negotiated terms, which shall be filed in the Circuit Court of the 11 th Judicial Circuit in and for Miami -Dade County, Florida; and WHEREAS, the City Commission desires to grant this request to stay the litigation for eighteen (18) months; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission directs the City Attorney to stay the matter for a period of eighteen (18) months. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City.
