A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO ACCEPT INFORMATIONAL ADVERTISEMENTS INVOLVING
HUMAN RIGHTS ISSUES AND HUMAN RIGHTS VIOLATIONS IN ANY
COUNTRY; ACCEPTING THE ADVERTISING PROPOSAL MADE BY
ORLANDO GUTIERREZ TO THE MIAMI CITY COMMISSION FINDING THAT
SUCH ADVERTISEMENTS WILL BE INFORMATIONAL AND NOT ADVOCATE
A PARTICULAR POLITICAL CAUSE OR ISSUE.
WHEREAS, the City of Miami ("City") operates a municipal trolley system throughout the
City; and
WHEREAS, the Request for Proposals ("RFP") issued for Trolley Advertisement
Program Services provides that unacceptable advertising includes advertising that supports or
opposes a particular candidate, political cause or issue, or a religious belief; and
WHEREAS, at the City Commission meeting of September 13, 2018, Orlando Gutierrez
made a presentation relating to his proposal for an advertisement, which was accepted by the
City Commission, that is informational in nature and discusses human rights issues and human
rights violations; and
WHEREAS, the City Commission finds that informational advertising concerning human
rights issues and human rights violations has a public benefit in that it fosters a well-informed
public; and
WHEREAS, THE City Commission finds that informational advertisements regarding
human rights issues and human rights violations, from all points of view, are in the public
interest, and serves a public purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and finding contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The informational advertisement proposal made by Mr. Orlando Gutierrez to
the Miami City Commission, at their meeting of September 13, 2018, is hereby accepted.
Advertisements involving human rights issues and human rights violations in any country are
found to be informational in nature, and will not advocate a particular political issue or cause.
Section 3. The City Manager is advised and instructed that the City's Trolley System,
subject to compliance with applicable ("RFP") and contractual provisions, will accept
informational advertising involving human rights issues and human rights violations in any

country. The City Manager is authorized' to take any needed administrative measures to
implement this Resolution. This is considered informational advertising.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
