Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), establishing a new
Special Revenue Project, entitled: "Pedestrian and Bicycle Safety Enforcement
Campaign, WalkWise;" authorizing the City Manager to execute the Letter of Agreement
and Contract and accompanying documents, in substantially the attached form,
between the City of Miami ("City") and the University of South Florida Board of Trustees
for reimbursements of overtime expenses in an amount not to exceed $88,000.00 for
City Police Department officers conducting traffic enforcement details and community
education initiatives consistent with the Pedestrian and Bicycle Safety Enforcement
Campaign; further authorizing the City Manager to designate the Chief of Police to
execute any and all other necessary documents, in a form acceptable to the city
attorney, for acceptance of said reimbursement funds.
Background of Item:
The intent of this contract is to utilize law enforcement support to enhance a
comprehensive safety campaign that will educate pedestrians, bicyclists, and motorists
of safe behaviors within high priority intersections within the City of Miami. The Traffic
Enforcement Unit will be responsible for these enforcement activities. Education and
enforcement activities may include warnings and/or citations to pedestrians, bicyclists,
and motorists in accordance with Florida Statutes. Enforcement officers will distribute
safety educational materials during all High Visibility Enforcement operations and is
required to engage the media during the contractual period distribution. The University
will provide the City of Miami copies of the required training materials, a copy of
Florida's Pedestrian and Bicycle Strategic Safety Plan, educational materials for
distribution and approved safety messages.

A RESOLUTION OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW
SPECIAL REVENUE PROJECT TITLED "PEDESTRIAN AND BICYCLE SAFETY
ENFORCEMENT CAMPAIGN, WALKWISE;" AUTHORIZING THE CITY MANAGER TO
EXECUTE THE LETTER OF AGREEMENT, CONTRACT, AND ACCOMPANYING
DOCUMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY
OF MIAMI AND THE UNIVERSITY OF SOUTH FLORIDA BOARD OF TRUSTEES
FOR REIMBURSEMENT OF OVERTIME EXPENSES IN AN AMOUNT NOT TO
EXCEED $88,000.00 FOR MIAMI POLICE DEPARTMENT OFFICERS CONDUCTING
TRAFFIC ENFORCEMENT DETAILS AND COMMUNITY EDUCATION INITIATIVES
CONSISTENT WITH THE PEDESTRIAN AND BICYCLE SAFETY ENFORCEMENT
CAMPAIGN; FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE
CHIEF OF POLICE TO EXECUTE ANY AND ALL OTHER NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
ACCEPTANCE OF SAID REIMBURSEMENT FUNDS.
WHEREAS, the National Highway Traffic Safety Administration ("NHTSA"), Florida
Department of Transportation ("FDOT") through a Task Work Order managed by the University
of South Florida ("USF") utilizes local law enforcement support to develop an effective,
integrated, grassroots pedestrian safety initiative in two (2) focus cities in the State of Florida;
and
WHEREAS, the purpose of this project is to develop and integrate an effective
grassroots educational and high visibility enforcement program that influences behaviors
benefitting high -risk pedestrian and bicyclist groups along approved high crash corridors to
reduce traffic crashes resulting in injuries and fatalities; and
WHEREAS, the Letter of Agreement and Contract and accompanying documents
(collectively, "Agreement") are intended to utilize the support of the Miami Police Department
("MPD") by allotting funds to implement a comprehensive enforcement and educational
campaign that addresses motor vehicle crashes resulting in injuries and fatalities to pedestrians
and bicyclists within high priority intersections throughout the City of Miami ("City"); and
WHEREAS, this high visibility enforcement program is managed through the Agreement
and NHTSA, FDOT has allotted funds in an amount not to exceed $88,000.00 to reimburse the
City for overtime expenses disbursed to MPD officers conducting on -street enforcement
operations that promote pedestrian and bicycle safety or making on -street contacts with the
public to deliver the initiative's safety message; and
WHEREAS, the MPD's Traffic Enforcement Unit has prepared a program plan for
purposes of conducting the enforcement and education component of the initiative pursuant to
the Agreement; and
WHEREAS, no matching funds are required from the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Project is established and resources are
appropriated as described below:
FUND TITLE: Pedestrian and Bicycle Safety Enforcement
Campaign, WalkWise
RESOURCES: USF and NHTSA, FDOT: $88,000.00
APPROPRIATIONS: Reimbursement of overtime expenses: $88,000.00
Section 3. The City Manager is authorized to execute the Agreement, in
substantially the attached form, between the City and USF Board of Trustees for
reimbursement of overtime expenses in an amount not to exceed $88,000.00 for MPD
officers conducting traffic enforcement details and community education initiatives
consistent with the pedestrian and bicycle safety enforcement campaign.
Section 4. The City Manager is further authorized' to designate the Chief of Police
to execute any and all other necessary documents, in a form acceptable to the City
Attorney, for the acceptance of said reimbursement funds.
Section 5. This Resolution shall become effective immediately upon its adoption
and signature of the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited, to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
