Subject: Authorize Agreement - Railroad Crossing at NE 42nd Street and NE 4th Avenue
Purpose of Item:
To accept funds in the amount of $500,000 from the State of Florida, Department of
Economic Opportunity ("DEO") to fund the cost of public infrastructure and rights -of -way
improvements within the Miami Design District at NE 42st Street between NE 4th
Avenue and Federal Highway, associated with the Capital Improvements Project No. B-
173901, "Railroad Crossing at NE 42nd Street and NE 4 Avenue" (the "Project"). This
resolution further authorizes the City Manager to execute a Grant Agreement in
substantially the attached form, with the DEO for said purpose.
Background of Item:
In April 2018, the Office of Capital Improvements was notified about a $500,000 FDEO
grant that was made available to the City for the Project. The funding program does not
require a match contribution. The Grant Funds from the DEO shall be used solely for
costs associated with the Project. The City shall be reimbursed upon 100% completion
of the Project by the end of the grant agreement, which expires June 30, 2019. Funds
are to be appropriated by separate Resolution for a total allocation of $500,000.00, for
the Railroad Crossing at NE 42nd Street and NE 4 Avenue Project.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT AGREEMENT WITH
THE STATE OF FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY ("FDEO"),
IN SUBSTANTIALLY THE ATTACHED FORM, FOR PUBLIC INFRASTRUCTURE AND
RIGHT-OF-WAY IMPROVEMENTS AT NORTHEAST 42ND STREET BETWEEN
NORTHEAST 4TH AVENUE AND FEDERAL HIGHWAY ASSOCIATED WITH THE
CITY OF MIAMI'S OFFICE OF CAPITAL IMPROVEMENTS ("OCI") PROJECT NO. B-
173901 REFERENCED AS THE "RAILROAD CROSSING AT NORTHEAST 42ND
STREET AND NORTHEAST 4TH AVENUE" ("PROJECT"); FURTHER, ACCEPTING
GRANT FUNDS IN AN AMOUNT NOT TO EXCEED FIVE HUNDRED THOUSAND
DOLLARS ($500,000.00) ("GRANT FUNDS") FOR THE IMPLEMENTATION OF THE
PROJECT WITH SAID FUNDS TO BE APPROPRIATED BY A SEPARATE
RESOLUTION.
WHEREAS, the City of Miami ("City") will be performing public infrastructure and right-of-
way improvements at Northeast 42nd Street between Northeast 4th Avenue and Federal
Highway as part of the City's Office of Capital Improvements ("OCI") Project No. B-173901
referenced as the "Railroad Crossing at Northeast 42nd Street and Northeast 4th Avenue"
("Project"); and
WHEREAS, the Project shall include, but not be limited to, the building of a new roadway
across the existing railroad crossing to allow for vehicular traffic along with other roadway
enhancements such as traffic signals, street lighting, sidewalks, Americans with Disabilities Act
("ADA") compliant ramps, curbs and gutters, drainage improvements, and modifications to the
existing on -street parking within the public right-of-way; and
WHEREAS, in response to the community's request for said improvements, specifically
the new roadway across the existing railroad crossing in the City's Design District, the State of
Florida Department of Economic Opportunity ("FDEO") Division of Community Development has
committed to the provision of funding in an amount not to exceed Five Hundred Thousand
Dollars ($500,000.00) ("Grants Funds") to be used solely for the costs associated with the
Project; and
WHEREAS, the City Manager is requesting authorization to execute a Grant Agreement
("Agreement") with the FDEO, in substantially the attached form, for acceptance of the Grant
Funds for the Project with said funds to be appropriated by separate resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute an Agreement with the FDEO, in
substantially the attached form, for acceptance of the Grant Funds for the Project with said
funds to be appropriated by a separate resolution.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
