Background of Item: The City of Miami ("City") applied for and was awarded a federal grant for the Overtown Greenway along NW 11th Sreet from NW 7th Avenue to NW 12th Avenue, Project 40- B173648. FDOT will serve as the pass -through agency for the federal funds. LAP Agreement with FDOT is required to access the awarded funds. The Overtown Greenway Project will extend the Overtown Greenway into the next phase uniting the Overtown and Spring Garden neighborhoods by providing the critical missing connection between the Miami Riverwalk, the existing Overtown Greenway and the Culmer Metrorail Station. The construction of the multi -use path within the swale area will make use of the existing sidewalk and right-of-way along the north side of NW 11th Street without requiring additional right-of-way. The project will include decorative sidewalk treatment, specialty signage, trash receptacles, benches, landscaping, and the repair of affected curbs along the north side of the corridor. Currently, the Overtown Greenway Project is included in FDOT's five-year work program. The City Manager requests authority to accept the funds and execute the necessary LAP Agreement. Funds are to be appropriated by separate Resolution for a total allocation of $822,891.00 for the Overtown Greenway Project. This includes $760,000.00 for construction and $62,891.00 for Construction Engineering Inspection (CEI). WHEREAS, the City of Miami ("City") applied for and was awarded a federal grant for the extension of the Overtown Greenway along Northwest 11th Street from Northwest 7th Avenue to Northwest 12th Avenue as associated with the City's Office of Capital Improvements Project No. 40-B173648 ("Project"); and WHEREAS, the Project unites the Overtown and Spring Garden neighborhoods by providing the critical missing connections between the existing Overtown Greenway, the Miami Riverwalk, and the Culmer Metrorail Station with construction of a multi -use path within the swale area, making use of existing sidewalk and right-of-way area along the northside of Northwest 11th Street, without requiring additional right-of-way, and provides for decorative sidewalk treatment, specialty signage, trash receptacles, benches, landscaping, and the repair of affected curbs along the northside of the corridor; and WHEREAS, through the Local Agency Program ("LAP"), the Florida Department of Transportation ("FDOT") will serve as the pass -through agency for Federal Government grant funds in an amount not to exceed Eight Hundred Twenty -Two Thousand Eight Hundred Ninety - One Dollars ($822,891.00) ("Grant Funds") for the funding of the Project; and WHEREAS, of the Grant Funds for the Project, Seven Hundred Sixty Thousand Dollars ($760,000.00) will fund the construction costs and Sixty -Two Thousand Eight Hundred Ninety - One Dollars ($62,891.00) will fund the construction engineering inspection costs, amounts currently included as part of FDOT's Five (5) Year Work Program; and WHEREAS, the City Manager requests authority to execute the required LAP Agreement with FDOT ("Agreement"), in substantially the attached form, for acceptance of the Grant Funds for the Project with said funds to be appropriated by a separate resolution; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the Agreement for the Grant Funds for the Project with said funding to be appropriated by a separate resolution. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
