Subject: Mutual Aid Agreement - City of North Miami Beach
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a Voluntary Cooperation and Operational Assistance Mutual Aid
Agreement, in substantially the attached form, between the City of Miami and the City of
North Miami Beach, to receive and extend mutual aid in the form of law enforcement
services and resources to ensure public safety and adequately respond to intensive
situations, including, but not limited to, natural and manmade disasters or emergencies
as defined under Section 252.34 of the Florida Statutes or requests for certain law
enforcement services specified herein and as defined under Section 23.1225 of the
Florida Statutes.
Background of Item:
There is an existing and continuing possibility for the occurrence of law enforcement
problems, and other natural and man-made conditions which are, or are likely to be,
beyond the control of the services, personnel, equipment or facilities of the City of Miami
Police Department or the City of North Miami Beach Police Department.
The City of Miami and the City of Miami Beach are so located in relation to each other
that it is to the advantage of each to received and extend mutual aid in form of law
enforcement services and resources.
The parties to this agreement have the authority under the Mutual Aid Act, Chapter 23,
Part 1, of the Florida Statutes, to enter into a mutual aid agreement for law enforcement
services which:
1. Permits voluntary cooperation and assistance of a routine law enforcement
nature across jurisdictional lines; and
2. Provides for rendering of assistance in a law enforcement emergency.
This agreement shall remain in full force until November 17, 2021.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT,
IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI
("CITY") AND THE CITY OF NORTH MIAMI BEACH ("NMB") TO RECEIVE AND
EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND
RESOURCES TO ENSURE PUBLIC SAFETY AND ADEQUATE RESPONSE TO
INTENSIVE SITUATIONS, INCLUDING, BUT NOT LIMITED TO NATURAL AND
MANMADE DISASTERS OR EMERGENCIES AS DEFINED IN CHAPTER 23, PART 1,
FLORIDA STATUTES, ENTITLED "FLORIDA MUTUAL AID ACT."
WHEREAS, there are natural and manmade challenges faced by the Miami Police
Department ("MPD") and other municipal police departments that are, or are likely to be, beyond
the control of the services, personnel, equipment, or facilities of the municipal police
departments; and
WHEREAS, the City of Miami ("City") and the City of North Miami Beach ("NMB") wish to
enter into a Voluntary Cooperation and Operational Assistance Mutual Aid Agreement ("MAA")
to ensure that preparation and resources from their respective law enforcement agencies will be
adequate to address natural and manmade challenges, to protect the public peace and safety,
and to preserve the lives and property of the residents of the City and NMB; and
WHEREAS, the City and NMB have the authority under the Florida Mutual Aid Act,
Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into mutual aid
agreements; and
WHEREAS, the City and NMB have the authority under the Florida Interlocal
Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into
interlocal agreements for purposes of permitting local governmental units to make the most
efficient use of their powers by enabling them to cooperate with other localities on a basis of
mutual advantage and thereby provide services and facilities in a manner and pursuant to forms
of governmental organization that will accord best with geographic, economic population, and
other factors influencing the needs of the local communities;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute the MAA, in substantially the
attached form, between the City and NMB to receive and extend mutual aid in the form of law
enforcement services and resources to ensure public safety and adequate response to intensive
situations, including, but not limited to natural and manmade disasters or emergencies as
defined in Chapter 23, Part 1, Florida Statutes, entitled "Florida Mutual Aid Act."
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
