AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO.
13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
MORE SPECIFICALLY BY AMENDING ARTICLE 1, SECTION 1.2 ENTITLED "DEFINITIONS
OF TERMS," ARTICLE 3, SECTION 3.6, ENTITLED "OFF-STREET PARKING AND LOADING
STANDARDS," ARTICLE 3, SECTION 3.14, ENTITLED "PUBLIC BENEFITS PROGRAM,"
ARTICLE 4, TABLE 4, ENTITLED "DENSITY, INTENSITY, AND PARKING," AND ARTICLE 4,
TABLE 7, ENTITLED "CIVIC SPACE TYPES," TO PROVIDE FOR FUTURE OPPORTUNITIES
FOR ENHANCEMENTS TO THE UNDERLINE CORRIDOR; CONTAINING A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on November 1, 2017, the Planning, Zoning and Appeals Board ("PZAB")
considered this matter at a duly noticed public hearing, and adopted PZAB-R-17-084,
recommending approval, by a vote of 7-0; and
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114
as the Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and
WHEREAS, the Underline is a ten (10) mile proposed linear park system to operate as
an urban trail and multimodal corridor along the previously designated M-Path corridor below
Miami's Metrorail; and
WHEREAS, The Underline presents an extraordinary opportunity to generate a
significant amount of economic development in the region by increasing property values along
the corridor and thus stimulating new and unique developments that can reinforce the
Underline's vision as a new sector of the region; and
WHEREAS, access between the Underline greenways and trails will provide
interconnectedness and mobility opportunities from surrounding recreation spaces; and
WHEREAS, it has been determined that amending Article 1, Section 1.2, of the Miami 21
Code, entitled "Definitions," Article 3, Section 3.6, entitled "Off -Street Parking Requirements,"
Article 3, Section 3.14, entitled "Public Benefits Program," and Article 4, Table 4 entitled
"Density, Intensity, and Parking," and Article 4, Table 7, entitled "Civic Space Types," is needed
to promote appropriate development benefits for the Underline and other linear park systems
throughout the City; and
WHEREAS, the City Commission has considered whether the proposed amendment will
further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan, the
Miami 21 Code, and other City regulations;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Article 1, Section 1.2 of the Miami 21 Code, entitled "Definitions," is further
amended in the following particulars:1
"ARTICLE 1. DEFINITIONS
1.2 DEFINITIONS OF TERMS
Frontage: The area between a Building Facade and the vehicular lanes of a Thoroughfare or the
pavement of a Pedestrian Passage Frontage Line of a Civic Space Type.
Linear Park: See Article 4, Table 7.
The Underline: A Linear Park as described within Article 4, Table 7 along the previously
designated M-Path corridor below Miami's Metrorail.

Section 3. Article 3 of the Miami 21 Code is further amended in the following
particulars:1

b. Within Transit Oriented Development ("TOD") areas, required bicycle parking shall be
provided as either Short -Term Bicycle Parking or Long -Term Bicycle Parking.
1. Short -Term Bicycle Parking may be located within the public ROW or a required
Setback.
2. Long -Term Bicycle Parking shall be located within a built structure, subject to the
standards outlined below.
SECTION 3.14 PUBLIC BENEFITS PROGRAM

3.14.1 The bonus Height and FLR shall be permitted if the proposed Development contributes
toward the specified public benefits, above that which is otherwise required by this Code, in the
amount and in the manner as set forth herein.
The bonus shall not be available to properties in a T6 Zone if the property abuts a T3 Zone or in
a T6 8 Zonc if the property abuts a CS Zone.

3.14.3 The proposed bBonus Height and FLR shall be permitted in exchange for the
following public benefits: LU aAffordable/wWorkforce #Housing, 2j Public Parks and
Open Space, (3) the Underline, Green Buildings, j Brownfields, and Oj Civic
Space or Civil Support &Space.
The City shall establish a Miami 21 Public Benefits Trust Fund to acceptfor the cash
contributions for Affordable/Workforce Housing and Public Parks and Open Space,
andas well as deposit any Green Building certification shortfall penalty made under,
as set forth in this section. The City Commission, upon the mCity Manager's
recommendation, shall annually allocate any funds contributed pursuant to decidc
the allocation of funds from the Trust Fund collected underthis section. All cash
contributions thu&Funds allocated by the Commi;sionto support
Aaffordable/Wworkforce Housing shall be deposited in the Affordable Housing Trust
Fund for expenditures pursuant to the guidelines adopted by the City Commission.
All cash contributions thusFunds allocated by the Commi"sionto support Parks and
Open Space shall be deposited in the Parks and Open Space Trust Fund, set forth in
Chapter 62 of the City Code, to be expended in accordance with the guidelines
outlined therein.
The City shall establish the Underline Trust Fund to accept cash contributions for
improvements and maintenance to the Underline, as set forth in this Section. The
City Commission, upon the City Manager's written recommendation, shall annually
allocate any funds contributed pursuant to this Section. Funds allocated to support
enhancements to the Underline shall be deposited in the Underline Trust Fund, set
forth in Chapter 62 of the City Code, to be expended in accordance with the
guidelines outlined therein.

5. The Underline shall mean: A Linear Park within the City meeting the standards
of Article 4, Table 7 and further described within the Underline Master Plan.
3.14.4 For the purposes of the public benefits program, the following criteria shall apply:
q. The Underline Improvements. A development project abutting the Underline in a T6
Transect Zone may provide any of the following or combination thereof, subject to review
and approval by the Miami -Dade County Department of Transportation and Public
Works, with recommendations from the Planning Director:
1. Improvements to the Underline, consistent with the Underline Master Plan, shall
be valuated and for said value the development project shall be allowed additional
Floor Area up to the bonus Height and FLR described in Section 3.14.1.
2. Trust Fund contribution. For a cash contribution to the Underline Trust Fund,
the development project shall be allowed additional Floor Area up to the bonus
Height and FLR described in Section 3.14.1. The cash contribution shall be
determined based on a percentage of the market value of the per square foot
price being charged for units at projects within the market area where the
proposed project seeking the bonus is located. The calculation assumes a land
value per saleable or rentable square foot within market area to equate to
between 10 (ten) to 15 (fifteen) percent of the market area's weighted average
sales price per square foot. The cash contributions shall be adjusted on an annual
basis to reflect market conditions effective as of October 1st of every year.

TABLE 7 CIVIC SPACE TYPES
a. Park: A natural preserve available for unstructured and structured recreation
programs. A Park may be independent of surrounding Building Frontages. Its
landscape may be naturalistic and consist of paths and trails, meadows,
woodland, sports fields and open shelters. Parks may be Conservation Areas,
preserving natural conditions and their size may vary.
Linear Park: A continuous public space intended for recreation and conveyance that
links to a larger greenway and trail network. A Linear Park shall have minimum length of
a half -mile and an average width of 14 feet or more, but may at no point have a width
less than 8 feet. Its landscape should be similar to a Park with bike and pedestrian trails
through the space for enhanced connectivity. Buildings fronting a Linear Park shall be
considered a Principal Frontage in all Transect Zones except in T3 Transect Zones.

this Ordinance is declared invalid, the remaining provisions of this Ordinance should not be
affected.
