HomeMy WebLinkAboutR-18-0366City of Miami Resolution R-18-0366 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 4515 Final Action Date: 9/13/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE MUTUAL AID AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND THE CITY OF AVENTURA, TOWN OF GOLDEN BEACH, CITY OF HIALEAH, CITY OF HOMESTEAD, VILLAGE OF KEY BISCAYNE, CITY OF CORAL GABLES, CITY OF SWEETWATER, AND CITY OF WEST MIAMI (COLLECTIVELY, "PARTICIPATING MUNICIPALITIES") TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ENSURE PUBLIC SAFETY AND ADEQUATE RESPONSE TO INTENSIVE SITUATIONS, INCLUDING, BUT NOT LIMITED TO NATURAL AND MANMADE DISASTERS OR EMERGENCIES AS DEFINED IN CHAPTER 23, PART 1, FLORIDA STATUTES, ENTITLED "FLORIDA MUTUAL AID ACT." WHEREAS, there are natural and manmade challenges faced by the Miami Police Department ("MPD") and other municipal police departments that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the respective municipal police departments; and WHEREAS, the City of Miami ("City") and the City of Aventura, Town of Golden Beach, City of Hialeah, City of Homestead, Village of Key Biscayne, City of Coral Gables, City of Sweetwater, and City of West Miami (collectively, "Participating Municipalities") wish to enter into Mutual Aid Agreements ("MAA") to ensure that preparation and resources from their respective law enforcement agencies will be adequate to address natural and manmade challenges, to protect the public peace and safety, and to preserve the lives and property of the residents of the City and the Participating Municipalities; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into the MAA; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into the MAA for a purposes of permitting local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic population, and other factors influencing the needs of the local communities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 4515 (Revision: A) Printed On: 4/3/2025 File ID: 4515 Enactment Number: R-18-0366 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to execute MAA between the City and the Participating Municipalities to receive and extend mutual aid in the form of law enforcement services and resources to ensure public safety and adequate response to intensive situations, including, but not limited to natural and manmade disasters or emergencies as defined in Chapter 23, Part 1, Florida Statutes, entitled "Florida Mutual Aid Act." Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity ktor ey 8/31/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
